Schoolcraft, relative to creating a Superintendent of Common Schools, was taken up.

On motion of Mr. Schoolcraft, the resolution was amend ed by striking out the first sentence thereof and substituting the following:

Resolved, That the committee on schools be instructed to inquire into the propriety of so amending the act relative to common schools, as to provide a compensation to the superintendent of schools, to be paid out of the Territorial Treasury--and more fully prescribing his duties. On motion of Mr. Schoolcraft,

The resolution, as amended was concurred in.
On motion of Mr. Schoolcraft,

Resolved, That the Directors of the Farmers and Mechanics' Bank of Michigan be directed to furnish a statement of the fiscal operations of that institution, agreeably to the provisions contained in the sixth section of the charter; embracing the period from the establishment of said bank, until the first day of January, 1831.

On motion of Mr. Drake,

The Council adjourned to Monday, at 11 o'clock, A. M.

Mr. Schoolcraft moved to amend the amendment by inserting after the word "St. Clair," the words "Mackinac and Chippewa."

The motion prevailing, the bill was reported as amended. The amendments being concurred in,

On motion of Mr. Drake,

The first section of the bill was further amended by inserting after the word "counties," line 3, the words "in each district;" and striking out the words "in this Territory ly ing east of lake Michigan;" and inserting after the words "be," line 5, the words "appointed for the district," and striking out the words "a person of knowledge and integ rity, and skilled in the law," and inserting after the word justices," line 6, the word "appointed," and striking out, "who shall be inhabitants of after the word "aforesaid," the counties for which they shall be commissioned." The Council adjourned to 10 o'clock, A. M. to-morrow. TUESDAY, February 22, 1831.

Mr. Drake from the select committee, to whom the subject was referred, reported,

A bill to amend the act entitled an act to district the Territory of Michigan, and to provide for the election of the members of the Legislative Council, approved July 3, 1828, and for other purposes.

The bill was read the first time and laid on the table. Mr. Lawrence from the Judiciary committee, reported A bill to amend an act entitled "an act to regulate the admission and practice of Attorneys and Counsellors at law."

The bill was read the first time and laid on the table.

The bill to incorporate the Stockholders of the Clinton Steam Mill Company at Mount Clemens, was read the

third time.

On motion of Mr. Drake,

The bill was amended by adding the following to stand as the 10th section of the bill:

Sec. 10. That the Legislative authority of the Territory, shall have power, at all times to alter, or amend this act." Mr. Stockton moved that the bill pass.

The question being taken, it was decided that the bill do now pass, and that the title thereof be,

An act to incorporate the Stockholders of the Clinton Steam Mill Company at Mount Clemens."

The bill to continue the charter of the Bank of Michigan, was read the third time.

On motion of Mr. Drake,

The bill was amended by striking out in the 11th line, section 1. the words "within two years."

Mr. Stockton moved that the bill pass.

The question being taken, it was decided that the bill do now pass, and that the title thereof be,

An act to continue the charter of the Bank of Michigan. The bill to authorise the board of supervisors of St. Clair county, to erect certain bridges, and for other purposes, was read the third time.

Mr. M'Donell moved that the bill pass.

The question being taken, it was decided that the bill do now pass, and that the title thereof be,

An act to authorise the board of supervisors of St. Clair county to erect certain bridges.

The bill to establish a board of commissioners, with authority to raise a sum of money by lottery, and to locate, open and construct a free road between the city of Detroit and the River Aux Raisin, in the county of Monroe, and for the improving of the navigation of Flint River, and for other purposes, was read a second time and considered as in committee of the whole.

On motion of Mr. Drake,

The bill was amended by inserting section 7, line 2, after the word "road," the words "and improvement of the navigation of said river;" by striking out line 5, the words "locating said roads," and inserting the words "the premi ses;" by inserting section 1, line 10, after the word "roads," and improvement of the navigation of said river."

On motion of Mr. Kingsley,

The bill was further amened by striking out in the 4th section, line 7, all after the word "oaths."

The bill being reported as amended, the amendments were concurred in.

On motion of Mr. M'Donell,

Ordered, That the bill be engrossed and read a third time

to-morrow.

The bill establishing courts of common pleas in certain counties, and defining their powers and duties, was taken

up.

On motion of M. Drake,

The bill was amended, by inserting after the word "conclusive," line 13, section 3, the words "in all cases where the judgment does not exceed $1,000."

On motion of Mr. Drake,

"Impressed with these views, and acting under an imperious sense of duty, as citizens temporarily clothed with the public authority, we most earnestly protest against the principle and policy of granting bills of legislative divorcement.

The bill to provide for the improvement of certain roads, was read a second time, and considered as in committee of the whole.

On motion of Mr. Stockton,

The bill was amended by inserting the following to stand as the 4th section thereof:

Sec. 4. That from the money in the Treasury not otherwise appropriated, there shall be laid out and expended, in repairing the road from Detroit to Fort Gratiot, in the year 1831, a sum not exceeding one hundred dollars.

The bill being reported as amended, the amendments were concurred in.

On motion of Mr. Drake,

Ordered, That the bill be engrossed and read a third time on Tuesday week.

The bill for the relief of Lucy Fish, was read a second time, and on motion of Mr. Drake,

Ordered, To be engrossed and read a third time on Friday.

On motion of Mr. M'Donell,

Ordered, That the bill relative to constables, and

The bill to amend an act entitled "an act to regulate and define the powers of Justices of the Peace and Constables in civil cases," be recommitted to the Judiciary committee. The bill concerning divorces was read a second time, and considered as in committee of the whole.

Mr. Drake moved to amend, by inserting after the word "circuit," the words " or any county or probate." On motion of Mr. Lawrence,

The bill was laid on the table.

The bill fixing the place for holding township meetings in the township of Erie, in the county of Monroe, was read a third time.

Mr. Lawrence moved that the bill pass.

The question being taken, it was decided that the bill do now pass, and that the title thereof be,

An act for fixing the place for holding township meetings in the township of Erie in the county of Monroe.

The bill concerning township clerks, was read a third time.

Mr. Drake moved that the bill pass.

The question being taken it was decided that the bill do now pass, and that the title thereof be,

An act concerning township clerks.

The bill to amend an act entitled an act to prescribe the tenure of office of auctioneers, and to levy a duty upon sales at auction in certain cases, read a third time on the 8th instant, was taken up.

Mr. Drake moved to add the following to stand as the third section of the bill:

Sec. 3. That it shall be lawful for any person, owning the same, to sell at auction, free from charge or duty to the Territory, any lands or tenements within this Territory, and also, any cattle or horses, sheep or swine, any law to the contrary notwithstanding.

On motion of Mr. Lawrence,

Ordered, That the bill and amendment lie on the table. The Council resumed as in committee of the whole the consideration of the bill establishing courts of common pleas in certain counties, and defining their powers and du

ties.

Mr. Drake moved to amend by inserting the following to stand as the first section of the bill:

Sec. 1. That there shall be formed two court districts, out of that part of the Territory lying east of Lake Michigan. The first district shall be composed of the counties of Monroe, Wayne, Macomb, and St. Clair; the second, of the counties of Oakland, Washtenaw, Lenawe, Cass, St. Joseph, and Kalamazoo, and the country attached thereto. Mr. Lawrence moved to amend the amendment, by striking out the word "Monroe."

The motion was negatived.

Mr. Lawrence moved to lay the bill on the table.
