A message announced that the House had concurred in Council Substitute to Council Bill No. 71-An Act providing for the appointment of a district attorney in and for the counties of Lincoln, Chaves and Eddy, in the Territory of New Mexico, and for other purposes; and

Council Bill No. 85-An Act amending Section 6, of Chapter 56, of the Session Laws of 1889, relating to duties of district attorneys; and also had passed House Substitute to House Bills Nos. 30 and 29-An Act to repeal An Act entitled "An Act to compel persons, companies or corporations, cultivating or irrigating lands by means of water raised or pumped from wells and in other ways to enclose the same with a fence, and for other purposes," becoming a law by limitation February 28, 1891; and also,

House Bill No. 157-An Act relating to the organization of new counties in the Territory of New Mexico.

The President signed Council Bill No. 120—An Act for the protection of mines and mining claims; also,

Council Bill No. 28-An Act for the protection of the records of the several counties of the Territory of New Mexico, and regulating the business of abstracting in relation thereto; also,

Council Bill No. 147-An Act to repeal Section 1365, of the Compiled Laws of New Mexico of 1884; also,

Council Bill No. 126-An Act relating to cities and incorporated towns; also,

Council Substitute to Council Bill No. 71--An Act providing for the appointment of a district attorney in and for the counties of Lincoln, Chaves and Eddy, in the Territory of New Mexico, and for other purposes; also,

Council Bill No. 85-An Act amending Section 6, of Chapter 56, of the Session Laws of 1889, relating to duties of district attorneys; also,

Council Bill No. 92-An Act to amend Sections 2406 and 2407, of the Compiled Laws of 1884, relating to change of venue in justices of peace courts; also,

Council Bill No. 105--An Act to amend Section 742, of the Compiled Laws of New Mexico.

Council Bill No. 141--An Act providing a method for the

assessment and taxation of railroads, was taken up and read in full for information.

On motion of Mr. Mills the bill was read the third time by title, and on his further motion the bill passed by the following

vote:

Ayes, Messrs. Catron, Contreras, Jaramillo, Mills, Perea, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. Pres ident-11.

Nays, none.

Absent, Mr. Ancheta.

Therefore Council Bill No. 141 was passed.

A message announced that the House had passed House Substitute to House Bill No. 132, An Act dividing the Territory of New Mexico into legislative districts, and apportioning the councilmen and members of the house of representatives.

Mr. Catron moved that the House Substitute to Council Bill No. 81, An Act providing funds and making appropriations for the 42d and 43d fiscal years and for other purposes, be made the special order for 2:30 p. m. Carried.

Mr. Stover moved to take up House Substitute for House Bill No. 120, An Act to provide for the display of products of New Mexico in the World's Columbian Exposition. Lost.

A message announced that the House had passed Council Bill No. 96, An Act relating to judgment liens; also,

Council Bill No. 95-An Act relating to practice in the district court; also,

Council Bill No. 108-An Act in relation to crimes, punishments and criminal procedure.

The chair signed the three last named Council Bills, No. 95, 96 and 108.

Mr. Richardson asked unanimous consent to take Bill No. 138, An Act authorizing and restricting the issue of bonds by counties for the building of court houses and jails.

Mr. Perea objected.

Mr. Stover moved that the rules be suspended, and House Bill No. 138 be now taken up. Carried.

The bill was read in full for information; the rules, on momotion of Mr. Richardson, were further suspended and the bill was read the second time, notwithstanding Mr. Perea's objection.

Mr. Perea moved that the Council go into executive session. Motion lost.

On motion of Mr. Richardson, the rules were further suspended and the bill was read the third time by title.

Mr. Perea moved to adjourn.

Lost.

On the further motion of Mr. Richardson the bill passed by the following vote:

A message announced that the House had passed House Bill No. 156, An Act to amend An Act prohibiting hogs from running at large; also,

House Bill No. 127-An Act to provide for minor children; also,

House Bill No. 176-a substitute for An Act to amend Section 1, of Chapter 28, of the Session Laws of 1889, in regard to graveyards; also,

House Bill No. 88--An Act in relation to the Agricultural College and Agricultural Experiment Station of New Mexico.

On motion of Mr. Catron the last reported bill was taken up and read the first time by title, the rules were further suspended and the bill read the second time in full, and on his further motion the bill was read the third time and passed by the following vote:

Ayes, Messrs. Catron, Jaramillo, Mills, Perea, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. President---10. Nays, Mr. Contreras-1.

Absent, Mr. Ancheta.

Therefore House Bill No. 88 was passed.

On motion of Mr. Catron House Bill No. 174, An Act fixing the salary of the territorial librarian, was taken up and read the first time, the rules were suspended and the bill was read the second time by title, and by unanimou's consent it was read the third time by title, and on motion of Mr. Catron the bill passed by the following vote:

Ayes, Messrs. Catron, Contreras, Jaramillo, Mills, Perea, Santistevan, Stover, Valdez, Vigil and Mr. Pesident-10. Nays, none.

Absent, Messrs. Ancheta and Richardson.

Therefore House Bill No. 174 was passed.

On motion of Mr. Perea, and by unanimous consent, House Bill No. 127, An Act to provide for minor children, was taken up and read the first time in full.

On motion of Mr. Mills, it was read the second time by title, and on motion of Mr. Jaramillo it was read the third time, and on his further motion the bill passed by the following vote:

Ayes, Messrs. Catron, Contreras, Jaramillo, Mills, Perea, Santistevan, Stover, Valdez, Vigil and Mr. President--10. Nays, Mr. Richardson-1.

A message announced that the House had concurred in Council amendments to House Joint Resolution No. 10, relating to the pay of clerks and employes.

On motion of Mr. Jaramillo, and by unanimous consent House Bill No. 126, to amend Chapter 135 of the Laws of 1889, was taken up, read the first time in full, and on motion of Mr. Jaramillo the bill was read the second time by title.

Mr. Jaramillo moved that the rules be further suspended and the bill be read the third time.

The President signed House Joint Resolution No. 10, relating to the pay of clerks and employes.

On motion of Mr. Perea, and by unanimous consent, House Bill No. 192, An Act for the relief of counties and municipalities, was read in full, and, on motion of Mr. Richardson, it was read the second time by title, and on his further motion it was read the third time and passed by the following vote:

Ayes, Messrs. Catron, Contreras, Jaramillo, Mills, Perea, Richardson, Santiste van, Stover, Valdez, Vigil and Mr. President-11.

Nays, none.

Therefore, House Bill No. 192 was passed.

The President signed House Bill No. 197, An Act to provide for minor children; also,

House Bill No. 88-An Act in relation to the Agricultural College and Agricultural Experiment Station of New Mexico; also, House Bill No. 113- An Act to provide a method for establishing the rights of appropriation of water for ditches, canals or feeders of reservoirs, and requiring registration of all such hereinafter made, changed or enlarged; also,

House Bill No. 184- An Act to require the redemption of merchandise checks, orders, tickets and due bills at their full face value in cash or merchandise; also,

House Bill No. 174-An Act fixing the salary of the Territorial librarian; also,

House Bill No. 138-An Act authorizing and restricting the issue of bonds by counties, for the building of court houses and jails.

Mr. Richardson demanded the regular order, being House Substitute to Council Bill No. 81, An Act providing funds and making appropriations for the 42d and 43d fiscal years and for other purposes, which was read in full for information, and the rules were suspended and the bill was read a second time.

On motion of Mr. Perea, the House Substitute to this bill was laid on the table indefinitely, and he presented a substitute to the House Substitute which was read the first, second and third time and adopted.

On motion of Mr. Perea, that the President appoint a committee of three to confer with a similar committee of the House on the disagreeing votes of the two houses on this bill, the President appointed Messrs. Perea, Catron and Jaramillo as said committee on the part of the Council.

A message announced that the House had passed Council Bill No. 66, An Act to provide for the establishment, change, maintenance and control of roads and highways in the Territory of New Mexico; also,
