Senate bill No. 16, in relation to the time of holding district court in the 5th judicial district, was

Referred to the Committee of the Whole.

The following message from the House of Representatives was received and read:

MR. PRESIDENT-I am instructed by the House of Representatives to inform the Senate that the House of Representatives has adopted Senate concurrent resolution No. 8, resolving to celebrate the anniversary of the birth of Abraham Lincoln, with the following amendments: 1st. Strike out " 12 M.," and insert "2 o'clock P. M." 2d. Add the name of Hon. M. W. Delahay. In which amendments the concurrence of the Senate is respectfully desired. JOHN T. MORTON,

The House amendments to Senate concurrent resolution No. 8 were concurred in.

Senator Emmert introduced the following resolution, which was adopted:

Resolved, That the use of this Senate Chamber is hereby tendered to the Publishers' Convention for Wednesday evening of this week, and for such subsequent evening of the week as they may desire to occupy it; and that the Sergeant-at-Arms is instructed to prepare the hall for their use.

Senator Weer, by unanimous consent, introduced Senate bill No. 41, "An act in relation to the service of process.” Read a first time.

On motion of Senator Wheeler,

The Senate went into Committee of the Whole for the consideration of Senate bills Nos. 5, 16 and 19, Senator Wheeler in the chair.

After some time spent therein; the committee rose and through their chairman reported that they have had under consideration Senate bill No. 19, relating to the running at large of swine, and reported the same back and recommended its passage.

Also, Senate bill No. 5, "An act to amend an act sentitled 'An

act to establish a code of criminal procedure,'" and recommended

its rejection.

Also, Senate bill No. 16, in relation to time of holding term of district court, and recommended that it be laid on the table. On motion of Senator Houston,

The report of the Committee of the Whole was received.
On motion of Senator Grover,

The report of the Committee of the Whole on Senate bill No. 5 was adopted.

On motion of Senator Emmert,

Senate bill No. 19 was ordered engrossed and to a third reading.. On motion of Senator Houston,

The report of the Committee of the Whole on Senate bill No. 16, relating to the time of holding terms of the district court in the fifth judicial district, was adopted.

Senator Manning, by consent, introduced Senate bill No. 42, "An act to authorize district No. 4, of Marshall county, Kansas, to issue bonds."

Read a first time.

Senator Foote, by consent, introduced Senate bill No. 43, “An act to amend an act entitled 'An act to enable the trustees of colleges, academies, universities and companies, to become bodies corporate,' approved February 9, 1859."

Read a first time.

Senator Weer, by consent, introduced Senate bill No. 45, "An act supplemental to an act entitled 'An act to establish a code of civil procedure,' approved February 11, 1859.”

Read a first time.

Senator Weer, by consent, introduced Senate bill No. 44, "An act for the better suppression of crimes against the persons of individuals."

Read a first time.

Senator Gambell, by consent, introduced Senate concurrent resolution No. 17, a concurrent resolution relating to the oath to be taken by Senators and Representatives in Congress.

Laid over under the rule.

Senator Manning moved that B. S. Bassett, Esq., be appointed as an Assistant Engrossing Clerk.

The yeas and nays were demanded and had with the following result:

Yeas, 19; nays, 2.

Gentlemen voting in the affirmative were

Senators Akin, Anderson, Emmert, Eskridge, Foote, Gambell, Horne, Jones, Legate, Manning, Miller, Milhoan, Potter, Quigg, Riggs, Speer, Smith, Twiss and Wheeler.

Gentlemen voting in the negative were-
Senators Grover and Houston.

And so the motion prevailed.

On motion of Senator Houston,

Mr. Bassett came forward and was sworn in as Assistant Engrossing Clerk of the Senate.

On motion, the Senate adjourned.
