The motion prevailed by a vote of 35 to 22, and the amendment was adopted.

Mr. Stewart moved to reconsider the vote just had.

Mr. Temple raised the point of order that Mr. Stewart had not voted for the amendment.

Prayer was offered by the Rev. Stewart of Des Moines, Iowa. The Journal of Friday, February 23d, was corrected and approved.

The Journal of Saturday, February 24th, was corrected and approved.

On request, indefinite leave of absence was granted Mr. Prentis.

On request, leave of absence was granted Mr. Miller of Fayette.

On request of Mr. Keck, leave of absence was granted Miss Anna Murphy on account of illness.

On request of Mr. Blume, leave of absence was granted Mr. Campbell until Tuesday.

Mr. Hawk, from the committee on Public Health, submitted the following report:

MR. SPEAKER-Your committee on Public Health, to whom was referred House file No. 64, a bill for an act defining the art of midwifery, declaring the qualifications of midwives, and regulating the practice thereof in the state of Iowa, and providing penalties for the violation of the provisions thereof, and repealing all acts and parts of acts in conflict with the provisions of this act, beg leave to report that they have had the' same under consideration and have instructed me to report the same back

to the House with substitute, and recommend that the substitute do pass.

Committee substitute for House file No. 64, a bill for an act regulating the practice of midwifery, was read first and second time and passed on file.

COMMITTEE SUBSTITUTE FOR HOUSE FILE NO. 64.

A bill for an act to regulate the practice of midwifery.

Be it Enacted by the General Assembly of the State of Iowa:

Section 1. Any person, not a legally qualified physician, who shall treat, or publicly profess to treat pregnant women in confinement, for a fee or compensation, shall be deemed a practitioner of midwifery for the purposes of this act.

Sec. 2. All persons desiring, after the passage of this act, to enter upon the practice of midwifery in this state, shall appear before the state board of medical examiners and submit to such examination as the board shall require.

Sec. 3. If the applicant passes a satisfactory examination, the board shall, upon the payment of a fee of ten dollars, issue a certificate which shall entitle the holder to practice midwifery in this state.

Sec. 4. All persons practicing midwifery at the time of the taking effect of this act, and desiring to continue in such practice shall, within six months thereafter, secure a certificate in the manner, and on the terms prescribed in sections 2 and 3 of this act.

Sec. 5. All certificates shall be recorded in the office of the county. recorder in the manner prescribed by section twenty-five hundred and seventy-seven (2577) of the code, for the recording of physicians' certificates.

Sec. 6. A certificate to practice midwifery may be refused or revoked for incompetency, immorality, unprofessional conduct, or for violating any of the provisions of this act.

Sec. 7. The certificate granted to practice midwifery shall not give the holder the right to perform version, or treat breech or face presentations, or do any obstetric operation requiring the use of instruments, or to treat any other abnormal conditions except in emergencies.

Sec. 8. It is provided, however, that this act shall not be construed to prohibit service in emergency, or the domestic administration of family remedies.

Sec. 9. Any person who shall practice midwifery without a certificate, or without the recording of the same, as provided in this act, or who shall continue the practice after such certificate shall be revoked is guilty of a misdemeanor, and on conviction thereof shall be fined not less than one hundred dollars, nor more than three hundred dollars, and shall stand committed to the county jail till such fine is paid.

Sec. 10. All acts, or parts of acts, in conflict or inconsistent with this act are hereby repealed.

SPEAKER-Your committee on Public Health, to whom was referred House file No. 186, a bill for an act prohibiting the use of gasoline, benzine, naptha and other explosives in tenements in cities and towns (additional to chapter 10, title 24 of the code), beg leave to report that they have had the same under consideration and have instructed me to report the same back to the House with the recommendation that the same do pass with the following amendments:

Amend section 1 by striking out the article "a," in line 1, and inserting the words "or operate" between the words "establish" and "dye works." Also, by inserting the words "any part of which is " between the words "building ” and “used," in line 5. Also, by striking out the words "in any city or town," in line 5 of said section.

Amend the title by inserting the word "one" before the figure “1” and enclosing the figure “1” in parentheses. Also, by inserting the words "sixty-seven" before the figures "67" and enclosing the figures in parentheses.

Amend section 1, in the first line, by inserting the word "one" before the figure "1" and enclosing the figure in parentheses. Also, by inserting the words "sixty-seven" before the figures "67" and enclosing the figures in parentheses.
