pass and the ayes and nays were ordered with the following result.

Ayes, Messrs. Catron, Mills, Richardson and Stover-4.

Nays, Messrs. Ancheta, Contreras, Jaramillo, Perea, Santistevan, Valdez, Vigil and Mr. President-8.

Therefore House Bill No. 4 was rejected.

Upon motion of Mr. Perea the vote by which House Bill No. 4 was lost was reconsidered and the same laid on the table indefinitely.

By unanimous consent, Mr. Richardson introduced the following bills:

Council Bill No. 95-entitled An Act relating to practice in the district court; the bill was read a first time by title and under suspension of the rules read a second time, ordered translated and printed and referred to the committee on the judiciary; also

Council Bill No. 96-entitled An Act relating to judgment liens; the bill was read a first time by title, and under suspension of the rules, read a second time and referred to the committee on the judiciary.

Council Bill No. 53-entitled An Act to provide for the prompt payment of wages to laborers every month, and the report of the committee on territorial affairs, recommending the passage of the bill was next taken up, and bill read in full for

information.

After several ainendments to the bill being adopted, Mr. Perea moved that the bill be considered as engrossed and read a third time by title, which motion was carried and the bill was read a third time.

Mr. Ancheta now moved that Council Bill No. 53, pass as amended.

And the ayes and nays were ordered with the following result:

Ayes, Messrs. Ancheta, Contreras, Perea, Santistevan, Stover, Vigil and Mr. President-7.

Nays, Messrs. Catron, Jaramillo, Mills, Richardson and Valdez-5.

Therefore Councill Bill No. 53 as amended was passed.

House Bill No. 36-entitled An Act for the benefit of the Sisters of Mercy, and the report of the committee on finance, recommending that the bill be not passed, but that the appropiation for Hospital purposes at Silver City be equally divided

between the two hospitals at Silver City, was next taken up and read in full for information.

Upon motion of Mr. Perea the report of the committee was adopted and upon further motion of Mr. Perea, House Bill No. 36 was laid on the table indefinitely.

Council Bill No. 12-entitled An Act establishing common schools in the Territory of New Mexico and creating the office of superintendent of public instruction; and the report of the committee on education, recommending that the bill be not passed but that a substitute presented by the committee do pass Upon motion of Mr. Perea the report was adopted and the substitute for Council Bill No. 12 read a first time by title, and under the suspension of the rules read a second time.

Upon motion of Mr. Perea the Council then resolved itself into a committee of the whole with the President in the chair, to consider the substitute for Council Bill No. 12, section by by section.

Upon the committee of the whole arising, the President as chairman of the said committee, reported that they had had under consideration, the substitute for Council Bill No. 12, and that they had come to no resolution thereon.

Upon motion of Mr. Catron the substitute for Council Bill No. 12 was ordered printed, and when returned to be taken up and considered at the point, where left off

Upon motion of Mr. Catron the chaplain's (Rev. G. G. Smith) leave of absence was extended until February 15th 1891.

The Council then adjourned until 10 a. m. January 28th, 1891, upon motion of Mr. Catron.

Session opened by prayer by the Rev. John Menaul.
Roll-call dispensed with, all members being present.

The Journal of yesterday's proceedings was read and approved, upon motion of Mr. Jaramillo.

Council Bill No. 81--entitled An Act providing funds and making appropriations for the 42d and 43d fiscal years and for other purposes, which was made a special order for to-day, was taken. up and upon motion of Mr. Perea the Council resolved itself into a committee of the whole, with the President in the chair, to consider the same.

Upon the committee of the whole arising, the President as chairman of said committee, reported that they had had under consideration Council Bill No. 81 and had come to no resolu tion thereon.

Upon motion of Mr. Perea the Council then adjourned until 2 p. m.

By unanimous consent the following bills were introduced:
Mr. Richardson introduced:

Council Bill No. 97-entitled An Act to provide for the preservation of testimony adduced in all preliminary examinations before justices of the peace, in the Territory, of crimes and other felonies; the bill was read a first time by title, and under suspension of the rules read a second time and referred to the committee on judiciary.

Mr. Jaramillo introduced:

Council Bill No. 98-entitled An Act to district and appo"tion the Territory of New Mexico for councilmen and representatives; the bill was read a first time by title, and under sus pension of the rules read a second time and ordered translated and printed, and referred to the committee on the judiciary.

Mr. Stover introduced Council Bill No. 99—entitled An Act to enable counties to hold and manage certain real estate, for the purpose of creating corporations to hold and manage real estate, to provide for the commencement, prosecution and compromise of actions, with reference to real estate and for other matters connected therewith, and for other purposes; the bill was read a first time by title, and under suspension of the rules

read a second time, ordered translated and printed, and referred to the committee on the judiciary.

Upon motion of Mr. Santistevan the vote by which Council Bill No. 53, entitled An Act to provide for the prompt payment of wages to laborers every month, passed, was reconsidered.

Upon motion of Mr. Perea the Council then resolved itself into a committee of the whole, with the President in the chair, to resume the consideration of Council Bill No. 81.

Committee of the whole arose temporarily and received a message from the House, who announced that Council Bill No. 62 with amendments, and House Bills Nos. 82, 78 and 25 had passed that body.

Committee of the whole resumed.

Upon motion of Mr. Perea the committee of the whole again arose and upon further motion of Mr. Perea Council Bill No. 53 was ordered to be re called from the House, where it had been sent after its passage yesterday.

The chair here announced that he had signed House Bill No. 32, entitled An Act in relation to sewers in cities and incorporated towns.

The committee of the whole again rose temporarily to receive a messenger from the House, who announced the amendments of the Council to the amendments of the House to Council Bill No. 5, had passed that body.

The committee of the whole again arose temporarily to receive a messenger from the House, who announced that House Bill No. 85, had passed that body.

Committee of the whole resumed.

Upon the committee of the whole arising the President, as chairman of said committee, reported that they had had under consideration Council Bill No. 81, but had come to no resolution thereon.

Upon motion of Mr. Catron the Council then adjourned until 10 a. m. January 29, 1891.

Upon motion of Mr. Jaramillo the reading of the Journal of yesterday's proceedings was dispensed with and the Journal approved.

Upon motion of Mr. Perea the Council resolved itself into a committee of the whole, with the President in the chair to resume the consideration of Council Bill No. 81, entitled An Act providing funds and making appropriations for the 42d and 43 fiscal years and for other purposes, which was made a special order for today.

Upon the committee of the whole arising the President as chairman of said committee reported that they had under consideration Council Bill No. 81 and that they had come to no resolution thereon.

Mr. Ancheta rose to a question of privilege and as chairman of the committee on enrolled and engrosed bills, reported that Council Bill No. 56, entitled An Act amending Chapter 52 of the Session Laws of 1887, was duly enrolled.

The chair announced that he had signed Council Bill No. 56 entitled as above.

Upon motion of Mr. Perea the Council then adjourned until 2 o'clock p. m.
