The bill to increase the taxes of the county of Oakland, was taken up and read the second time; and having been considered as in committee of the whole,

On motion of Mr. Trowbridge, said bill was ordered to be engrossed and read the third time on Thursday next.

The resolution to fix the orthography of a certain name, was taken up and read the second time; and having been considered as in committee of the whole,

Mr. Drake moved that said resolution be ordered to be engrossed and read the third time on Wednesday next; and the motion was agreed to.

The bill to incorporate the President, Directors and Company of the Portage Canal and Road Company, was taken up as in committee of the whole.

Mr. Irwin moved that the bill be amended, so that the style of the company shall be, "The President, Directors and Company of the Summit Portage Canal and Road Company;" and the motion was agreed to.

Mr. Irwin then moved that the bill be further amended by striking out the words," or property," in the proviso, at the close of the 8th section; and the motion was agreed to. The bill was then laid on

the table.

Mr. Rumsey submitted the following resolution, which was read and laid on the table:

Resolved, That the committee on the Judiciary be instructed to inquire into the expediency of so amending the 23d section of the act regulating Grand Juries, as to make it obligatory on the part of the Foreman to administer oaths to all witnesses that shall testify before said Grand Jury.

On motion of Mr. Stockton, the Council then adjourned.

MONDAY, Oct. 19, 1829.

Mr. M'Donell presented the claim of Isaac W. Day, for services as Crier in the County Court of Wayne county, and in the Supreme Court; also, of Joseph F. Marsac, for services as chain-man, in laying out a Territorial Road from Detroit to Clinton River; also, the claim of Orange Risdon, for services in laying out a Territorial

Road from Pontiac to Adrian. Referred to the committee on Claims.

Mr. Rumsey presented sundry memorials from the inhabitants of the county of Washtenaw, remonstrating against the cutting off certain ties of townships from said county, agreeably to the prayer of certain petitions heretofore presented to the Council. Referred to the committee on Territorial Affairs.

Mr. Trowbridge presented the claim of Charles Reed, for remuneration for a book-case furnished for the Library-Also, that of Hiram W. Pond, for painting the said book-case. Referred to the committee on Expenditures.

The bill to amend "an act to regulate and define the powers of Justices of the Peace and Constables in civil cases," and the act to amend said act; was taken up and read the second time, and,

On motion of Mr. M'Donell, the consideration of said bill was postponed until to-morrow.

The bill for the speedy assessment of dower, and for the preventing of strip and waste by tenants therein, was taken up and read the second time; and said bill having been considered as in committee of the whole, was,

On motion of Mr. Drake, ordered to be engrossed and read a third time on Friday next.

The bill to amend an act, entitled "an act for the relief and settlement of the Poor," was taken up and read the third time.

Mr. M'Donell submitted as an amendment to said bill, a section, to stand as the 14th section thereof also, an additional section to stand as the 18th section.

Mr. Trowbridge submitted as an amendment to said bill an additional section, to stand as the 19th; and,

On motion of Mr. Lawrence, said bill and the amendments were then laid on the table for further consideration.

The bill to amend "an act regulating Highways," was taken up and read the third time, whereupon,

Mr. Ruinsey moved, that the bill be amended by striking out in the 1st section all after the enacting clause, to the proviso in said section, and inserting in lieu thereof the following, viz:-"That all overseers of highways, who shall hereafter be elected or appointed, shall give two days' notice to the several taxed inhabitants of their respective districts, of the time and place when and where the labor is to be performed, to appear with such necessary teams and implements as said inhabitants may possess; and in case of neglect or refusal to perform said labor, or within three days thereafter to commute for the same, agreeably to the warrants directed to the said overseers by the commissioners of highways, the said overseers shall, by virtue of said warrants, forthwith collect the same, in the same manner as county and township taxes are collected."—And said motion to amend was decided in the affirmative.

And the bill, as amended, was then, on motion, passed.

The bill respecting marks and brands for horses, cattle, sheep, and hogs; was taken up and read the third time.

On motion of Mr. Connor, the bill was then amended by adding at the close of the second section, the following proviso, viz:— "Provided, That no person shall, for his mark, cut off both ears of cattle, sheep or hogs."

On motion of Mr. Lawrence, the bill was further amended by striking out the word "one," in the 4th line of the 2d section, and inserting in lieu thereof the word "five."

Mr. Lawrence then moved that the bill be further amended by inserting, after the word "used," in the 6th line of the 2d section,

the following, viz:-" And if any person shall wilfully mark or brand the horses, cattle, sheep or hogs of any other person with his own brand or mark, the person so offending shall forfeit for every such offence, to the person injured, ten dollars, to be recovered by action of debt, before any Justice of the Peace, in the name and for the use of such person."—And said amendment and bill were then laid on the table.

The bill to amend an act, entitled "an act allowing and regulating writs of replevin," was taken up and read the third time.

Mr. Lawrence then moved to amend the bill, by striking out at the close thereof, the words, "the act to which this act is amendatory," and to insert in licu thereof the following, viz. "law in other cases ;" and the bill and amendment were, on motion, then laid on the table.

The bill to organise the townships of Lima and Richland, in the county of Wayne, was taken up, read the third time and passed.

The bill to dissolve the marriage contract existing between Wm. C. Hutchinson and Susanna Hutchinson, was taken up and read the third time; and, on motion, the further consideration thereof was postponed until Wednesday next.

The bill for the relief of Delia, the daughter of Thaddeus Alvord, of the county of Oakland, was taken up, read the third time, and the further consideration thereof, on motion, was postponed until Wednesday next.

Mr. Drake asked and obtained leave to bring in a bill for the regulation of Common Schools; also, a bill to authorise the guardian of Imri Fish, to remove said Imri from the county jail of the county of Oakland, to some safe place without the Territory; and,

Messrs. Drake, Rumsey and Connor, were appointed a committee to prepare said bills.

Mr. Stockton gave notice, that he should, to-morrow, move the adoption of a resolution, providing that thereafter the Council shall hold two sessions daily.

On motion of Mr. Lawrence, the Council then adjourned.

TUESDAY, Oct. 20, 1829.

Prayer by the Rev. Mr. Brown.

Mr. Durocher presented the claim of Seneca Allen, for his services as Commissioner to lay out a Territorial Road from Port Lawrence to the Chicago Road. Referred to the committee on Claims.

Mr. Irwin presented the petition of Peter Van Avery, praying that a law may be passed to discharge him from a certain recognisance mentioned in said petition. Read and referred to the committee on the Judiciary.

Mr. Schoolcraft, from the committee of Enrolment, reported as correctly enrolled, bills with the following titles:-"An act to cr

ganise the townships of Richland and Lima, in the county of Wayne," and "an act to amend an act regulating highways;" and the President signed the same.

Mr. M'Donell, from the committee on Territorial Affairs, to whom had been committed "a bill concerning the Treasurer of the Territory of Michigan," and "a bill amendatory to an art, entitled 'an act to regulate the assessment and collection of Territorial taxes," reported the same with amendments; and said bills with the amendments were laid on the table.

Mr. Trowbridge, from the committee on Territorial Affairs, reported,

A bill to amend the several acts now in force for the regulation of the White Fishery, in the Strait of Detroit and the River St. Clair ; which was read the first time and laid on the table.

The bill to amend the several acts to organise the Militia, was taken up.

Mr. Stockton moved that the bill be amended by restoring the words, "the county of Lenawe, and," to the Sd line of the 1st section, which had been heretofore stricken out on motion—and that the 3d section of the bill be stricken cut; and the motion was agreed to by the following vote, the ayes and nays being required by Mr. Drake:

Ayes-Messrs. Brown, Connor, Durocher, Edwards, Irwin, M'Donell, Rumsey, Schoolcraft, Stockton, Trowbridge-10.

Nay-Messrs. Drake, Lawrence-2.

The amendment heretofore submitted by Mr. Drake, to stand as the 8th section of the bill, was then on motion agreed to; and said bill as amended was then passed.

The bill to amend an act, entitled "an act for the relief and settlement of the Poor," was taken up.

Mr. M'Donell moved that the amendment heretofore submitted by him, to stand as the 14th section of the bill, be accepted; and the motion was agreed to.

The question next occurred on the following amendment, heretofore submitted by Mr. Trowbridge, to stand as the last section of the bill, viz:

"That the operation of this act shall not extend to the county of Oakland, but that the act now in force for the relief and settlement of the Poor is hereby continued in force and operation in said county."

And the amendment was rejected by the following vote, the ayes and nays being required by Mr. Drake:

Aes-Messis. Drake, Trowbridge.

Nays-Messrs. Brown, Connor, Durocher, Edwards, Irwin, Lawrence, M'Donell, Rumsey, Schoolcraft, Stockton-10.

Mr. Lawrence then moved, that the bill be further amended by striking out the words, "including the President and Secretary," in the 24 line of the Sd section; and the motion was agreed to.

On motion of Mr. M'Donell, the following was substituted to stand as the last section of the bill, viz:-" That the act to which this act is an amendment, which expires of its own limitation at the end of the session of the present Legislative Council, be continued and remain in full force, excepting such parts thereof as may be inconsistent with this act."

Mr. M'Donell then moved that the bill do now pass; and the motion was decided in the affirmative by the following vote, the ayes and nays being required by Mr. Drake:

Ayes-Messrs. Brown, Connor, Durocher, Edwards, Irwin, Lawrence, M'Donell, Rumsey, Schoolcraft, Stockton, Trowbridge

Nays-Mr. Drake.

So the bill passed.

The bill respecting marks and brands for horses, cattle, sheep and hogs, was taken up; the question being on agreeing to the amendment submitted yesterday by Mr. Lawrence-and said amendment was agreed to.

On motion of Mr. M'Donell, said bill, as amended, was then passed.

The bill to amend an act, entitled "an act allowing and regulating writs of replevin," was taken up, and the amendment thereto submitted yesterday by Mr. Lawrence, was agreed to; and on mo tion the bill then passed.

Mr. Rumsey then moved that the Council take a recess until 3 o'clock, P. M.; and the motion was agreed to.

3 o'clock, P. M. The bill to incorporate the President, Directors and Company of the Summit Portage Canal and Road Company was taken up.

Mr. Irwin moved that said bill be engrossed and read the third time to-morrow; and the motion was agreed to by the following vote, the ayes and nays being required by Mr. Irwin:

Ayes-Messrs. Durocher, Edwards, Irwin, Lawrence, M'Donell, Stockton-6.

Nays-Messrs. Brown, Connor, Drake, Rumsey, Trowbridge

Mr. Drake asked and obtained leave to bring in a bill for laying out a Territorial Road from Enoch Huntley's, in the county of Macomb, westward, by Dr. Chipman's, in the county of Oakland, on the most direct and eligible route to the Kalamazoo river, thence down said river to its mouth.

And Messrs. Drake, Trowbridge and Rumsey, were appointed a select committee to prepare said bill.

The bill amendatory to an act, entitled "an act to regulate the assessment and collection of Territorial taxes," was taken up; and, On motion of Mr. Lawrence, the words, and such as shall be hereafter organised," were added after the word "Territory," iş the 3d line of the frst section.
