7 SEC. 6. (a) (1) Each State and unit of general local 8 government shall permit any individual who is an individual 9 qualified to vote in any Federal election under the laws of the 10 State involved, or under any applicable Federal law, to 11 register and vote on the date of the Federal election involved 12 at the polling place at which such individual would have been 13 permitted to vote if such individual registered to vote before 14 the date of such election.

(2)(A) Except as provided in subparagraph (B), the 16 requirement established in paragraph (1) shall apply to the 17 general election for Federal office in 1978 and to each Fed18 eral election thereafter.

(B) The chief executive officer of any State may request 20 the Commission for a waiver of the application of the re21 quirement established in paragraph (1) with respect to elec22 tions for Federal office occurring before 1980. The Commis23 sion shall grant any such request if the Commission deter24 mines that

(i) the laws of the State involved require amend

ment or modification in order for such State to establish

eligibility for financial assistance under section 7(b)(1) (C); and

(ii) the legislature of such State is not able to con

vene at a regularly scheduled general session before

(3) Each State and unit of general local government

10 by individuals before the date of elections for Federal office. (b) (1) Any individual who registers to vote at a polling 12 place on the date of any Federal election in accordance with 13 subsection (a) shall establish his identity, place of residence, 14 and qualifications at the time of such registration by—

(A) executing at such polling place an affidavit or declaration under penalty of perjury, which the State or unit of general local government involved shall provide and which

(i) attests that such individual is a citizen of the United States and otherwise meets the qualifica

tions for voting under the laws of such State or

under any applicable Federal law;

(ii) lists such qualifications;

(iii) lists the name, residence address, and

place of birth of such individual;

(iv) includes on its face a brief summary of the penalties established in section 11 and of any applicable penalties under State law; and

(v) attests that such individual has not voted

in the election involved; and

(B) if additional identification is required by the State or unit of general local government involved, submitting either

(i) a form or forms of identification establishing the identity and place of residence of such individual, which has been approved by the Commission; or

(ii) an affidavit attesting to the identity and place of residence of such individual, which is executed as provided in paragraph (6).

(2) The form of any affidavit or declaration required

17 by any State or unit of general local government under para18 graph (1)(A) or paragraph (1)(B) (ii) shall be subject to 19 approval by the Commission.

(3) If a State or unit of general local government 21 establishes or administers any rule or procedure which per22 mits an individual to vote in a Federal election if such 23 individual is present at the polling place involved before the 24 closing of such polling place on the date of the election 25 involved, then such State or unit of general local government

1 shall establish and administer rules and procedures which 2 permit an individual to register to vote under this section 3 and, when registered, to vote, if such individual is present 4 at the polling place involved before the closing of such polling 5 place on the date of the election involved.

(4) A State or unit of general local government may 7 require an individual to submit more than one form of identi8 fication under paragraph (1)(B) (i) only if the submis9 sion of additional such forms of identification is necessary 10 to establish the identity and place of residence of such in11 dividual. An individual shall be permitted to submit, in 12 addition to, or in lieu of, any form of identification required 13 under paragraph (1)(B) (i), such additional forms of 14 identification approved in accordance with such paragraph 15 as may be necessary to establish the identity and place of 16 residence of such individual.

(5) The effective period of any registration made by 18 any individual under this section may not be less than the 19 effective period applicable to any registration made by any other method or procedure which is permitted by the State or unit of general local government involved.

(6) The affidavit required by paragraph (1)(B)(ii)

23 shall be executed by an individual who

(A) has registered to vote at the polling place

involved before the date of the election for which the

individual with respect to whom such affidavit is executed

desires to register;

(B) is present at such polling place with such individual on such date; and

(C) has not executed more than four other affidavits under paragraph (1)(B)(ii) on such date.

(7)(A) Each State and unit of general local govern

8 ment shall provide at each polling place means by which 9 individuals registering to vote under this section are proc10 essed separately from individuals voting at such polling 11 place who registered to vote before the date of the election 12 involved.

(B) The Commission may exempt any State or unit of 14 general local government from the application of subpara15 graph (A) with respect to any polling place at which the 16 Commission considers the separate processing required by 17 such subparagraph to be impracticable or unnecessary. 18 (c) Nothing contained in this Act shall be construed 19 to limit the power of any State to prescribe the qualifications 20 for voting in any Federal election conducted in such State. (d) (1) Any standard, practice, or procedure established

or maintained by any State or unit of general local govern

23 ment which is necessary to comply with the requirements of 24 subsection (a), or which is necessary to establish eligibility 25 for financial assistance under section 7, shall not be subject
