AFTERNOON SESSION.

Upon motion of Mr. Stover the Council again resolved itself into a committee of the whole with House Bill No. 85, as a substitute for Council substitute for Council Bill No. 12 under consideration.

Mr. Richardson now moved that the committee of the whole rise and report progress.

Upon the committee of the whole arising the President as chairman of said committee announced to the Council that they had had under consideration House Bill No. 85 as a substitute for Council substitue for Council Bill No. 12, and recommended that the same pass.

Upon motion of Mr. Richardson the report of the committee of the whole was adopted.

Upon motion of Mr. Stover House Bill No. 85 was considered as engrossed and put upon its third reading.

Mr. Richardson moved that House Bill No. 85 do now pass, and the ayes and nays were ordered with the following resuit:

Ayes, Messrs. Ancheta, Catron, Contreras, Jaramillo, Mills, Perea, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. President-12.

Nays, none.

Therefore House Bill No. 85 as a substitute for Council substitute for Council Bill No. 12 was passed.

Upon motion of Mr. Richardson the vote by which House Bill No. 85 had passed was reconsidered and laid upon the table indefinitely.

Upon motion of Mr. Richardson the Council now adjourned until 10 o'clock a. m. February 5, 1891.

MORNING SESSION.

Council met pursuant to adjournment.

Session opened by prayer by Rev. John Menaul.
Roll call dispensed with, all members being present.

The Journal of yesterday's proceedings was read and approved.

A messenger from the House appeared and announced that that honorable body had passed the following House substitute for House Bill No. 49, entitled An Act relating to discharged convicts; also, Council substitute for Council Bills Nos. 19 and 24 and House Bill No. 63, entitled An Act amending An Act in relation to the election of justices of the peace, and for other purposes; approved February 28, 1889.

As a matter of privilege the committee on enrolled and engrossed bills through its chairman, Mr. Ancheta, reported that Council Joint Resolution was duly enrolled.

The chair announced that he had signed Council Joint Resolution No. 6, authorizing the appointment of a commission to proceed to Washington relative to land court bill.

Unanimous consent having been granted the committee on the judiciary, through Mr. Ancheta, made a report on Council Bill No. 79, entitled An Act to fix the time for holding the su preme and district courts in the Territory of New Mexico, with House amendments, recommending the passage of the bill with additional amendments. The report and bill ordered to lie on the table and await their regular order.

Under the unanimous consent granted; Mr. Richardson introduced:

Council Bill No. 121-entitled An Act prescribing the mode for determining and defining the nature, extent and duration of all rights and interests in and liens upon and to quiet the title of real property; the bill was read a first time by title, and under suspension of the rules read a second time, ordered trans

lated and printed, and referred to the committee on the judiciary.

The committee on the judiciary through its chairman, Mr. Catron, made the following reports:

On House Bill No. 82, entitled An Act authorizing the admission of church records and family records in evidence, they reported adversely, but presented a substitute for said bill which they recommended for passage.

Ön Council Bill No. 63, entitled An Act to amend Chapter 11, of Title 33, of the Compiled Laws of New Mexico, relating to judgments, they recommended several amendments and the passage of the bill as so amended.

On Council Bill No. 101, entitled An Act relating to gamblers, gambling and gambling devices, they reported adversely, but presented a substitute for said bill which they recommended for passage.

The above reports with bills were ordered to lie on the table and await their regular order.

Upon motion of Mr. Aucheta the special order of the day, Council Bill No. 81, was set aside for the time being, and Council Bill No. 79, entitled An Act to fix the time for holding the supreme and district courts in the Territory of New Mexico, with House amendments, and the report of the committee on the judiciary recommending the passage of the bill with several additional amendments was taken up, and read in full for information, and the report on same adopted.

Upon motion of Mr. Ancheta the bill was considered as engrossed and read a third time by title.

Mr. Richardson now moved that Council Bill No. 79 pass, and the ayes and nays were ordered with the following result: Ayes, Messrs. Ancheta, Catron, Contreras, Mills, Perea, Richardson, Santistevan, Stover, Vigil and Mr. President-10. Nays, none.

Messrs. Jaramillo and Valdez did not vote

Therefore Council Bill No. 79 was duly passed.

A messenger of the House now appeared and announced that that honorable body had passed Council Bill No. 47 entitled An Act to amend Chapter 23 of Session Laws of 1887 and for other purposes.

Under the unanimous consent already granted, Council Bill No. 101-entitled An Act relating to gamblers, gambling and gambling devices, with the report of the committee

on

judiciary, recommending that the bill do not pass, but that the substitute offered by said committee do pass, the substitute was read a first and second time by title, then was read in full for information.

Upon motion of Mr. Jaramillo the substitute for Council Bill No. 101 was considered as engrossed and read a third time by title.

Mr. Jaramillo now moves that substitute for Council Bill No. 101 pass; and the ayes and nays were ordered with the following result:

Ayes, Messrs. Ancheta, Catron, Contreras, Jaramillo, Perea, Santistevan, Stover, Valdez, Vigil and Mr. President -10. Nays, Messrs. Mills and Richardson-2.

Therefore the substitute for Council Bill No. 101 was duly passed.

The chair presented a message from the Governor announcing that he had approved and signed Council Bill No. 8, entitled An Act declaring certain trusts, pools and combinations illegal, and providing for the punishment thereof; also, Council Joint Resolution No. 6, authorizing the appointment of a commission to proceed to Washington, relative to the land court bill.

The chair presented a second message from the Governor in which he announced that he had not approved Council Bill No. 55, entitled An Act to provide for the issuance of county current expense bonds in the Territory of New Mexico.

The said message and bill were referred to the committee on the judiciary.

A messenger from the House appeared and announced that the House had passed House Joint Memorial No. 5.

Council Bill No. 63-entitled An Act to amend Chapter 11, of Title 33, of the Compiled Laws of New Mexico, relating to judgments, and the report of the judiciary committee thereon, recommending its passage was taken up and read in full for information.

Upon motion of Mr. Richardson the bill was considered as engrossed and put upon its third reading.

Mr. Richardson made a motion that the bill pass, and the ayes and nays were ordered with the following result:

Ayes, Messrs. Ancheta, Catron, Contreras, Jaramillo, Perea, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. Presi dent-11.

Nays, none.

Therefore Council Bill No. 62 as amended passed.

House Bill No. 82-entitled An Act authorizing the admission of church records and family records in evidence, and the report recommending the passage of a substitute for said House Bill No. 82 was taken up.

Upon motion the report was adopted, and the substitute read a first time by title then read a second time in full for information.

Upon motion of Mr Catron the substitute for House Bill No. 82 was considered engrossed, and read a third time.

Mr. Catron made a motion that substitute for House Bill No.

82 do now pass; the ayes and nays were ordered with the following result:

Ayes, Messrs. Ancheta, Catron, Contreras, Jaramillo, Mills, Perea, Richardson, Santistevan, Stover, Valdez, and Mr. President-11.

Nays, none.

Therefore substitute for House Bill No. 82 was passed.
The chair announced the order of business.

Petitions and memorials, none being presented.

Reports of standing committees were in order, none being *presented.

Reports of special committees were in order, none being presented.

Resolutions were in order, none being presented.

Introduction of bills was in order, none being presented.
Joint resolutions were in order, none being presented.

Bills on second reading were in order.

And Council Bill No. 44-entitled An Act fixing the compensation of county assessors in the Territory of New Mexico, and the report of the committee on territorial affairs recommending its passage was taken up; the bill read in full for information, and upon motion the report was adopted.

Mr. Jaramillo made a motion to amend Council Bill No. 44, which said amendment was adopted.

Upon motion of Mr. Perea Council Bill No. 44 was referred to the committee of the whole for consideration.

Upon motion of Mr. Ancheta the Council adjourned.
