Ordered, That the Clerk return said bill to the Senate, with a message informing that the Assembly have passed the same.

By unanimous consent, Mr. Baltz offered for the consideration of the House a resolution, in the words following:

Resolved, That there be printed and bound in cloth, under the direction of the State Engineer and Surveyor, the following number of copies of the report on railroads for the year ending September 30, 1872: For each member, officer and reporter of the Assembly, ten copies; and for the Department of the State Engineer and Surveyor, 2,400 copies; the whole expense thereof to be refunded to the treasury of the State by an equitable amount by the Comptroller on the several railroad companies

of this State.

Ordered, That said resolution be referred to the committee on public printing.

The Senate bill entitled "An act to amend an act entitled 'An act in relation to the debt of the town of Newtown, Queens county,' passed May 21, 1872," was read a third time.

Mr. Speaker put the question whether the House would agree to the final passage of said bill, and it was determined in the affirmative, a majority of all the members elected to the Assembly voting in favor thereof, and three-fifths of said members being present.

Ordered, That the Clerk return said bill to the Senate, with a message informing that the Assembly have passed the same.

A message from the Senate was received and read, informing of concurrence in the amendments of the Assembly to the bill entitled as follows:

"An act to extend the time for the collection of taxes in the town of Fort Ann, county of Washington."

Ordered, That the Clerk return said bill to the Senate.

The Senate returned the bill entitled "An act to incorporate the Saratoga Cemetery Association," with a message that they had passed the same with the following amendments:

Section 8, line 9, strike out the words " or other material except granite or marble."

Section 9, line 9, strike out the word "acreable."

The amendments having been read,

Mr. Speaker put the question whether the House would concur in the same, and it was determined in the affirmative, a majority of all the members elected to the Assembly voting in favor thereof, and three-fifths of said members being present.

Ordered, That the Clerk return said bill to the Senate, with a message informing of concurrence in their amendments.

The Senate returned the bill entitled "An act to authorize the construction of a railroad in Christopher and certain other streets and avenues in the city of New York," with a message that they had passed the same with the following amendments:

Section 2, line 17, strike out the words "two and a half," and insert the word "three." Add at the end of the section the words, "They shall also keep in good repair the pavement the width of their tracks and eighteen inches upon the outside of same through the streets and avenues and places on the above mentioned route," and strike out the words "they shall also keep in good repair the pavement the width of their tracks through the streets and avenues and places on the above mentioned route."

Add as section 4 the following:

§ 4. The Legislature may at any time alter, amend or repeal this Change section 4 to section 5.

The Senate returned the bill entitled "An act to incorporate the Oneonta Savings Bank, of Oneonta, Otsego county, New York," with a message that they had passed the same with the following amendments: Section 1, line 7, after the word "bank" insert the words "to be located at the village of Oneonta, Otsego county, New York."

Amend the title so as to read as follows:

"An act to incorporate the Oneonta Savings Bank, located at Oneonta, Otsego county, New York."

The amendments having been read,

Ordered, That the Clerk return said bill to the Senate, with a message informing of concurrence in their amendments.

The Senate returned the bill entitled "An act to revise and amend an act entitled 'An act to incorporate the village of Port Jervis,' passed March 30, 1866, and all acts relating thereto," with a message that they had passed the same with the following amendments:

Strike out all of section 1 from the word "all" line 1, down to and including the word "the" in line 27, and insert the following: "all that part of the town of Deerpark, in the county of Orange, contained in the following boundary, to wit: beginning at the tri-State rock, being the point of intersection of the States of New York, New Jersey and Pennsylvania, and the junction of the Delaware and Neversink river; thence north-easterly up the Neversink river to a point four hundred feet northeast from the boundary line that divides the lands of Elting Cuddlebuck and Simeon Westfall; thence north thirty-six degrees west, six thousand five hundred feet; thence south fifty-three degrees west to the berme bank of the Delaware and Hudson canal; thence along said canal northwesterly eighteen hundred and fifty feet; thence south fifty-three degrees west, crossing the Delaware and Hudson canal, the Erie railway and the lands of Buckley and Brothers, to the center of the Delaware river; thence down the same south-easterly to the place of beginning at the." Section 2, add at the end the words: "except as provided in this act." Section 6, line 2, strike out the word "third" and insert the word "second." Also, strike out the word "April" and insert the word "May."

Add at the end of section 40 the following: "but in case of the temporary absence or inability of said police justice to perform the duties of that office the same may be performed by a justice of the peace of the town of Deerpark."

Section 51, subdivision 14, line 7, strike out the word "two" and insert the word "three." Subdivision 29, line 8, after the word "swine insert the word "goats."

The amendments having been read,

The Senate returned the bill entitled "An act to amend an act entitled 'An act to regulate elections in the city of Brooklyn,' passed May 7, 1872," with a message that they had passed the same with the following amendments:

Section 4, line 24, engrossed bill, strike out the word "five" and insert the word "four."

Section 5, line 36, strike out all after the word "and" down to and including the word "year" in line 39, and insert in place thereof the words "each member of the said board shall be paid for his services at the rate of one thousand dollars a year."

Section 8, line 7, from the beginning of the section, strike out all after the word "appointment" down to and including the word "appointed " in line 8.

Section 15, line 6, after the word "of" insert the words "and resident of the ward containing."

Insert as section 24 the following:

"§ 24. The members of the board of election of the city of Brooklyn who were appointed as such on the third Monday of July, 1872, shall be entitled to a salary of one thousand dollars each, and the comptroller of Brooklyn is hereby directed to pay the same."

The amendments having been read,

Mr. Roche moved that the House non-concur in said amendments, that a conference committee be appointed on the part of the Assembly, and request a like committee on the part of the Senate.

Mr. Speaker put the question whether the House would agree to said motion, and it was determined in the affirmative.

Mr. Speaker appointed as such committee, Messrs. Roche, Watt, Van Cott, Higgins and Cocheu.

Ordered, That the Clerk return said bill to the Senate, with a message informing of non-concurrence in their amendments, and requesting a committee of conference.

The Senate returned the bill entitled "An act to amend an act entitled 'An act making appropriations for certain expenses of government, and for supplying deficiencies in former appropriations,' passed May 15, 1872, by a two-third vote," with a message that they had passed the same with the following amendment :

In title, strike out the words "by a two-thirds vote."

The amendment having been read,

Mr. Speaker put the question whether the House would concur in the same, and it was determined in the affirmative, two-thirds of all the members elected to the Assembly voting in favor thereof.
