Acquisition of Land Commencing on West Side of Semmes Street.

Approved November 18, 1912.

Be it resolved by the Council of the City of Richmond, the Board of Aldermen concurring, That the City Attorney be, and is hereby, directed to acquire by gift, purchase, condemnation or otherwise a strip of land on the west side of Seventh street beginning at the northern line of Semmes street and extending along the west side of Seventh street for a distance of 137 feet, having a depth of 20 feet at its southern extremity on Semmes street and 28.75 feet at its northern extremity, as shown on, and in accordance with, the blue print plan attached to the draft of this resolution, a plan of which is on file in the office of the City Engineer, dated June 27, 1912, made by D. F. LaPrade, Assistant Engineer, and marked 35 G-6 (c). But before any concluded action is taken the City Attorney is to report the cost or costs at which said land can be acquired to the Committee on Finance.

Hull Street-Acquisition of Land.

Approved November 18, 1912.

Be it resolved by the Council of the City of Richmond, the Board of Aldermen concurring, That the City Attorney be, and is hereby, directed to acquire by gift, purchase, condemnation or otherwise 23 feet of land and all necessary rights, privileges and easements on the south side of Hull street in South Richmond from the eastern boundary of the right-of-way of the Atlantic Coast Line Railway, westward across said right-of-way, and to the western boundary line of the lot of land owned by the said A. C. L. Railway and adjoining its right-of-way on the west, in order to widen Hull street in accordance with the blue print plan accompanying this resolution, a plan of which is on file in the office of the City Engineer, the said 23 feet to be acquired from the front of the said lot of land in fee simple, but before any concluded action is taken, he shall report the cost or costs at which the said land and rights, privileges and easements can be acquired to the Committee on Finance.

Alley-Grade of Alley.

Approved December 13, 1912.

Be it resolved by the Council of the City of Richmond, the Board of Aldermen concurring, That the profile showing the grade of alley, between Cherry and Linden, Beverly and Cumberland streets (herewith accompanying) as approved by the City Engineer and Committee on Streets be, and the same is hereby adopted as the true grade of said alley.

St. Andrew's Association-Dedication of land for public alley-Closing strip of land by the City.

Approved December 13, 1912.

Be it resolved by the Council of the City of Richmond, the Board of Aldermen concurring, That upon the execution and recordation in the Clerk's office of the Chancery Court of the City of Richmond by the Saint Andrews Association, a corporation, of a deed satisfactory to the City Attorney dedicating as and for a public alley a strip of land 15 feet 3 inches in width, the exact metes and bounds of which appear enclosed within red lines on a "Plat showing location of Arent's Free Library on the west side of Cherry street between Cumberland and Beverly streets, Richmond, Virginia," dated November 5, 1912, made by T. Crawford Redd & Bro., Surveyors and Engineers, a blue print copy of which is attached to the draft of this resolution, the said association shall be and is hereby authorized to close to public use and travel a strip of land in the rear of its property four (4) feet, nine (9) inches in width, shown on said plat, it being understood and agreed that the said alley extending from Beverly street to Cumberland street, between Cherry and Linden streets shall remain of a uniform width of fifteen (15) feet, three (3) inches.

Church Hill Tunnel-Agreement between the City and the Chesapeake & Ohio Railway Co.

Approved December 13, 1912.

Be it resolved by the Council of the City of Richmond, the Board of Aldermen concurring:

1. That the Mayor of the City of Richmond be, and he is hereby authorized and directed, on behalf of the City of Richmond, when the same has been approved by the City Attorney, to enter into a written contract with the Chesapeake & Ohio Railway Company, a corporation, providing for the extension of the eastern end of the Church Hill tunnel one hundred and twenty-five (125) feet eastwardly from its present eastern portal, upon the following terms and conditions:

(1) That the City of Richmond will take down the present stone portal at the eastern end of said tunnel and rebuild it at the new eastern end of said tunnel.

(2) That the City of Richmond will do all work, at its own cost and expense, necessary to the construction of said extension of said tunnel, in accordance with the plans and specifications approved by the Chief Engineer of the Chesapeake and Ohio Railway Company, which plans and specifications are to be attached to and made a part of the contract, and that the City of Richmond in the prosecution of the work upon said extension, will not interfere with traffic through the same.

(3) That the City of Richmond will, at all times, at its own expense, maintain said extension of said tunnel in such a way as not to interfere with the Chesapeake and Ohio Railway Company in the use of its tracks through such portion of said tunnel.

That if at any time during the construction of said extension or afterwards, from any cause, traffic may be impeded upon said extended portion of said tunnel the said City of Richmond will indemnify and save harmless the Chesapeake and Ohio Railway Company from any and all claims that maye be made because of such interruption of said tracks; and in the event that the Chesapeake and Ohio Railway Company is put to any expense because of any interruption of traffic during the building of said extension of said tunnel, or afterwards, then, and in that event, the City of Richmond will indemnify and save harmless the Chesapeake and Ohio Railway Company from all such claims, costs and expenses.

(4) That the City of Richmond will indemnify and save harmless the Chesapeake and Ohio Railway Company from any damages, costs, or charges which it may have to pay in consequence of any injury that may happen to persons or property during the construction of said extension of said tunnel, or which may occur to persons or property after the same is constructed because of any settling, cracking or other failure of said extended portion of said tunnel.

2. That upon the execution of said contract by the Mayor, the Treasurer of the City is hereby authorized to affix the seal of the city thereto and acknowledge the same.

3. That upon the execution of the said contract the City Attorney is hereby directed to have the same recorded in the Clerk's office of the Chancery Court of the City of Richmond.

Church Hill Tunnel

Approved December 13, 1912.

Be it resolved by the Council of the City of Richmond, the Board of Aldermen concurring, That the sum of four thousand six hundred dollars ($4,600.00) be and is hereby appropriated to credit of account “Extension of Church Hill tunnel," said amount to be paid upon warrants drawn by the Administrative Board,

Fire Department-Master Machinist.

Be it resolved by the Council of the City of Richmond, the Board of Aldermen concurring:

1. That, on recommendation of the Board of Fire Commissioners, sufficient funds be added to the Fire Department pay-roll account, so as to allow

the said Board of Fire Commissioners to increase the salary and compensation of the Master Machinist of the Fire Department from $105.00 per month to $125.00 per month.

2. The Committee on Finance is hereby instructed to provide the sum necessary for this purpose, which sum shall be available on warrants, properly drawn and approved by the Board of Fire Commissioners.

Green Street-Land to Widen.

Approved December 13, 1912.

Be it resolved by the Council of the City of Richmond, the Board of aldermen concurring, That the City Attorney be, and he is hereby authorized to acquire by gift, purchase, condemnation or otherwise sufficient land to widen Green street, in accordance with blue print accompanying the draft of this resolution, plan of which is on file in the office of the City Engineer, but before any concluded action is taken he is to report the cost or costs at which said land can be acquired to the Committee on Finance and by them approved.

Salaries and Wages-City Officers and Employees.

Approved December 13, 1912.

Be it resolved by the Council of the City of Richmond, the Board of Aldermen concurring, That the Auditor of the City be, and he is hereby instructed to pay the salaries and wages of the officers and employees of the City, for account of the year 1913, in accordance with the ordinances and resolutions of the City, out of any funds to the credit of the General Fund, until such time as the annual appropriations for the year 1913 are available, and to charge said amounts to the proper account

Kensington Avenue-Acquisition of land to Widen-Resolution Repealed. Approved December 13, 1912.

Be it resolved by the Council of the City of Richmond, the Board of Aldermen concurring, That the resolution approved June 12, 1912, directing the City Attorney to acquire sufficient land to widen Kensington avenue between Cleveland and Tilden streets be and the same is hereby repealed, and the City Attorney is directed to dismiss the condemnation proceedings pending in the Hustings Court of the City of Richmond, having for its object acquiring of land necessary for that purpose and the Auditor of the

City of Richmond be, and he is hereby authorized and directed, out of any money in the treasury not otherwise appropriated, to pay the costs accrued in said proceedings when the same shall be certified to him for payment by the Hustings Court of the City of Richmond.

Armory-First Virginia Regiment.

Approved December 28, 1912.

Be it resolved by the Council of the City of Richmond, the Board of Aldermen concurring, That the award of contract made by the Committee on Grounds and Buildings at its meeting held on the 29th day of November, 1912, to Wise Granite Company and Richmond Engineering Company for the construction of the First Regiment Armory building of fireproof construction throughout in accordance with the plans of Carneal & Johnston adopted by joint resolution approved June 14, 1912, at the price of $124,468.00 and architects fees according to specifications on file in the Building Inspectors office be, and the same is hereby approved, and the said Committee is hereby directed to enter into a written contract with the said Wise Granite Company, Richmond Engineering Company and Carneal & Johnston for doing of said work, and the Committee on Finance is hereby instructed to provide, when necessary, sufficient additional funds to cover cost of said fire proof armory building not exceeding in the aggregate $131,147,64, which sum shall cover all costs of every character in connection with the construction of said Armory building.

Alley-Land to Open and Extend.

Approved December 28, 1912.

Be it resolved by the Council of the City of Richmond, the Board of Aldermen concurring, That the City Attorney be, and he is hereby authorized to acquire by gift, purchase, condemnation or otherwise, sufficient land to open and extend the alley extending westwardly from Mosby street, between Jefferson Park and Pleasants street, in accordance with the blue print plan attached to the draft of this resolution, plan of which is on file in the City Engineer's office, but before any concluded action is taken he is to report the cost or costs at which said land can be acquired to the Committee on Finance and be by them approved.
