An Act Concerning licensed officers of vessels.

[Navigation-R. S. sec. 4438 amended.] That section forty-four hundred and thirty-eight of the Revised Statutes be, and is hereby, amended to read as follows:

"Sec. 4438. [Licenses for masters, etc., modified- penalty for violation.] The boards of local inspectors shall license and classify the masters, chief mates, and second and third mates, if in charge of a watch, engineers, and pilots of all steam vessels, and the masters of sail vessels of over seven hundred gross tons, and all other vessels of over one hundred gross tons carrying passengers for hire. It shall be unlawful to employ any person, or for any person to serve, as a master, chief mate, engineer in charge of a watch, or pilot of any steamer or as master of any sail vessel of over seven hundred gross tons, or of any other vessel of over one hundred gross tons carrying passengers for hire, who is not licensed by the inspectors; and anyone violating this section shall be liable to a penalty of one hundred dollars for each offense." [34 Stat. L. 864.]

An Act To amend section forty-four hundred and forty-six of the Revised Statutes, relating to licensed masters, mates, engineers, and pilots.

[Act of Feb. 19, 1907, ch. 991, 34 Stat. L. 897.]

[Steam vessels-R. S. sec. 4446 amended.] That section forty-four hundred and forty-six of the Revised Statutes, as the same is now in force and effect, be, and the same is hereby, amended so as to read as follows:

"Sec. 4446. [License to be exhibited - temporary transfer to another vessel — penalty for violation.] Every master, mate, engineer, and pilot who shall receive a license shall, when employed upon any vessel, within forty-eight hours F. S. A. Supp.-26

after going on duty, place his certificate of license, which shall be framed under glass, in some conspicuous place in such vessel, where it can be seen by passengers and others at all times: Provided, That in case of emergency such officer may be transferred to another vessel of the same owners for a period not exceeding forty-eight hours without the transfer of his license to such other vessel; and for every neglect to comply with this provision by any such master, mate, engineer, or pilot, he shall be subject to a fine of one hundred dollars, or to the revocation of his license." An Act To amend the laws relating to navigation, and for other purposes.

[Act of May 28, 1908, ch. 212, 35 Stat. L. 424.]

SEC. 2. [Licensed officers - R. S. sec. 4438 amended.] That section fortyfour hundred and thirty-eight of the Revised Statutes is hereby amended to read as follows sixty days after the passage of this Act:

"Sec. 4438. The boards of local inspectors shall license and classify the masters, chief mates, and second and third mates, if in charge of a watch, engineers, and pilots of all steam vessels, and the masters of sail vessels of over seven hundred gross tons, and all other vessels of over one hundred gross tons carrying passengers for hire. An Act To amend section forty-eight hundred and ninety-six of the Revised Statutes.

[Act of May 23, 1908, ch. 188, 35 Stat. L. 245.]

[Patents rights of legal representatives of inventor.] That section fortyeight hundred and ninety-six of the Revised Statutes be, and the same is hereby, amended so that the section shall read as follows:

"Sec. 4896. When any person, having made any new invention or discovery for which a patent might have been granted, dies before a patent is granted the right of applying for and obtaining the patent shall devolve on his executor or administrator, in trust for the heirs at law of the deceased, in case

he shall have died intestate; or if he shall have left a will disposing of the same, then in trust for his devisees in as full manner and on the same terms and conditions as the same might have been claimed or enjoyed by him in his lifetime; and when any person having made any new invention or discovery for which a patent might have been granted becomes insane before a patent is granted the right of applying for and obtaining the patent shall devolve on his legally appointed guardian, conservator, or representative in trust for his estate in as full manner and on the same terms and conditions as the same might have been claimed or enjoyed by him while sane; and when the application is made by such legal representatives the oath or affirmation required to be made shall be so varied in form that it can be made by them. The executor or administrator duly authorized under the law of any foreign country to administer upon the estate of the deceased inventor shall, in case the said inventor was not domiciled in the United States at the time of his death, have the right to apply for and obtain the patent. The authority of such foreign executor or administrator shall be proved by certificate of a diplomatic or consular officer of the United States.

"The foregoing section, as to insane persons, is to cover all applications now on file in the Patent Office or which may be hereafter made." [35 Stat. L. 245.]

An Act To amend section forty-eight hundred and eigìty-five of the Revised Statutes.

[Act of May 23, 1908, ch. 189, 35 Stat. L. 246.]

[Date of patent- time of final fee payment increased.] That section fortyeight hundred and eighty-five of the Revised Statutes be, and the same hereby is, amended to read as follows:

"Sec. 4885. Every patent shall issue within a period of three months from the date of the payment of the final fee, which fee shall be paid not later than six months from the time at which the application was passed and allowed and notice thereof was sent to the applicant or his agent; and if the final fee is not paid within that period the patent shall be withheld." [35 Stat. L. 246.]

An Act To codify, revise, and amend the penal laws of the United States.

That the penal laws of the United States be, and they hereby are, codified, revised, and amended, with title, chapters, headnotes, and sections, entitled, numbered, and to read as follows:

SEC. 1. [Treason.] Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason. [35 Stat. L. 1088.] See R. S. sec. 5331, 7 Fed. Stat. Annot. 348.
