king out the words, "or of any goods and chattels in their possession," in the 11th and 12th line of the 17th section; and also by strking out the same words, in the 5th line of the 18th section.

On motion of Mr. Drake, the bill was further amended by inserting the words," in said district," in the 6th line of the 8th section, and the word "within," after the word "not," in the 5th line of the 26th section.

Mr. Lawrence then moved that the bill be amended, by inserting a clause by which the county of Monroe would be exempted from the operation of the provisions of the bill; and the motion was decided in the negative by the following vote, the ayes and nays having been required by Mr. Noble :

Ayes-Messrs. Drake, Durocher, Lawrence, Noble, Trowbridge-5.

Nays-Messrs. Brown, Connor, Edwards, M'Donell, Rumsey, Stockton-6.

Mr. Lawrence then moved that the bill be amended by striking out the 45th section, which exempts the city of Detroit from the operation of the provisions of the bill; and the motion was agreed

to.

On motion, the question "shall the bill pass ?" was then put, and was decided in the affirmative by the following vote, the ayes and nays being ordered by the President:

Mr. Stockton, from the committee on Territorial Affairs, to whom the message of the Governor upon the subject, had been referred, reported the following memorial, which was read and laid on the table:

MEMORIAL.

To the Senate and House of Representatives of the United States of America in Congress assembled:

The memorial of the Legislative Council of the Territory of Michigan, respectfully represents

That they believe it would be acceptable to their constituents, and promotive of the public good, to have Sheriffs and Justices of the Peace elected by the people; and the Clerks of Courts appointed by their respective Courts.

This measure would give to the people a direct and proper influence in the election of some of the most important offices, whose duties affect the community more generally than any other.

The act passed at the last session of Congress, extending to the citizens of Florida and Arkansas the privilege of electing almost all their officers, emboldens your memorialists to apply to your honorable bodies upon this occasion, and to request that the rights they have asked for may be extended to their constituents.

Resolved, That the Governor be and he is hereby requested to transmit a copy of this memorial to the President of the Senate, Speaker of the House of Representatives, and the Delegate from this Territory, at the next session of Congress.

Mr. Rumsey moved that the vote of the Council, taken yesterday on the question on the passage of the "bill to establish the Farmers' and Mechanics' Bank of Michigan," be reconsidered; and the motion was agreed to:

And said bill then being before the Council; and the question "shall the bill pass ?" being again under consideration, it was, on motion, put, and was decided in the affirmative by the following vote; the ayes and nays being ordered by the President:

Ayes-Messrs. Brown, Connor, Drake, Edwards, M'Donell, Rumsey, Stockton-7.

Nays-Messrs. Durocher, Lawrence, Noble, Trowbridge-4.
So the bill passed.

The bill in addition to the several acts concerning the Supreme Circuit, and County Courts of the Territory of Michigan, defining their jurisdiction and powers, and directing the pleadings and practice therein in certain cases; was taken up and read the third time, On motion of Mr. Lawrence, the bill was then amended by adding thereto a section, to stand as the 22d section.

Mr. Drake then moved that the bill be further amended by adding a clause providing that the county of Oakland should be exempted from the operation of the provisions of the bill; and the motion was decided in the negative by the following vote, the ayes and nays being required by Mr. Drake:

Ayes-Messrs. Brown, Drake-2.

Nays-Messrs. Connor, Durocher, Edwards, Lawrence, M'Donell, Noble, Rumsey, Stockton, Trowbridge-9.

On motion, the question "shall the bill pass ?" was then put; and was decided in the affirmative by the following vote, the ayes and nays being required by Mr. Drake:

Nays-Messrs. Brown, Connor, Drake, Trowbridge-4.
So the bill passed.

On motion of Mr. Noble, the Council went into the consideration of Executive business; and having disposed of the same,

Mr. Trowbridge, from the committee on Expenditures, reported, A resolution, directing the Fiscal Agent of the Council in the payment of appropriations, to be paid from the contingent fund, in certain cases, which was read the first time; and on motion said resolution was then read the second time, and was ordered to be engrossed and read a third time to-day.

The Council, on motion, agreed to take a recess of half an hour; and then adjourned.

The time for the recess having expired

The bill in addition to an act, entitled "an act to provide for the compensation of the officers of the Legislative Council, and for other purposes," was taken up and read the third time.

Mr. M'Donell then moved that the blank in the item of allowance for Thomas Knowlton, be filled by inserting the sum of "twenty-eight dollars ;" and the motion was decided in the negative by the following vote, the ayes and nays being required by Mr. M'Donell:

Ayes-Messrs. Connor, M'Donell, Stockton-3.

Nays-Messrs. Brown, Drake, Durocher, Edwards, Lawrence, Noble, Rumsey, Trowbridge-8.

Mr. Lawrence then moved that said blank be filled by inserting the sum of " ten dollars ;" and the motion was decided in the negative.

On motion of Mr. Drake, said blank was filled by inserting the sum of" fifteen dollars."

Mr. M'Donell moved that the following item be added to the bill, viz :-"To Henry Whipple, assistant Messenger, ten dollars ;" and the motion was decided in the negative by the following vote, the ayes and nays being required by Mr. M'Donell:

Nays-Messrs. Drake, Durocher, Lawrence, Noble, Rumsey, Trowbridge-6.

Mr. M'Donell then moved that the following item be added to the bill, viz :-" To Henry Whipple, assistant Messenger, five dellars" and the motion was agreed to;

And the bill, as amended, was then passed.

The resolution directing the Fiscal Agent of the Council, in the payment of appropriations to be paid from the contingent fund, in certain cases; was taken up and read the third time.

On motion of Mr. Trowbridge, said resolution was then amended by striking out all after the words, "Resolved by the Legislative Council of the Territory of Michigan," and by substituting certain other provisions;

And the resolution, as amended, was then adopted.

The bill to amend "an act to regulate and define the powers of Justices of the Peace and Constables in civil cases," and the act to amend said act; was taken up and read a third time.

Mr. M'Donell then moved that the further consideration of the bill be postponed until the next session of the Council; and the motion was decided in the negative.

Mr. Noble moved that the bill be amended by striking out the word "county," in the 10th, 12th and 16th lines of the 8th section, and in the 8th line of the 10th section, and by inserting in lieu the word "Circuit ;" and the motion was agreed to.

On motion, said bill was then passed.

The bill amendatory to the several acts now in force relative to costs and fees, was taken up as in committee of the whole.

On motion of Mr. M'Donell, the first section of the bill was stricken out, and the numbers of the sections which followed were altered to correspond with the amendment.

Said bill, on motion, was then ordered for a third reading; and having been read a third time,

Mr. Stockton moved that the bill be amended by adding thereto a section, to stand as the 5th section; and the motion was agreed to. Mr. M'Donell then moved that the bill do now pass; and the motion was decided in the affirmative by the following vote; the ayes and nays being ordered by the President:

Ayes-Messrs. Brown, Connor, Drake, Edwards, M'Donell, Trowbridge-6.

Nays-Messrs. Durocher, Lawrence, Noble, Rumsey, Stockton

So the bill passed.

The bill for the relief of Lucy Berthelet, was taken up, the question being on the passage of said bill.

Mr. M'Donell moved that the bill be postponed until the next session of the Legislative Council; and the motion was decided in the negative.

Mr. Noble then moved that the bill do now pass; and the metion was decided in the affirmative by the following vote, and nays being required by Mr. M'Donell:

The report and the resolution from the select committee to whom had been referred the memorial and petition of John P. Sheldon were taken up, and on motion of Mr. Drake, adopted.

The bill to provide for the payment of certain claims from the Territorial Treasury, with the amendments made thereto by the committee on Claims, was taken up as in committee of the whole;

and,

On motion of Mr. Durocher, said amendments were accepted. Mr. Stockton then moved that the word "thirty-nine dollars," in the item allowed to John L. Leib, be stricken out; and the motion was agreed to by the following vote, the ayes and nays being required by Mr. Stockton :

Ayes-Messrs. Brown, Drake, Durocher, Lawrence, Noble, Rumsey, Stockton, Trowbridge-8.

Nays-Messrs. Connor, Edwards, M'Donell-3.

Mr. Stockton then moved that all the items of the bill, founded on claims for laying out the Territorial Road from the city of Detroit to the Clinton River, near Euoch Huntleys, in the county el Macomb, be stricken out; and that said claims be referred, for ex mination and adjustment, to the Auditor of the Territory of Mich

gan; and the motion was decided in the negative by the following vote, Mr. Stockton requiring the ayes and nays:

On motion of Mr. Durocher, the bill was then read the third time.

Mr. Connor then moved that the words "thirty-nine dollars," which had been struck out of the item allowed to John L. Leib, be again inserted in said item; and the motion was agreed to by the following vote, Mr. Stockton requiring the ayes and nays:

Ayes....Messrs. Brown, Connor, Durocher, Edwards, Lawrence, M'Donell, Rumsey, Trowbridge....8.

Nays....Messrs. Drake, Noble, Stockton....3.

On motion, said bill was then passed.

The bill to amend an act, entitled "an act for the limitation of suits on penal statutes, criminal prosecutions, and actions at law," was taken up and considered as in committee of the whole; and,

On motion, said bill was then ordered to be read a third time; and having received a third reading, it was, on motion, passed.

The bill amendatory to the several acts relative to the assessment and collection of Territorial taxes, was taken up and considered as in committee of the whole.

Mr. Drake moved to strike out the second section of the bill; and the motion was decided in the negative.

Said bill was then on motion, ordered to be read a third time; and having received a third reading—

Mr. Trowbridge moved that the bill do now pass; and the motion was decided in the affirmative by the following vote:

Ayes....Messrs. Brown, Connor, Drake, Edwards, M'Donell, Stockton, Trowbridge....7.

Nays....Messrs. Durocher, Lawrence, Noble, Rumsey....4.
So the bill passed.

The bill directing the Auditor of this Territory to cause prosecutions to be instituted, for the removal of certain toll-bridges that obstruct the road leading from the city of Detroit, to the foot of the Rapids of the Miami of Lake Erie; was taken up and considered as in committee of the whole.

Mr. Stockton then moved that the bill be postponed until the next session of the Council; and the motion was agreed to by the following vote, Mr. M'Donell requiring the ayes and nays:

Ayes....Messrs. Brown, Connor, Drake, Durocher, Lawrence, Noble, Rumsey, Stockton, Trowbridge....9.

Nays....Messrs. Edwards, M'Donell, Rumsey.....

Mr. M'Donell, from the committee on Territorial Affairs, to whom had been referred the petition of Peter Van Every, reported, A bill for the relief of Peter Van Every, which was read the first time; and on motion, said bill was then read the second time by its title.
