The subcommittee met, pursuant to notice, at 2 o'clock p. m., Senator Selden P. Spencer, presiding.

Present: Senators Spencer, Ernst, King, and Neeley.

Present on behalf of the contestant: Luther Nickels, Esq., and Scott Woodward, Esq.

Present on behalf of the contestee: W. F. Zumbrunn, Esq., W. P. McLean, jr., Esq., and W. A. Hanger, Esq.

The CHAIRMAN. Mr. Nickels, who is your first witness?

Mr. NICKELS. We will call Mr. Mauer.

Mr. HANGER. We want the other witnesses excluded.

Mr. NICKELS. There are some other witnesses in the room, Mr. Chairman. I do not know whether the rule would be applied to them.

Mr. HANGER. We would like to request that the rule be applied to them.

The CHAIRMAN. You mean that they should be separated?

Mr. HANGER. Yes, sir.

The CHAIRMAN. The witnesses who have been subpoenaed, except the witness upon the stand, will be excused until they are called, and will leave the room.

TESTIMONY OF JOHN H. MAUER

(The witness was sworn by the chairman.) Mr. NICKELS. Your name is John H. Mauer?

Mr. MAUER. Mauer.

The CHAIRMAN. Where do you live?

Mr. MAUER. I live in Somerville, Burleson County, Tex.
Mr. NICKELS. How long have you lived in that county?

Mr. MAUER. About 11 years.

Mr. NICKELS. What is your business?

Mr. MAUER. Dry-goods business.

Mr. NICKELS. Have you a store at Somerville?

Mr. MAUER. Yes, sir.

Mr. NICKELS. Did you or not have any connection with the holding of the first primary election in Burleson County in 1922?

Mr. MAUER. Yes, sir.

Mr. NICKELS. What was your connection with that election?
