The committee on the judiciary through its chairman, Mr. Catron, made the following reports:

On House Bill No. 82, entitled An Act authorizing the admission of church records and family records in evidence, they reported adversely, but presented a substitute for said bill which they recommended for passage.

Ön Council Bill No. 63, entitled An Act to amend Chapter 11, of Title 33, of the Compiled Laws of New Mexico, relating to judgments, they recommended several amendments and the passage of the bill as so amended.

On Council Bill No. 101, entitled An Act relating to gam. blers, gambling and gambling devices, they reported adversely, but presented a substitute for said bill which they recommended for passage.

The above reports with bills were ordered to lie on the table and await their regular order.

Upon motion of Mr. Aucheta the special order of the day, Council Bill No. 81, was set aside for the time being, and Council Bill No. 79, entitled An Act to fix the time for holding the supreme and district courts in the Territory of New Mexico, with House amendments, and the report of the committee on the judiciary recommending the passage of the bill with several additional amendments was taken up, and read in full for information, and the report on same adopted.

Upon motion of Mr. Ancheta the bill was considered as engrossed and read a third time by title.

Mr. Richardson now moved that Council Bill No. 79 pass, and the ayes and nays were ordered with the following result: Ayes, Messrs. Ancheta, Catron, Contreras, Mills, Perea, Richardson, Santistevan, Stover, Vigil and Mr. President-10. Nays, none.

Messrs. Jaramillo and Valdez did not vote

Therefore Council Bill No. 79 was duly passed.

A messenger of the House now appeared and announced that that honorable body had passed Council Bill No. 47 entitled An Act to amend Chapter 23 of Session Laws of 1887 and for other purposes.

Under the unanimous consent already granted, Council Bill No. 101-entitled An Act relating to gamblers, gambling and gambling devices, with the report of the committee

on

judiciary, recommending that the bill do not pass, but that the substitute offered by said committee do pass, the substitute was read a first and second time by title, then was read in full for information.

Upon motion of Mr. Jaramillo the substitute for Council Bill No. 101 was considered as engrossed and read a third time by title.

Mr. Jaramillo now moves that substitute for Council Bill No. and the ayes and nays were ordered with the follow

Ayes, Messrs. Ancheta, Catron, Contreras, Jaramillo, Perea, Santistevan, Stover, Valdez, Vigil and Mr. President -10. Nays, Messrs. Mills and Richardson-2.

Therefore the substitute for Council Bill No. 101 was duly passed.

The chair presented a message from the Governor announcing that he had approved and signed Council Bill No. 8, entitled An Act declaring certain trusts, pools and combinations illegal, and providing for the punishment thereof; also, Council Joint Resolution No. 6, authorizing the appointment of a commission to proceed to Washington, relative to the land court bill.

The chair presented a second message from the Governor in which he announced that he had not approved Council Bill No. 55, entitled An Act to provide for the issuance of county current expense bonds in the Territory of New Mexico.

The said message and bill were referred to the committee on the judiciary.

A messenger from the House appeared and announced that the House had passed House Joint Memorial No. 5.

Council Bill No. 63-entitled An Act to amend Chapter 11, of Title 33, of the Compiled Laws of New Mexico, relating to judgments, and the report of the judiciary committee thereon, recommending its passage was taken up and read in full for information.

Upon motion of Mr. Richardson the bill was considered as engrossed and put upon its third reading.

Mr. Richardson made a motion that the bill pass, and the ayes and nays were ordered with the following result:

Ayes, Messrs. Ancheta, Catron, Contreras, Jaramillo, Perea, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. Presi dent-11.

Nays, none.

Therefore Council Bill No. 62 as amended passed.

House Bill No. 82-entitled An Act authorizing the admission of church records and family records in evidence, and the report recommending the passage of a substitute for said House Bill No. 82 was taken up.

Upon motion the report was adopted, and the substitute read a first time by title then read a second time in full for information.

Upon motion of Mr Catron the substitute for House Bill No. 82 was considered engrossed, and read a third time.

Mr. Catron made a motion that substitute for House Bill No.

82 do now pass; the ayes and nays were ordered with the following result:

Ayes, Messrs. Ancheta, Catron, Contreras, Jaramillo, Mills, Perea, Richardson, Santistevan, Stover, Valdez, and Mr. President-11.

Nays, none.

Therefore substitute for House Bill No. 82 was passed.
The chair announced the order of business.

Reports of standing committees were in order, none being *presented.

Resolutions were in order, none being presented.

And Council Bill No. 44- entitled An Act fixing the compensation of county assessors in the Territory of New Mexico, and the report of the committee on territorial affairs recommending its passage was taken up; the bill read in full for information, and upon motion the report was adopted.

Mr. Jaramillo inade a motion to amend Council Bill No. 44, which said amendment was adopted.

Upon motion of Mr. Perea Council Bill No. 44 was referred to the committee of the whole for consideration.

Upon motion of Mr. Ancheta the Council adjourned.

Council Bill No. 23-entitled An Act to regulate the transportation of freights by railroad corporations and to present the pooling of their earnings, and the report of the committee on railroads recommending that the bill do not pass, was taken up. Upon motion the report of the committee on railroads was adopted.

Upon motion of Mr. Stover Council Bill No. 23 and report were ordered to lie on the table indefinitely.

Council Bill No. 81-entitled An Act providing funds and making appropriations for the 42d and 43d fiscal years, and for other purposes, was taken up as the special order of the day.

A messenger from the House appeared and announced that House Bill No. 102, entitled An Act in relation to live stock had passed that honorable body.

Upon motion of Mr. Richardson the Council adjourned until 10 o'clock February 6, 1891, with Council Bill No. 81 pending.

Council met pursuant to adjournment.

Session opened by prayer by the Rev. John Menaul.

Roll call dispensed with, all members being present with ex

ception of Hon. J. A. Ancheta, who was and is still suffering from the effects of an attempted assassination.

The Journal of yesterday's proceedings was read and approved A messenger of the House appeared and announced that Council Bill No. 79, entitled An Act to fix the time for holding the supreme and district courts in the Territory of New Mexico, had passed the House, with the amendments of the Council.

Uuanimons consent having been granted Mr. Catron introduced the following bill:

Councill Bill No. 122- entitled An Act making appropriation for the arrest and conviction of the parties concerned in the shooting and wounding of Hon. J. A. Ancheta; the bill was read a first time in full, and on motion of Mr. Jaramillo the bill was read a second time by title under suspension of the rules.

Upon motion of Mr. Valdez the rules were further suspended and the bill was read a third time by title, and put upon its passage.

Mr. Catron now moved that Council Bill No. 122 pass and the ayes and nays were ordered with the following result:

Ayes, Messrs. Catron, Contreras, Jaramillo, Mills, Perea, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. President-11.

Nays, none.

The Hon. J. A. Ancheta absent..

Therefore Council Bill No. 122 was passed unanimously.
Mr. Catron now introduced the following resolution: .

Resolved, By the Council of the Legislative Assembly of the Territory of New Mexico: That we sincerely extend to our honored colleague, Hon. J. A. Ancheta, our heartfelt sympa. thies in his affliction and assure him that he may command each and everyone of us and our means and resources to aid and assist him.

Upon motion of Mr. Jaramillo the above resolution was unanimously adopted.

Upon motion of Mr. Catron, the President of the Council was directed to forward an engrossed copy of the above resolu tion to Hon. J. A. Ancheta, with the information that the same was passed unanimously.

A messenger from the House appeared and announced that House Joint Resolution No. 7 appropriating $20,000 as a reward for the arrest and conviction of the would be assassins of
