Ayes, Messrs. Ancheta, Contreras, Jaramillo, Mills, Perea, Richardson, Valdez, Vigil and Mr. President-9. Nays, Messrs. Catron, Santistevan and Stover-3. Therefore Council Bill No. 35 was duly passed.

A messenger of the House appeared and announced that the House had failed to concur in the passage of House bill No. 64, entitled An Act to provide for certain contingent expenses of the 29th Legislative Assembly of the Territory of New Mexico, as amended by the Council; the messenger further stated that the House had appointed a committee consisting of Messrs. Burns, Fall, Montoya, and Easley, to confer with a similar committee appointed by the Council in relation to the matter contained in said House Bill No. 64.

Mr. Perea rose to a question of privilege and moved that the chair appoint a committee to confer with the committee appointed by the House in relation to House Bill No. 64, which motion being carried the chair appointed Messrs. Perea, Catron, Ancheta and Jaramillo to act as snch committee.

Upon motion of Mr. Perea the Council then adjourned until p. m.

Bills on second reading still in order, there being no more. Bills on third reading were in order, there being none. Business on the President's table was in order.

House Bill No. 46-entitled An Act creating a commission to codify and revise the laws of the Territory of New Mexico taken up; the bill was read a first time by title.

Mr. Stover moved that the rules be suspended and the bill read a second time, which motion was lost.

The bill was then ordered to lie on the table until to-morrow. Council Bill No. 55-entitled An Act to provide for the issuance of county current expense bonds in the Territory of New Mexico, and the report of the committee on judiciary recommend ing several amendments and passage as so aniended then taken up, but upon motion was ordered to lie on the table until to morrow. Upon motion of Mr. Perea the Council then took a recess for

fifteen minutes, to give the members of the conference commit. tee time to consult together on House Bill No. 64.

Council called to order at 2:35 p. m.

The members of the conference committee appointed by the House now made their appearance and upon motion of Mr. Perea the Council took another recess to allow the two conference committees to consult together, stating that the matter of conference was of much importance and should be attended to

at once.

The Council was again called to order at 3 p. m.

The committee on conference through their chairman, made the following report, that the committees of the Council and House had met to consult as to the disagreement of the two branches on House Bill No. 64 and the amendments thereto, and that they had failed to come to any agreement, in the premises.

Upon motion of Mr. Perea the report was adopted.

Mr. Jaramillo asks the unanimous consent of the Council to introduce a bill, which being granted he introduced the following:

Council Bill No. 78-entitled An Act amending the method of electing county commissioners; the bill was read a first time. by title, then read in full for information and under suspension of the rules, read a second time by title, ordered translated and printed and referred to the committee on counties and county lines.

A messenger of the House appeared and announced that Council Bill No. 5 as amended had passed that body.

It appearing that the amendments offered by the House to Council Bill No. 5 constituted a complete substitute for said Council Bill No. 5, the substitute was read a first time by title, then read in full in English and Spanish for information, and under suspension of the rules the substitute was read a second time by title, and original Council Bill No. 5 and substitute referred to the committee on the judiciary, without being translated or printed.

Upon motion of Mr. Perea the Council then adjourned until 10 a. m., January 22, 1891.

Council met pursuant to adjournment.

Session opened by prayer by the Rev. John A. Menaul.
Roll call dispensed with all members being present.

The Journal of yesterday's proceedings was read in English and Spanish and no objection being offered the same was ap proved.

The chair then announced the order of business.

Petitions and memorials.

Mr. Stover presented a letter from Judge Oakes, in relation to the protection of game, which letter was referred to the committee on territorial affairs; also

A letter from N. C. Dennette, in relation to settlers on public land, which letter was referred to the committee on mines and public lands.

Reports of standing committees were now in order and the committee on territorial affairs through its chairman, Mr. Ancheta, made a report on Council Bill No. 77, which report and bill were ordered to lie on the table and await their regular order.

The committee on railroads through its chairman, Mr. Stover, made a report on Council Bill No. 47, which bill and report were ordered to lie on the table, and await their regular order.

The committee on counties and county lines, through their chairman, Mr. Santistevan, made a report on Council Bill No. 28, which bill and report were ordered to lie on the table and await their regular order.

The committee on municipal and private corporations through its chairman, Mr. Catron, made a report on Council Bill No. 48, and presented a substitute for the same, which report and bill and substitute were ordered to lie on the table and await their regular order.

Same committee made a report on House Bill No. 32, which

report and bill were ordered to lie on the table and await their regular order.

Reports of special committees were now in order, none being presented.

Resolutions were in order, none being presented.

Introduction of bills was in order

Mr. Richardson introduced the following:

Council Bill No 79-entitled An Act to fix the time for holding the Supreme and District Courts in the Territory of New Mexico, the bill was read a first time by title and under suspension of the rules read a second time and referred to the committee on the judiciary; also

Council Bill No 80-entitled An Act in reference to supervision of public roads in towns and cities in the Territory of New Mexico, amending Section 1286 of the Compiled Laws of 1884, the bill was read a first time and under suspension of the rules, read a second time and referred to the committee on roads and highways.

Joint resolutions were now in order, none being presented.
Bills on third reading were now in order.

Council Bill No. 28--entitled An Act for the protection of the records of the several counties of the Territory of New Mexico, and regulating the business of abstracting in relation thereto, and the report of the committee on counties and county lines, recommending several amendments and the passage of the bill as so amended, was taken up and read in full for information. Upon motion of Mr. Mills the amendments suggested by the committee were adopted.

Mr. Mills moved that the bill be considered as engrossed and read a third time by title.

Mr. Perea moved that the bill be laid on the table indefinitely, which motion was lost.

Mr. Mills motion was then carried and the bill was read a third time.

Mr. Mills moved that Council Bill No. 28 pass as amended and the ayes and nays were ordered with the following result: Ayes, Messrs. Ancheta, Catron, Jaramillo, Mills, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. President-10. Nays, Messrs. Contreras and Perea-2.

Therefore Council Bill No. 28 was duly passed.

House Bill No. 32--entitled An Act in relation to sewers in

cities and incorporated towns and the report of the committee on municipal and private corporations recommending several amendments and the passage of the bill as so amended, next taken up and read in full for information.

Upon motion of Mr. Stover the amendments suggested by. the committee were adopted, and upon further motion of Mr. Stover the bill was considered as engrossed and read a third time by title.

Mr. Stover then moved that House Bill No. 32 as amended be passed, the ayes and nays were ordered, with the following result:

Ayes, Messrs. Ancheta, Catron, Contreras, Jaramillo, Mills, Perea, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. President-12.

Nays, none.

Therefore House Bill No. 32 as amended was passed unanimously.

Council Bill No. 48-entitled An Act enabling the authorities having charge of the finances of any town or city in the Territory of New Mexico to refund any bonds or other obligations of said towns or cities, by the issuance of similar obligations, bearing a less rate of interest, and the report of the committee on municipal and private corporations, recommending that the bill do not pass, but that the substitute for said bill prepared by said committee, be passed instead, next taken up, but upon motion, the bill, report and substitute were recommitted to the committee on municipal and private corporations.

Council Bill No. 47-entitled An Act to amend Chapter 23 of the session laws of 1887, and for other purposes, and the report of the committee on railroads recommending its passage next taken up and read in full for information.

Upon motion of Mr. Stover the bill was considered as engrossed and read a third time by title.

Mr. Ancheta now moved that Council Bill No. 47 pass and the ayes and nays were ordered with the following result:

Ayes, Messrs. Ancheta, Catron, Contreras, Mills, Perea, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. President

Mr. Jaramillo did not vote.

Therefore Council Bill No. 47 was duly passed.

Council Bill No. 77-entitled An Act to repeal Chapter 107 of the session laws of 1889 relating to fences in special cases,
