LVI. MANUFACTURERS AND VENDERS OF MINERAL WATERS AND OTHER BEVERAGES MAY HAVE PROPRIETARY BOTTLES. PENALTY FOR USING THEM BY NON-OWNERS.

Act 9 April, 1870, Sec. 1, P. L., 1068.—If any person or persons shall, without the permission of the owner thereof, fill with mineral water, or any other article whatsoever, any bottle marked and registered in accordance with the Acts of April 9th, 1849, and January 20th, 1849, and April 20th, 1843, by the manufacturers and venders of mineral water and other beverages, or shall sell or buy, traffic in, or use or dispose of, any such bottles for gain, convenience, or profit, such person or persons shall be deemed guilty of a misdemeanor, and, upon conviction thereof, in the proper court, shall be liable to a fine not exceeding five hundred dollars, or imprisonment not exceeding six months.

Act 9 April, 1870, Sec. 2, P. L., 1068.-The using by any other person than the rightful owners of such bottles as aforesaid, shall be prima facie proof of the unlawful dealing in or using said bottles: Provided, That this act shall only apply to the city of Philadelphia.

Act 25 May, 1871, Sec. 1, P. L., 1177.-The provisions of an act, entitled "An act to punish the sale and traffic in mineral water bottles and other bottles, and for the protection of the bottlers and venders of mineral water and other beverages in this Commonwealth," approved the 9th day of April, Anno Domini 1870, be and the same is hereby extended to the counties of Northampton, Lehigh, Bucks, Carbon, and Monroe: Provided, That the penalties prescribed in said act shall apply only to persons who shall fill, sell, buy, traffic in or dispose of, such bottles as in said act set forth.

LVII. NEGLECT OF DUTY BY ASSESSORS, HOW PUNISHED.

Act 15 May, 1841, Sec. 3, P. L., 394.-If any assessor or assistant assessor shall knowingly and intentionally omit, neglect, or refuse to assess and return any property, person, or thing made taxable by law, or shall knowingly and intentionally assess, rate, or value the same at more or less than he shall know and believe the just cash value or rate thereof, or neglect or refuse to assess any tax required by law, he shall be guilty of a misdemeanor in office, and, on conviction thereof, be subject to imprisonment, not

less than three nor more than twelve months, and fined in a sum not less than one hundred nor more than two hundred dollars. ED. NOTE.-See Act 15 April, 1869, P. L., 981, as to assessors in Allegheny.

LVIII. COLLECTOR OF DELINQUENT TAXES IN PHILADELPHIA, HOW PUNISHED FOR NEGLECT OF DUTY.

Act 24 March, 1870, Sec. 4, P. L., 544.-In case the said collector of outstanding and delinquent taxes shall neglect or omit to file any claim placed in his hands for collection not paid, or shall neglect or omit to proceed to sell any real estate against which a lien exceeding ten dollars may have been filed, according to the foregoing provisions of this act, such neglect or omission shall be deemed a misdemeanor in office, and punishable, upon conviction, by a fine not less than three times the amount of said delinquent taxes, and removal from office by the court in which such conviction shall take place: Provided, That the provisions of this section shall not apply to any claim for taxes which the Board of Revision may decide cannot be collected, and may order to be stricken from the registry.

LIX. HEALTH CERTIFICATE MUST BE OBTAINED BEFORE COMMUNICATION WITH THE SHORE BY CREW OR PASSENGERS OF VESSELS, OR CARGO OR BAGGAGE DISCHARGED. Act 29 January, 1818, Sec. 4, 7 Sm., 9, P. L., 42.—If any master, commander, or pilot shall leave his station before the said Lazaretto, or if any master or commander shall permit or suffer any part of the cargo or baggage, or any person or persons arriving in such ship or vessel, from any port beyond the limits of the United States, to be landed on either shore of the Delaware bay or river, or suffer any person, except the pilot, to come on board, before such examination be duly had, and a certificate obtained as is hereinafter specified, the person or persons so permitting, and the person or persons so landed or going on board (unless imminent danger of the loss of the vessel or lives of the crew shall render assistance necessary), being thereof convicted, upon indictment or prosecution under this act, by verdict, confession, or standing mute, in any court having jurisdiction of the offence, shall pay a fine not exceeding five hundred dollars, to be recovered and appropriated as is herein directed.

LX. DECEPTION OF THE HEALTH-OFFICERS BY MASTER OR OTHERS, HOW PUNISHED.

Act 29 January, 1818, Sec. 4, 7 Sm., 9, P. L., 44.—If any master or captain, or other person, on board any vessel which shall be examined, agreeably to this law, shall not true answers make to all such questions as the Lazaretto physician and quarantine- . master, or the said health-officer or port-physician shall ask, agreeably to this act, or the rules heretofore established, or which shall, from time to time, be established by the board of health, in conformity with this act, or shall knowingly deceive, or attempt to deceive, the proper officers, as aforesaid, in his answers to their official inquiries, he having been duly informed and apprised of the penalties imposed by this act on the person so offending, previous to his said examination, by the person making such examination, such person, for each and every offence, being thereof legally convicted, shall forfeit and pay a sum not exceeding five hundred dollars, to be recovered and appropriated as hereinafter provided and directed, and, moreover, shall be sentenced to imprisonment at hard labor for any term not less than one year, and not exceeding five years.

ED. NOTE.-The limitation is one year.

LXI. REFUSING TO COMPLY WITH QUARANTINE REGULATIONS. PENALTY.

Act 29 January, 1818, Sec. 4, 7 Sm., 9.-If any captain or master of any ship or vessel, or any other person on board the same, shall refuse or neglect to comply with the directions of the Lazaretto physician and quarantine-master, which shall be made agreeably to this act, or the regulations of the board of health, with respect to the detention of any ship or vessel, or the landing from on board the same of any person or persons, or of any goods, merchandise, bedding, baggage, or clothing, or shall refuse to carry the same into effect, such person, for each and every such offence, shall forfeit and pay a sum not exceeding five hundred dollars, nor less than two hundred dollars, to be recovered and appropriated as is hereinafter provided and directed.

ED. NOTE.-Recovery to be before a court having jurisdiction of sum involved.

LXII. CAPTAINS OR MASTERS OF VESSELS FROM DOMESTIC PORTS, HAVING FOREIGN GOODS ON BOARD, Required to OBTAIN CERTIFICATE AND PRESENT IT AT THE HEALTHOFFICE WITHIN TWENTY-FOUR HOURS AFTER ARRIVAL IN PHILADELPHIA. PENALTY FOR FAILURE HEREIN.

Act 29 January, 1818, Sec. 5, 7 Sm., 9.- . . . . And if he should neglect so to do, being thereof legally convicted under this act, he shall be sentenced to pay a fine of two hundred dollars, to be recovered and appropriated as is hereinafter directed and provided.

LXIII. DOMESTIC VESSELS, HAVING ON BOARD ANY FOREIGN MERCHANDISE, BEDDING, CLOTHING, OR PERSONS, SHALL ANCHOR OPPOSITE THE LAZARETTO.

Act 29 January, 1818, Sec. 5, 7 Sm., 9, P. L., 45.-If the captain or master of any such ship or vessel coming from any port or place within the United States, and bound to the port of Philadelphia, having on board any goods or merchandise, bedding, clothing, or persons, as aforesaid, shall refuse or neglect to come to anchor opposite the Lazaretto, and shall pass the same, with intent to proceed to the city without examination by and certificate obtained from the said physician and quarantine-master, as aforesaid, he shall, on conviction, forfeit and pay the sum of five hundred dollars, to be recovered and appropriated as is hereinafter provided and directed; and the said vessels, goods, merchandise, bedding, clothing, and persons shall be sent back to the Lazaretto, there to be proceeded with in such manner as the board of health, agreeably to this act, shall in that case devise and direct.

ED. NOTE.-By act of 25 March, 1852, section 14, P. L., 181, section 5 of Act of 29 January, 1818, may be suspended from time to time by the Board of Health.

LXIV. PENALTY FOR HARBORING OR EMPLOYING ANY ESCAPED PERSON FROM THE LAZARETTO.

Act 29 January, 1818, Sec. 16, 7 Sm., 9, P. L., 51.- . . . . If any master or captain shall knowingly receive or employ on

board of his ship or vessel, or if any housekeeper or other inhabitant of this Commonwealth shall knowingly receive, harbor, or in any way entertain any person so eloping or absenting from the Lazaretto, each and every master and captain, and each and every housekeeper or inhabitant, so respectively offending, shall, on being thereof legally convicted, forfeit and pay a sum of two hundred dollars.

LXV. PENALTY FOR GOING WITHIN THE LIMITS OF THE LAZARETTO, OR LEAVING A SHIP OR VESSEL IN QUARANTINE, OR GOING ON BOARD SUCH VESSEL OR SHIP.

Act 29 January, 1818, Sec. 16, 7 Sm. 9, P. L., 51.— . . . . If any person arriving in and belonging to any ship or vessel detained at the Lazaretto as aforesaid, shall elope or absent himself or herself without having first obtained a discharge signed by the Lazaretto physician and the quarantine-master; or if any person other than those detained at the Lazaretto as aforesaid, shall go on board or alongside of any ship or vessel, whilst under quarantine as aforesaid; or if any person not authorized by the board of health, shall go within the limits of the Lazaretto, such person or persons shall perform such quarantine as the board of health may direct; the person so offending, upon legal conviction of such offence, shall forfeit and pay the sum of two hundred dollars, to be recovered and appropriated as hereinafter directed.

LXVI. REFUSAL TO OBEY THE INSTRUCTIONS OF THE LAZARETTO PHYSICIAN OR QUARANTINE-MASTER, HOW PUNISHED. Act 29 January, 1818, Sec. 16, 7 Sm., 9, P. L., 52.—If any diseased or other person landed and sent to the Lazaretto by any officer having authority to do the same, or any person arriving in or belonging to any ship or vessel detained at the Lazaretto as aforesaid, shall refuse or neglect to obey the directions of the Lazaretto physician or quarantine-master respectively, agreeably to this act, and the order and regulations by the board of health, which shall, from time to time, be ordained and established for the government and management of the Lazaretto, and the persons, vessels and cargoes under quarantine, the person so refusing or neglecting shall, for each and every offence, on being thereof legally convicted,
