consideration Council Bill No. 18 and that he was instructed to recommend that the same pass as amended.

Upon motion of Mr. Richardson the report was adopted. Upon motion of Mr. Richardson the Council adjourned until 3 o'clock p. m.

resumed the consideration of Council Bill

Mr. Richardson presented an amendment to Council Bill No. 18, to be inserted after section 13 and be numbered section 14, and original section 14 be numbered section 15, which amendment being adopted it was so ordered.

Mr. Mills presented an amedment to be inserted at the end of section 1, which amendment being adopted it was so ordered. Upon motion of Mr. Mills, the bill, Council Bill No. 18, was ordered engrossed and laid on the table to take its regular

course.

A messenger from the House now appeared and presented Council Bill No. 50 which he announced had passed the House as amended by that body; he also presented House Bill No. 31 and House Joint Memorial No. 3 which had passed the House. A messenger from the Governor now appeared and presented the following message to the President, which was read: SANTA FE, N. M., January 16, 1891.

To the Legislative Council:

I have the honor to notify you that I have this day approved and filed with the Secretary of the Territory, Council Bill No. 43, entitled "An Act to provide for the placing of shelves and pigeon holes in the vault of the Council, and also the vault of the House of Representatives, and for other purposes;" and

also

Council Memorial No. 1, relating to the passage by Congress of a land court act.

Bills on third reading were in order, none being presented. Business on Presidents table was in order.

House Bill No. 19, entitled An Act to define express companies and to prescribe the mode of taxing the same and to fix the rate of taxation thereon, was taken up, read a first and second time by title and referred to the committee on municipal aud private corporations.

Council Joint Resolution No. 3 in relation to sending a com mission to Washington was next taken up.

Mr. Stover presented the following resolution in relation to the matter in hand:

Mr. Stover moved that the resolution be referred to the committee on judiciary with instructions to report it back with the amendments; that the Governor be requested to name six gentle men and that the sum of $900 dollars be appropriated to pay only their traveling expenses each way; that the judiciary committee be instructed to report Council Joint Resolution No. 3 back by Monday afternoon.

Which resolution upon motion was carried and Council Joint Resolution No. 3 referred to the committee on judiciary, with instructions to said committee to report back the same on Monday next.

House Bill No. 17-entitled An Act relating to condemna tion of private property was taken up; read a first and second time by title, and referred to the committee on municipal and private corporations.

House Bill No. 63-entitled An Act to repeal an act providing for the qualification of justices of the peace, constables and for other officials, Chapter 12 of the Acts of 1889, was taken up; read a first and second time by title, and upon motion of Mr. Richardson the bill was laid on the table, to be taken up with two bills and a report of the committee on territorial affairs on the same subject in their regular order.

House Bill No. 31-entitled An Act repealing an act of the 28th Legislative Assembly of the Territory of New Mexico entiled An Act providing for the inspection of live animals intended for human food and prohibiting the sale or use of uncured meats, uninspected bovine cattle and hogs and the sale of improper fresh meats; the bill was read a first and second time by title and referred to the committee on territorial affairs.

Council Bill No. 50-entitled An Act to repeal section 1140, title 12 of the Compiled Laws of 1884, of the Territory of New Mexico; the bill was read a first and second time by title and

and upon motion of Mr. Mills, the amendments suggested by the House were adopted.

Mr. Mills moved that the bill be considered as engrossed; read a third time by title, and passed, which motion being carried the ayes and nays were called for with the following result:

Ayes, Messrs. Ancheta, Jaramillo, Mills, Perea, Santistevan, Stover and Mr. President-7.

Nays, Messrs. Contreras, Richardson, Valdez, and Vigil- 4. Mr. Catron was absent.

Therefore Council Bill No. 50 was duly passed.

House Joint Memorial No. 3 in relation to the Mescalero Apache Indian reservation was next taken up.

Upon motion of Mr. Richardson the rules were suspended and House Joint Memorial No. 3 read a third time and put upon its passage.

Mr. Richardson moved that House Joint Memorial No. 3 pass, which motion being carried the ayes and nays were called for with the following result:

Ayes, Messrs. Ancheta, Contreras, Jaramillo, Mills, Richardson, Sautistevan, Stover, Valdez, Vigil and Mr. Presidentt-10. Nays, Mr. Perea -1.

Mr. Catron was absent.

Mr. Richardson asked for unanimous consent to introduce a bill, which being granted he introduced the following:

Council Bill No. 60-entitled An Act to establish and provide for the maintenance of a normal school in the Territory of New Mexico; the bill was read a first and second time by title, and referred to the committee on education without being translated or printed.

Mr. Mills being granted unanimous consent he introduced the following:

Council Bill No. 61-entitled An Act to amend Section 192 of the Compiled Laws of 1887 of the Territory of New Mexico; the bill was read a first and second time by title, and referred to the committee on municipal and private corporations without being translated or printed.

Upon motion of Mr. Perea the Council then adjourned until 10 o'clock a. m. January 18, 1891.

MORNING SESSİON.

Council met pursuant to adjournment.

Session opened by prayer by Rev. John Menaul.
Roll call dispensed with, a quorum being present.

The Journal of yesterday's proceedings was read in English and Spanish and upon motion of Mr. Jaramillo the same was approved.

A messenger from the Governor appeared and presented a message which was received.

Mr. Perea moved that the Council resolve itself into an executive session, which motion being carried, the Council thereupon went into executive session.

Upon the Council arising from executive session the chair announced the order of business.

Petitions and memorials.

The chair presented a memorial from Pascual Baca, in relation to acequias and irrigation; which was read and referred to the committee on irrigation.

Reports of standing committees were in order.

The committee on enrolled and engrossed bills through their chairman, Mr. Ancheta, reported Council Bill No. 50 as duly enrrolled and engrossed.

The report of the committee was adopted.

The committee on territorial affairs through their chairman, Mr. Ancheta, made a report on House Bill No. 3; report and bill ordered to lie on the table and take their regular course.

The chair announced that he had signed Council Bill No. 50. The committee on penitentiary through their chairman, Mr. Stover, made a report on Council Bill No. 27; report and bill ordered to lie on the table, and take their regular course.

The committee on judiciary through their chairman, Mr. Catron, made a report on Council Bill No. 56; report and bill ordered to lie on the table, and take their course.

The committee on municipal and private corporations through their chairman, Mr. Catron, made a report on House Bill No. 17, and report and bill ordered to lie on the table, and take their regular course.

Reports of special committees were now in order.

The special committee appointed by the Council to confer with a similar committee of the House in relation to the printing of rules and bills in Spanish, through their chairman, Mr. Ancheta, reported the following bill, with the recommendation that it be passed.

Council Bill 62-entitled An Act to provide for the printing of bills, reports, documents and etc., in the Spanish language; the bill was read in full for information; the bill was then read a first and second time by title, and under suspension of the rules was read a third time by title.

Mr. Perea moved that the bill pass, which motion being carried; the ayes and nays were called for with the following result: Ayes, Messrs. Catron, Ancheta, Contreras, Jaramillo, Mills, Perea, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. President-12.

Nays, none.

Therefore Council Bill No. 62 was duly passed.

Resolutions were now in order, none were presented.
Introduction of bills was now in order.

Mr Stover introduced the following:

Council Bill No. 63, entitled An Act to amend Chapter 11, Title 33 of the Compiled Laws of New Mexico, relating to judgments; bill read in full for information; bill read a first and second time by title, and referred to the committee on judiciary, without being translated or printed.

Joint resolutions were now in order, none being presented. Bills on second reading were now in order.

Council Bill No. 18 was taken up, but upon motion of Mr. Catron it was laid on the table until Monday.

Council Bill No. 27-entitled An Act to provide for the purchase of school books for the inmates of the territorial penitentiary was next taken up and the report of the committee on penitentiary thereon read and adopted.

Mr. Mills presented an amendment to be inserted at the end of Section 1, which amendment was adopted.

Mr. Jaramillo moved that the bill be read a third time by title, and that it pass, which motion was carried.
