"An act," &c.

The bill to dissolve the marriage contract between Peter Schoon●ver and Affe Schoonover, was read the third time.

Mr. Le Roy moved that the bill pass.

The question being taken, the bill was rejected.

Mr. Lawrence moved the reconsideration of the vote taken yesterday, rejecting the bill concerning townships.

The motion to reconsider prevailing, and the bill being again be fore the Council,

Mr. Drake moved that the bill pass.

The question being taken, it was decided that the bill do now pass; and that the title thereof be,

The bill concerning the counties of Michillimackinac, Brown, Crawford, Chippewa, and Iowa, was read the third time.

On motion of Mr. Irwin, the bill was amended, by inserting after the word "that," in the 1st line of the 1st section, these words"the counties of lowa and Chippewa, are hereby exempted from the operation of;" and striking out all after the word "Territory." And by inserting, after the word "that," in the 1st line of the 2d section, these words—“the counties named in the title to this act, are hereby exempted from the operation of," and striking out all after the words, "by them." And by adding the following, to stand as the 7th section:

"SEC. 7. That until a Treasurer shall be elected for the county of Iowa, all bonds or other securities, which are required to be approved by, and filed with, the Treasurer, shall be approved of by the Justices of the County Court, and remain with said Justices, until a Treasurer shall be appointed as aforesaid."

Mr. Irwin moved that the bill pass.

The question being taken, it was decided that the bill do now pass; and that the title thereof be,

" &c.

The bill to legalise the proceedings of officers within the county of Iowa, and for other purposes, was taken up.

On motion of Mr. Irwin, the bill was amended by striking out in the 5th line of the 1st section, the words, " since the organisation of said county, or previous or preliminary thereto."

Mr. Irwin moved that the bill pass.

The question being taken, it was decided that the bill do now pass; and that the title thereof be,

The bill amendatory to an act relative to the office and duties of the Auditor of the Territory of Michigan, was read the third time.

Mr. M'Donell moved that the bill pass.

The question being taken, it was decided that the bill do now -pass; and that the title thereof be,

"An act," &c.

The bill to set off and organise the township of La Fayette, is the county of Monroe, read a third time yesterday, was taken up. Mr. Durocher moved that the bill pass.

The question being taken, it was decided that the bill do now pass; and that the title thereof be,

"An act," &c.

The Council adjourned to Monday.

MONDAY, July 26, 1830.

The following bills were reported from the respective committees, read the first time and ordered to lie on the table:

By Mr. M'Donell, from the committee on Territorial Affairs, A bill to raise money, and determine the compensation to be paid to the Chief Justice and Associate Justices of the Court of Common Pleas in the Territory of Michigan.

A bill to provide for the termination of the first session of the fourth Legislative Council of the Territory of Michigan.

By Mr. Irwin, from the committee on Claims,

A bill to provide for the payment of damages which have been assessed, in laying out a certain Road.

A bill making certain appropriations to be paid out of the Territorial treasury, for the year 1830.

By Mr. Drake, from the committee on Schools,

A bill to establish an Academy in the county of Washtenaw. Mr. M'Donell, from the committee on Territorial Affairs, reported,

A bill to alter the name of the township of Ossewa, in the county of Oakland.

The bill having been read the first time;

On motion of Mr. M'Donell, the 19th rule was suspended, and the bill read a second time by its title.

On motion of Mr. Drake,

Ordered, That the bill be engrossed and read a third time to

morrow.

Mr Irwin, from the committee on Claims, reported unfavorably on the claims of John Kirby, and of J. F. Allen and others, for services on the Roads from Detroit to Monroe, and to the River Clinton-as follows:

The committee on Claims, to whom was referred the petition of John Kirby, for expenses incurred in laying out a Territorial Road from Detroit to Monroe, and the accounts of Jonathan F. Allen, David H. Brown, Joseph Fairbanks, and Joseph John, for services in laving out a road from Detroit to Clinton River in the county of Macomb, have had the same under consideration, and would re.port

That with reference to the petition of John Kirby, a majority of your committee were members of the committee on Claims, at the last session of the Legislative Council, at which time the account of the petitioner was presented, but the committee not feeling satisfied with the charges, masmuch as they were not authorised by law, the claim was rejected; and as there has been no further evidence produced in support of them, he committee do not feel themselves warranted in authorising their payment.

In regard to the claims of the individuals named above for services on the road between Detroit and Clinton River, we have to state, that the accounts were before the committee on Claims at the last session of the Council, and allowed at a discount of from thirty-three and a third, to fifty per cent. From the information the committee at present possess, they are inclined to the opinion, that the former decision of the committee awarded to the claimants, a full equivalent for the services rendered, and are therefore opposed to any additional allowance.

On motion of Mr. Irwin, the report was concurred in.

Mr. M'Donell, from the committee on Territorial Affairs, to whom had been recommitted, the bill to amend an act, entitled an act to regulate taverns, reported the same without amendment.

The bill having been again read, was considered as in committee of the whole.

Mr. Irwin moved to amend, by inserting in the 3d line, 1st section, after the word "Territory," these words-"excepting the counties of Chippewa, Mackinac, Brown and Crawford, and the county of Mouroe.”

The question being taken, the amendment was rejected.

Mr. Irwin then moved to amend, by inserting after the word "Territory," aforesaid, these words" excepting the counties of Chippewa, Mackinac, Brown and Crawford."

The question being taken, the amendment was received.
Ayes, 9; Nays, 4.

Mr Drake requiring the ayes and nays:

Those who voted in the affirmative, are,

Messrs. Bartow, Brown, Fletcher, Irwin, Lawrence, Le Roy, Schoolcraft, Stockton, Edwards-9.

Mr. Lawrence moved so to amend the bill, as to except the county of Monroe.

Mr. Drake moved to amend the amendment offered, so as to oxcept the county of Oakland also.

The question being taken upon the joint amendments offered they were rejected.

Mr. Irwin moved that the Council reconsider the vote taken yesterday on the passage of the "bill concerning the counties of Mackinac, Brown, Crawford, Chippewa, and lowa."

The motion prevailing, and the bill being again before the Council;

On motion of Mr. Irwin, the bill was amended by adding the following, to stand as the 8th section thereof:

"SEC. 8. That the Supervisers of the counties aforesaid, may at their discretion, authorise the Sheriffs of their respective counties, to employ convicts sentenced to hard labor, to be employed in working upon the public highways, or on the public buildings in said counties, under such restrictions as to them may seem best calculated to promote the public interest, aud to prevent the escape of such convicts while employed as aforesaid."

Mr Irwin moved that the bill pass.

The question being taken, it was decided that the bill do now pass; and that the title thereof be,

"An act," &c.

The bill to amend an act, entitled an act to prevent forcible entries and detainers, was read the third time.

Mr. Fletcher moved that the bill pass.

The question being taken, it was decided that the bill do now pass; and that the title thereof be,

"An act," &c.

The bill to authorse Sarah Ann Steers, to sell and convey cer tain lands therein mentioned, was read a third time.

Mr. Fletcher moved that the bill pass.

The question being taken, it was decided that the bill do now pass; and that the title thereof be,

"An act," &c.

The bill to organise the township of Notawa, was read the third time.

Mr. Drake moved that the bill pass.

The question being taken, it was decided that the bill de no pass; and that the title thereof be

The bill to amend an act, entitled an act to regulate blacks and mulattoes, and to punish the kidnapping of such persons, was read a second time.

On motion of Mr. Drake,

Ordered, That it be engrossed and read a third time on Wednesday.

The bill to amend an act, entitled an act to amend an act entitled an act concerning judgments and executions, approved July 3,

1828. was read a third time.

Mr. Drake moved that the bill pass.

The question being taken, it was decided that the bill do now pass; and that the title thereof be,

"An act," &c.

The Council proceeded to consider, as in committee of the whole, the bill concerning District Surveyors.

On motion of Mr. Bartow, the bill was amended, by striking out in the 6th section, the words, "one dollar," and inserting in lieu, the words, "seventy-five cents."

On motion of Mr. Drake, the bill was further amended, by striking out in the 1st section, the words, " Auditor of the Territory ;" and inserting in lieu, the words, "Treasurer of the proper county."

On motion of Mr. Lawrence, the bill was further amended, by inserting after the word "deputy," sec. 6, the words, at the request of the party requiring the services."

The bill being reported to the Council as amended;

On motion, the amendments were received.

On motion of Mr. Stockton,

Ordered, That the bill be engrossed and read a third time on Thursday.

The bill to set off and organise the township of Jacksonburgh, was taken up and considered as in committee of the whole.

On motion of Mr. Drake, the bill was amended by striking out the 3d section thereof.

On motion of Mr. Drake,

Ordered, That the bill be engrossed and read a third time to

morrow.

The bill to incorporate the Pontiac and Detroit Rail Road Company, was taken up, as reported on the 24th inst and considered. The question on agreeing to the amendments reported, being taken, it was decided in the afirmative.

Mr. Fletcher moved further to amend the bill, by striking out in the 11th section, all between the word "Company," in the 2d line, and the wor is, "to contract," in the 14th line.

The question being taken, the amendment was rejected.

Ayes, 6; Nays, 7.

Mr. Stockton requiring the ayes and nays:
