Upon motion of Mr. Santistevan the vote by which Council Bill No. 53, entitled An Act to provide for the prompt payment of wages to laborers every month, passed, was reconsidered.

Upon motion of Mr. Perea the Council then resolved itself into a committee of the whole, with the President in the chair, to resume the consideration of Council Bill No. 81.

Committee of the whole arose temporarily and received a message from the House, who announced that Council Bill No. 62 with amendments, and House Bills Nos. 82, 78 and 25 had passed that body.

Upon motion of Mr. Perea the committee of the whole again arose and upon further motion of Mr. Perea Council Bill No. 53 was ordered to be re called from the House, where it had been sent after its passage yesterday.

The chair here announced that he had signed House Bill No. 32, entitled An Act in relation to sewers in cities and incorporated towns.

The committee of the whole was then resumed.

The committee of the whole again rose temporarily to receive a messenger from the House, who announced the amendments of the Council to the amendments of the House to Council Bill No. 5, had passed that body.

Upon motion of Mr. Perea the Council resolved itself into a committee of the whole, with the President in the chair to resume the consideration of Council Bill No. 81, entitled An Act providing funds and making appropriations for the 42d and 43 fiscal years and for other purposes, which was made a special order for today.

Upon the committee of the whole arising the President as chairman of said committee reported that they had under consideration Council Bill No. 81 and that they had come to no resolution thereon.

Mr. Ancheta rose to a question of privilege and as chairman of the committee on enrolled and engrosed bills, reported that Council Bill No. 56, entitled An Act amending Chapter 52 of the Session Laws of 1887, was duly enrolled.

The chair announced that he had signed Council Bill No. 56 entitled as above.

messenger from the House, who announced that Council Bill, No. 77 entitled An Act to repeal chapter 107, of the Session Laws of 1889 relating to fences in special cases; also

House amendments to Council Bill No. 79-entitled An Act to fix the time for holding the Supreme and District Courts in the Territory of New Mexico; also

House Bill No. 56-entitled An Act to amend An Act en titled An Act for the protection of wives and families, of Session Laws of 1887, had duly passed that body and asked the concurrence of the Council therein.

Committee of the whole resumed.

Upon the committee of the whole rising the President as chairman of said committee reported that they had under consideration Council Bill No. 81, and had come to no resolution thereon.

The Journal of yesterday's proceedings was read, and upon motion of Mr. Perea was approved.

Mr. Perea made a motion that the Council now resolve itself into a committee of the whole to resume the consideration of Council Bill No. 81, entitled An Act providing funds and making appropriations for the 42d and 43d fiscal years, and for other purposas; and further that no member be allowed to speak more than one time upon a subject before the other members

have spoken on the same subject, and that no member be allowed to speak more than five minutes at a time. Nr. Perea afterwards withdrew his motion temporarily.

Mr. Catron made a motion to suspend the rules and take up business on the President's table.

The motion having prevailed House Bill No. 56, entitled An Act to amend An Act entitled An Act for the protection of wives and families, of the Session Laws of 1887, taken up read a first time by title, and under suspension of rules read a second time by title and referred to the committee on territorial affairs.

House substitute for House Bills 29 and 30, entitled An Act to repeal An Act entitled An Act to compel persons, companies or corporations cultivating or irrigating lands by means of water raised or pumped from wells, and in other ways to inclose the same with a fence, and for other purposes, becoming a law by limitation February 21, 1889, was taken up, read a first time by title, and under suspension of rules was read a second time. Mr. Stover made a motion to suspend the rules and read the bill a third time, which motion being carried the bill was read a third time.

Mr. Mills moved that the bill now pass, the motion having carried the ayes and nays were ordered with the following result:

Ayes, Messrs. Ancheta, Catron, Contreras, Jaramillo, Mills, Perea, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. President-12.

Nays, none.

Therefore House substitute for House Bills No. 29 and No. 30, passed.

House Bill No. 88, An Act in relation to the Agricultural College and Agricultural Experiment Station of New Mexico was taken up and read a first time by title and under suspension of rules was read a second time by title, then read in full fʊr information and referred to the committee on education with instructions to report the same to-morrow.

House substitute for Council Bill No. 86, entitled An Act to amend section 1771 of the Compiled Laws of 1884; relating to the official bonds of the Territorial Auditor and Treasurer, was taken up, read a first time by title, and under suspension of the rules read a second time and referred to the committee on finance with instructions to report the same to-morrow.

Council Bill No. 54-entitled An Act to prevent animals in herds from trespassing upon lands, using and fouling the water thereon and for other purposes; was taken up read a first time, and under suspension of rules read a second time and referred to the committee on judiciary.

Council Bill No. 62-entitled An Act to provide for the printing of bills, reports documents, etc., in the Spanish language, with the amendments of the House; was taken up, read a firat time by title, and under suspension of the rules the bill was read a second time, under further suspension of the rules the bill was read a third time.

Mr. Ancheta moved that Council Bill No. 62 now pass, and the ayes and nays were ordered with the following result:

Ayes, Messrs. Ancheta, Catron, Contreras, Jaramillo, Mills, Perea, Richardson, Santistevan, Stover, Valdez, Vigil and Mr. President-12.

Nays, none.

Therefore Council Bill No. 62 was duly passed.

House Bill No. 82-entitled An Act authorizing the admission of church records and family records in evidence; was taken up, read a first time by title, and under suspension of the rules was read a second time by title, and referred to the committee on judiciary.

House Bill No. 78-entitled An Act to amend Chapter 76 of the Laws of 1889, entitled An Act to provide for the maintenance, government and police of the penitentiary and also the mode of employing the officers and other employes and fixing the pay for the same, and for other purposes; was taken up, read a first time by title and under suspension of the rules read a second time and referred to the committee on judiciary.

House Bill No. 85-entitled An Act establishig common schools in the Territory of New Mexico, and creating the office of superintendent of public instruction, read a first time by title, and under suspension of the rules read a second time, and upon motion of Mr. Stover was referred to the committee of the whole together with the Council bill on same subject.

Council Bill No 79-entitled An Act to fix the time for holding Supreme aud District Courts in the Territory of New Mexico, with amendments of the House thereon, was next taken up, read a first time by title and under suspension of the rules read a second time and referred to the committee on judiciary.
