On motion of Mr. Lawrence,

The bill was read a second time, and ordered to be engrossed and read a third time to-morrow.

Mr. Lawrence from the Judiciary committee to whom was referred the petition of Almazon Huston, reported the same as follows:

The Judiciary committee, to which was referred the petition and accompanying papers of Amanzon Huston, to be divorced from his wife Elizabeth, have had the same under consideration, and beg leave to report, that it does not appear that any notice whatever has been given by said Huston of his intention to make this application for a divorce.-Your committee, therefore, ask leave to be discharged from the further consideration of the petition.

The report was on motion of Mr. Lawrence, concurred in. Mr. M'Donell from the committee on Territorial Affairs, reported,

A bill for the preservation of health and the removal of nuisances.

The bill was read the first time.

On motion of Mr. M'Donell,

The bill was read a second time and ordered to lie on the table.

A message was received from the Governor, by Mr. Rowland, notifying the Council that he had this day approved and signed,

An act to amend the several laws now in force for the relief and settlement of the poor.

Mr. Schoolcraft from the committee on Expenditures, to whom was referred the report of the fiscal agent of the Council, reported a recommendation that the statement be spread on the journal.

The report being concurred in, the statement of the agent is as follows:

SIR-I have the honor to enclose herewith a statement, exhibiting the amount appropriated for the expenses of the Council for the year 1830, and the sum expended, together with the amount reported to Congress at its present session as necessary for the service of the year 1831.

I have seen the copy of the general appropriation bill for the year 1831, in which the amount appropriated for the Council was $8,290, but as the sums stated for Florida and Arkansas, were much less, it is probable the allowance for Michigan will be reduced upon the passage of the bill. February 22, 1831. Mr. Fletcher from the committee on the Judiciary, reported

A bill to amend an act entitled an act concerning mortgages.

The bill was read the first time.

On motion of Mr. Fletcher, the bill was read a second time, and ordered to be engrossed and read a third time

to-morrow.

The bill to provide for laying out and establishing certain Territorial roads, was read a second time and considered as in committee of the whole.

On motion of Mr. Stockton, the bill was amended by adding the following to stand as section 10.

Sec. 10. That if from any cause, the commissioners appointed to lay out and establish the road from Mount Clemens, to the Sault Ste Marie in the county of Chippewa, should be unable to perform that duty, then and in that case, said commissioners may lay out and establish said road to the seat of Justice in Saginaw county.

Mr. M'Donell moved to lay the bill on the table.
The motion was negatived.

Mr. Drake moved to strike out so much of the bill as relates to the establishment of a road from Saganaw to the Sault Ste Marie.

The motion was negatived.

Ayes-1.

Nays-11.

Mr. Drake voted in the affirmative.

In the negative, Messrs. Bartow, Brown, Durocher, Fletcher, Kingsley, Lawrence, Le Roy, M'Donell, Schoolcraft, Stockton, Edwards-11.

The bill being reported, the amendments were concurred in.

On motion of Mr. Stockton,

The bill was ordered to be engrossed and read a third time on Thursday.

The bill relative to the county of Wayne was read a second time, and considered as in committee of the whole. On motion of Mr. Fletcher,

The bill was amended by striking out the 5th section and substituting the following:

Sec. 5. That the assessors in the several townships in said county, shall in their assessment of property therein, subject to taxation, assess the same according to the then actual cash value thereof, and be governed by such criterion of value solely.

Mr. Bartow moved to strike out all after the enacting clause, and substitute the following:

That it shall be the duty of the assessors of the several townships, in taking the assessments to value property both real and personal, at such sum as the same may be currently exchanged for cash.

Sec. 2. That it shall be the duty of the board of Supervisors of the county of Wayne, to issue whatever County Money be hereafter issued, in such manner, that the same may draw interest until paid at the rate of five per centum.

Sec. 3. That the Supervisors of the several townships in the county of Wayne, shall yearly, levy and raise taxes in

said county to the full amount of one thousand dollars, over and above the current yearly expenses of the county, which sum of one thousand dollars, shall be annually ap plied to the redemption of such county money, as may be now in circulation, until the county debt is fully extinguished by the redemption of said outstanding county money, any law to the contrary notwithstanding.

Mr. M'Donell moved to lay the bill on the table.
The motion was negatived.

The Council took a recess until 3 o'clock, P. M. 3 o'clock P. M. Mr. Schoolcraft presented an account of G. L. Whitney, for printing.

Referred to the committee on Claims.

Mr. Kingsley presented an account of L, Davenport, for a desk.

Referred to the committee on expenditures.

On motion of Mr. M'Donell,

The bill for the preservation of health and the removal of nuisances, was recommitted to the committee on Territorial Affairs.

On motion of Mr. Le Roy,

The bill establishing courts of common pleas in certain counties, and defining their powers and duties, was recommitted to the committee on the Judiciary.

Mr. Fletcher from the committee on Enrolment reported as correctly enrolled, bills with the following titles. An act for fixing the place for holding township meetings, in the township of Erie in the county of Monroe.

An act to amend the several acts to organize the militia. An act to amend an act entitled an act to amend an act entitled an act to regulate taverns.

An act to amend the several acts to provide for the establishment of the University of Michigan.

An act to prescribe the mode of proving, in the courts in this Territory judgments rendered by Justices of the Peace iu the several States.

The Council having resumed the consideration of the bill relative to the county of Wayne,

The bill was ordered to lie on the table.

The bill to incorporate the Hydraulic Company of the City of Detroit, was read a second time, and ordered to be engrossed and read a third time to-morrow.

The bill amendatory to the several laws now in force for

the assessment and collection of Territorial taxes, was read a second time and considered as in committee of the whole. Mr. Schoolcraft moved to strike out the 4th and 5th sections of the bill.

On motion of Mr. Lawrence, the bill was ordered to lie on the table.

The bill to aid the raising of sheep was read a second time, and ordered to be engrossed and read a third time to

morrow.

The bill for the relief of Peter Schoonover, was read a second time.

On motion, ordered, that the bill lie on the table.

The bill to amend the several acts regulating and defining the powers and duties of Justices of the Peace in civil cases, and for other purposes, was read a second time.

Ordered, to be engrossed and read a third time to-mor

row.

The bill relative to proceedings in criminal cases was read a second time, and considered as in committee of the whole.

On motion of Mr. M'Donell,

The bill was amended by adding the following to stand as an additional section :

That any person charged with any offence under this act, shall be entitled to a trial by jury, if required,by such person. On motion of Mr. Stockton,

The 4th section of the bill was stricken out.

The bill being reported as amended, the amendments were concurred in.

On motion of Mr. Bartow,

The bill was ordered to be engrossed and read a third time on Wednesday.

The bill for the relief of Joseph Dozet and Alexis Loranger, was read a second time and considered as in committee of the whole.

On motion of Mr. Lawrence,

The blank was filled with the word 'sixty.'

The bill being reported as amended, the amendments were concurred in.

Mr. Lawrence moved that the bill be engrossed and read a third time to-morrow.

Mr. M'Donell moved to lay the bill on the table.

The motion was negatived.

The motion recurring on the motion to engross, was decided in the affirmative.
