AN ORDINANCE

(Approved September 11, 1912).

Granting permission to the Virginia State Fair Association, Incorporated, to string and maintain its advertising banners across Broad street, between Seventh and Eighth streets and across Main street, between Eighth and Ninth streets.

Be it ordained by the Council of the City of Richmond

1. That permission is hereby granted to the Virginia State Fair Association, Incorporated, to string and maintain its advertising banners, 12x20 feet in dimension, across Broad street, between Seventh and Eighth streets, and across Main street, between Eighth and Ninth streets, provided the owners of the houses from which it is so strung consent thereto, and provided, it shall not be at its lowest point less than 20 feet above the street.

2. The said permission hereby granted shall continue until October 15, 1912, subject at all times to any amendment or revocation by the City Council. 3. The said permission is given subject to the conditions that said Association will indemnify and save harmless the City of Richmond for any charges, damages and costs that the City may be required to pay by reason of any person being injured or damaged in person or property by the construction, existence or improper maintenance of the said banners. 4. This ordinance shall be in force from its passage.

AN ORDINANCE

To authorize Chas. F. Hudnall, a non-resident, to construct and maintain a sewer from his property on New York avenue to Virginia avenue, and there enter the Virginia avenue sewer belonging to the City of Richmond.

Be it ordained by the Council of the City of Richmond

1. That Chas. F. Hudnall be, and he is, hereby authorized to construct and maintain at his own costs and charges a sewer from his property located on New York avenue, in Riverview, to Virginia avenue, and there connect with the sewer belonging to the City of Richmond located in Virginia avenue; but before the same shall be constructed the said Chas. F. Hudnall shall file with the City Engineer, a plan showing the location, description and material of which the said sewer is to be constructed, which plan shall be satisfactory to the City Engineer.

2. That the said Chas. F. Hudnall shall execute and deliver to the City of Richmond a contract satisfactory to the City Attorney of the City of Richmond, agreeing that when the said territory in which the said sewer is located shall become the incorporated into the territory of the City of Richmond, that the said sewer, so far as located on a public highway, shall

become the property of the City of Richmond; and the said Chas. F. Hudnall shall also obtain permission of the Circuit Court of the County of Henrico for the said sewer to be located in and under New York avenue.

3. That the said agreement hereinbefore directed to be executed shall provide that the said Chas. F. Hudnall will comply with the ordinances of the City of Richmond, relating to the connection of the property of nonresidents with water mains, gas mains and sewers of the City of Richmond, and agreeing to have charged against his property and to pay the annual sum required to be paid under the ordinances of the Council of the City of Richmond granting such privileges to non-residents; and likewise agreeing to indemnify and save harmless the City of Richmond from any damage to persons or property, by reason of the construction, maintenance, management and control of the sewer hereby authorized to be constructed and maintained.

4. This ordinance shall be in force from its passage.

AN ORDINANCE

(Approved October 19, 1912).

To allow F. P. Loth, during the construction of his building at the northwest corner of Sixth and Main streets to close one-half of the sidewalk on Main street; the sidewalk on Sixth street and ten (10) feet of the roadbed of the street abutting said building, and the alley in the rear of said building.

Be it ordained by the Council of the City of Richmond-

1. That permission be, and the same is, hereby granted to F. P. Loth, to occupy and close to public use and travel, during the construction of his building, to be located at the northwest corner of Sixth and Main streets, one-half of the sidewalk on Main street; the sidewalk and ten (10) feet of the roadbed abutting said building on Sixth street and the alley in the rear of said building, and to use the parts of said streets and alley so authorized to be closed for the location and preparation of materials to be used in the construction of said building; provided, however, that said closing shall not continue more than six months from the approval of this ordinance.

2. That there shall be constructed over the portion of the sidewalk open to travel on Main street a covered way, and there shall also be constructed on Sixth street a fence ten (10) feet from the curb and parallel therewith to Main street, and connecting with the said covered walkway on Main street, as shown on a plan attached to the petition of the said F. P. Loth on file in the City Engineer's office.

3. The said permission is given subject to the condition that the said F. P. Loth will indemnify, reimburse and save harmless the City of Richmond from any and all charges, damages or costs that the City may suffer or be required to pay by reason of injury or damage to persons or property resulting directly or indirectly from the closing of the said streets and alley,

and from the presence, eixstence or preparation of material therein or thereon; and the closing and occupancy of the said streets and alley by the said Loth shall constitute an acceptance of this condition.

4. At the expiration of the permission hereby given, the said Loth shall remove all obstructions hereby temporarily authorized, and shall, at his own cost and charges, open to public use and travel the said sidewalk and street and place the same in a condition satisfactory to the City Engineer for public use and travel.

5. The Council of the City of Richmond hereby expressly reserves the power to amend or repeal this ordinance.

6. For any violation of this ordinance or failure to conform fully to the provisions thereof, or any amendment or repeal thereof, or any requirement made thereunder, the said Loth shall be liable to a fine of not less than five dollars nor more than fifty dollars, recoverable before the Police Justice of the City of Richmond, each day's failure to be a separate offence. 7. This ordinance shall be in force from its passage.

AN ORDINANCE

(Approved October 19, 1912).

To allow D. A. Blankenship with the consent of W. T. Hancock, to connect a sewer extending from his lot on the east side of 29th street between Main and Franklin streets, with a City sewer, located in the alley between 29th and 30th streets.

Be it ordained by the Council of the City of Richmond

1. That D. A. Blankenship, at his own cost and expense, in accordance with a plan to be furnished by the City Engineer, be, and he is, hereby authorized, after first obtaining the written consent of W. T. Hancock and filing the same in the office of the City Engineer, to construct and maintain a sewer from his lot located on the east side of 29th st.eet between Main and Franklin streets, across the rear of the lot of W. T. Hancock, and connect the said sewer with a sewer belonging to the City of Richmond located on an alley twelve (12) feet in width, extending from Main street in a northerly direction a distance of one hundred and sixty (160) feet to the southern line of the property of W. T. Hancock.

2. That the location, grade, and manner of construction of said sewer shall be satisfactory to the City Engineer.

3. That the said D. A. Blankenship shall indemnify and save harmless the City of Richmond from any and all claims to damages to persons or property by reason of the constuction or maintenance of the said sewer.

4. That the City of Richmond expressly reserves the right to amend or repeal this ordinance.

5. That for any failure to conform fully to the provisions of this ordinance the said D. A. Blankenship, or any subsequent owner of the said

property, shall be liable to a fine of not less than five nor more than one hundred dollars, recoverable before the Police Justice of the City of Richmond. 6. This ordinance shall be in force from its passage.

AN ORDINANCE

(Approved October 19, 1912).

Granting permission to the Export Leaf Tobacco Company to construct and maintain a tunnel under and across Lombardy street 304 feet south of Leigh street.

Be it ordained by the Council of the City of Richmond

1. That permission be, and the same is, hereby granted to the Export Leaf Tobacco Company, a corporation, to construct and maintain a tunnel under and across Lombardy street, south of Leigh street, connecting their buildings on the east and west sides of Lombardy street by means of said tunnel, to be constructed in accordance with a plan on file in the City Engineer's office, and to be approved by the said City Engineer, and also with such material as shall be satisfactory to said engineer.

2. That the said company, its successors and assigns, shall at all times keep said tunnel and all of the construction in connection therewith in good repair and condition satisfactory to the City Engineer.

3. The said company, its successors and assigns shall, as long as this ordinance remains in force pay to the City of Richmond the rate fixed by the ordinance allowing the construction of areaways or vaults in sidewalks or alleys.

4. The permission hereby granted shall at all times be subject to amendment or revocation by the City Council, and upon a revocation or amendment of said permission the said company, its successors or assigns, shall immediately conform to such amendment or revocation.

5. That the said company, its successors or assigns, shall indemnify, reimburse and save harmless the City of Richmond from any and all charges, damages and costs that the City may be required to pay by reason of any person being injured or damaged in any way in property or person by the construction, existence or maintenance of the said tunnel, and shall pay to the City of Richmond any costs incurred by it in order to restore the street to proper repair, should the existence or maintenance of the said tunnel cause any defect therein.

6. For a failure to conform fully to the provisions of this ordinance or any amendment or revocation thereof or any requirement thereof the said company, its successors or assigns shall be liable to a fine of not less than ten dollars nor more than fifty dollars, recoverable before the Police Justice of the City of Richmond, each day's violation to constitute a separate offence. 7. This ordinance shall be in force from its passage.

AN ORDINANCE

(Approved October 19, 1912).

To require unpaid salaries and wages to be deposited in the City Treasury.

Be it ordained by the Council of the City of Richmond

1. From and after the passage of this ordinance the officer or paymaster of every department of the City holding any unpaid wages or salaries drawn on the payroll or other account of said department, and which remains uncalled for two months shall, upon the expiration of said period, pay into the City Treasury to the credit of an account known as the Suspense Account of said department all sums remaining unpaid, depositing with the Auditor at the time a list of those entitled to such unpaid wages. The sums so deposited or any portion of same shall be paid by the Auditor to the party entitled to receive said amount upon a proper certificate from the officer or paymaster of the department to which the service was rendered. 2. This ordinance shall be in force from its passage.

AN ORDINANCE

To permit Dr. R. Angus Nichols, whose several properties are situated beyond the City limits, on the north side of Bacon street, between Oak street and Brook avenue, to use City water at his several properties, and prescribing the conditions on which the same may be used.

Be it ordained by the Council of the City of Richmond

1. That Dr. R. Angus Nichols, whose several properties are situated beyond the City limits, on the north side of Bacon street between Oak street and Brook avenue, in Henrico county be, and he is, hereby permitted to use City water for the supply of his several properties, to be subject to the conditions and penalties hereinafter provided:

(1) That the supply of water to be delivered shall be through a twoinch main and connections through a meter or meters to be located in front of each of the several properties on Bacon street between Oak street and Brook avenue, the two-inch main to be connected with the four-inch main in Oak street at the intersection of Bacon street and running eastwardly from said connection along Bacon street for a distance of approximately two hundred and twenty-four (224) feet to a point opposite said several properties of Dr. R. Angus Nichols, where connections are to be made from said main with each of the said several properties of Dr. R. Angus Nichols, on the north side of Bacon street between Oak street and Brook avenue.

(2) That the said main and the meter, or meters, (if more than one meter is deemed necessary by the Superintendent of the City Water Works
