2901, Section 10, of the Compiled Laws of New Mexico; the bill was read a first time in full, and under suspension of the rules read a second time by title and referred to the committee on finance.

Mr. Mills introduced the following:

Council Bill No. 92-entitled An Act to amend Section 2406 and 2407, of the Compiled Laws of 1884, relating to changes of venue in justices of the peace courts, the bill was read a first time by title, and under suspension of the rules read a second time in full and referred to the committee on the judiciary. Also,

Council Bill No. 93- entitled An Act to provide for the payment of printing expenses in Spanish, and for certain contingent expenses of the 29th Legislative Assembly of the Territory of New Mexico; the bill was read a first time by title, and under suspension of the rules it was read a second time.

Mr. Mills moved that the rules be suspended and the bill read a third time, which motion was lost.

The bill was then referred to the committee on the judiciary. Joint resolutions were now in order, and none being presented.

Bills on second reading were in order; and

Council Bill No. 51-entitled An Act to repeal an act entitled An Act to amend Section 933 of the revised statutes of New Mexico, being Chapter 26 of the Session Laws of 1887, and the report of the committee on territorial affairs recommending several amendments and the passage of the bill as so amended, was taken up and read in full for informrtion.

Upon motion of Mr. Ancheta the report was adopted.

Mr. Ancheta moved that the bill be considered as engrossed and read the third time.

Upon motion of Mr. Perea the title of Council Biil No. 51 was amended by inserting at the end, the words "and for other purposes."

Mr. Ancheta's motion was then put to a vote and carried and the bill was read a third time by title.

Mr. Perea now moved that Council Bill No. 51 pass, and the ayes and nays were ordered with the following result.

Ayes, Messrs. Aucheta, Catron, Contreras, Jaramillo, Perea, Richardson, Santistevan, Stover, Valdez and Vigil.

Nays, Messrs. Mills and Mr. President-2.
Therefore Council Bill No. 15, was duly passed.

Council Bill No. 48, entitled An Act enabling the authorities having charge of the finances of any town or city of the Territory of N. M., to refund any bonds or other obligations of said towns or cities, by the issuance of similar obligations bearing a less rate of interest, and the report of the Committee on Territorial Affairs, together with a substitue for said bill, was next taken up and substitute read in full for information.

Two amendments suggested by Mr. Ancheta were adopted. Mr. Ancheta now moved that the substitute be considered as engrossed and read a 3d time, which motion was carried.

Mr. Ancheta now moved that the substitute for Council Bill No. 48 pass, and the ayes and nays were ordered with the following result:

Ayes, Messrs. Ancheta, Catron, Contreras, Jaramillo, Mills, Perea, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. President-12.

Nays, none.

Therefore the substitute for Council Bill No. 48 passed unanimously.

The chair announced that he has signed House Bill No. 11, entitled An Act providing for guide boards on public roads. Upon motion of Mr. Perea Council Bill No. 81 was made a special order for to-morrow.

Mr. Mills moved that an additional clerk be appointed by the President to assist the translator.

Mr. Perea called for the ayes and nays on this motion with the following result:

Ayes, Messrs. Ancheta, Contreras, Mills, Richardson, Santietevan, Valdez and Vigil-–7.

Nays Messrs. Catron, Jaramillo, Perea, Stover and Mr. President-5.

Therefore the motion prevailed.

Mr. Perea rises to a question of privilege and stated that a Joint Resolution had passed the House in relation to a conference committee composed of 3 members from each body for the purpose of inspecting the accounts of the Territorial Auditor and Treasurer and to appoint an expert to examine the same, and moved that the President appoint three members to act on such committee, which motion being carried, the chair appointted Messrs. Perea, Catron and Santistevan.

Upon motion of Mr. Richardson the Council then adjourned until 10 a. m. January 27, 1891.

MORNING SESSION.

The Council met pursuant to adjournment.

Session opened by prayer by the Rev. John Menaul.
Roll call dispensed with, all members being present.

The Journal of yesterday's proceedings read and upon motion of Mr. Jaramillo the Journal was approved.

The chair recommended the name of Simon Nusbaum as special clerk in accordance with resolution passed yesterday.

Mr. Perea moved that Mr. Nusbaum be appointed, which motion being carried, Mr. Nusbaum was declared a special clerk of the Council.

Council Bill No. 81, which was made a special order for today was taken up, but upon motion of Mr. Perea, who stated that the translation of the bill would be completed to-morrow, the bill was made a special order for to-morrow morning at

10 a. m.

The chair announced the order of business, petitions and memorials.

Mr. Ancheta presented a petition from residents of New Mexico, asking that justices of the peace be given a larger jurisdiction, which petition was read in full and referred to the committee on territorial affairs.

Reports of standing committees were now in order, and the committee on education, through Mr. Catron, its chairman, made an adverse report on Council Bill No. 12, but presented a substitute for said bill, and substitute ordered to lie on the table and await their regular order.

The committee on territorial affairs, through Mr. Ancheta, its chairman, made a favorable report on Council Bill No. 54, which bili and report were ordered to lie on the table and await their regular order.

Reports of special committees were now in order, none being presented.

Resolutions were in order, none being presented.

Introduction of bills was in order, and Mr. Jaramillo introduced the following:

Council Bill No. 94-An Act amending An Act, entitled An Act to regulate the annual salary of each member of the board of county commissioners of the various counties of the Territory, the bill was read a first time by title, and under suspension of the rules read a second time by title then read in full for information, ordered translated and printed and referred to the committee on counties and county lines.

Joint resolutions were now in order, none being presented. Bills on second reading were in order; and

Council Bill No. 82-entitled An Act to amend An Act of the 27th Legislasive Assembly, Section 2, Chapter 71, entitled An Act relative to practice in the Supreme Court, and the report of the committee on the judiciary recommending the passage of the bill taken up and read in full for information.

Upon motion of Mr. Richardson the bill was considered as engrossed and read a third time by title.

Mr. Richardson now moved that Council Bill No. 82 be passed, and the ayes and nays were ordered with the following result:

Ayes, Messrs. Ancheta, Catron, Contreras, Jaramillo, Mille, Perea, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. President-12.

Nays, none.

Therefore Council Bill No. 82 was passed unanimously.

House Bill No. 28-entitled An Act to amend section 1608, of the Compiled Laws of 1882, entitled municipal corporations, and the report of the committee on municipal and private cor porations recommending several amendments, and the passage of the bill as so amended was next taken up and read in full. Upon motion of Mr. Mills the amendments contained in the report were adopted.

Upon further motion of Mr. Mills the bill was considered as engrossed and read a third time by title.

Mr. Mills now moved that House Bill No. 28 as amended be passed, and the ayes and nays were ordered with the following

result:

Ayes, Messrs. Ancheta, Catron, Santistevan, Valdez and Vigil—8.

Contreras, Jaramillo, Mills,

Nays, Messrs. Perea, Richardson, Stover and Mr. President -4.

Therefore House Bill No. 28 as amended was duly passed. Council Bill No. 49-entitled An Act to regulate the price for publishing tax sales and other legal notices, and the report of the committee on the judiciary recommending the passage of the bill next taken up and the bill read in full for information.

Upon motion of Mr. Mills the report was adopted.

Upon further motion of Mr. Mills the bill was read a third time by title.

Mr. Mills now moved that House Bill No. 49 do pass, and the ayes and nays were ordered with the following result:

Ayes, Messrs. Ancheta, Catron, Contreras, Jaramillo, Mills, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. President-11.

Nays, Mr. Perea-1.

Therefore Council Bill No. 49 was duly passed.

House Bill No. 4-entitled An Act relating to criminal cases, and the report of the committee on the judiciary, recom mending several amendments and the passage of the bill as SO amended, taken up and read in full for information.

Upon motion of Mr. Ancheta the Council adjourned until 2 p. m., pending the drafting of an amendment to House Bill No. 4 by Mr. Richardson.

AFTERNOON SESSION.

HALL OF LEGISLAVIVE COUNCIL,

Tuesday, 2 o'clock p. m.

House Bill No. 4 was again taken up and an amendment offered by Mr. Richardson, adopted.

Upon motion of Mr. Richardson the bill was considered as engrossed and read a third time by title.
