to pay the cost of commission appointed by the Hustings Court of the City of Richmond to ascertain value of property required for the purpose of widening Dock and Fifteenth streets, as authorized by joint resolution approved May 6, 1913, and to dismiss such proceedings as to said streets, but nothing herein shall be construed to apply to the proceedings under said resolution looking to the widening of Fourteenth street.

Dock-Richmond Dock-City Attorney Authorized and Directed to take such steps as are necessary to prevent the closing or other interference with the Dock.

Whereas that part of the Richmond Dock lying between 14th and 17th streets was constructed by the Richmond Dock Company, a corporation created by an Act of the General Assembly of Virginia, approved February 19, 1816, which act provided that all of the canals, basins and works to be erected by virtue of the Act, when completed shall forever thereafter be esteemed and taken as public highways free for the transportation of goods, wares, commodities or produce whatsoever by paying the tolls imposed by the said Act; and

Whereas the City of Richmond made large contribution towards the construction of said Dock upon the condition that the foregoing requirements should be complied with; and

Whereas, the State Corporation Commission has twice decided that the Richmond Dock is a public water highway, and as such a work of internal improvement and public utility, under their control and management, and that the persons now owning the said Dock property are under the jurisdiction of said Commission and are subject to the laws of the State governing transportation companies, canal companies, works of internal improvement and works of public service, as well as because they are persons owning and occupying a public highway and in a manner not permitted to the general public,

Therefore, be it resolved by the Council of the City of Richmond, the Board of Aldermen concurring, That the City Attorney be, and he is hereby authorized and directed, upon an effort being made by the present owners of the Dock between 14th and 17th streets, to obstruct or close the same as a public water highway for transportation, to institute the necessary legal proceedings before the State Corporation Commission or before the courts of this Commonwealth to prevent the closing or other interference with or obstruction of the said Dock between the points aforesaid.

Mayo's Bridge-Widening approaches to the Bridge-Land to be
acquired of the Virginia Railway and Power Company.

Be it resolved by the Council of the City of Richmond, the Board of Aldermen concurring;

1. That the City Attorney be, and he is hereby authorized and directed to acquire by deed satisfactory to him, from the Virginia Railway & Power Company, a corporation, upon the terms and conditions hereinafter stated, the following pieces of real estate, for the widening of the approaches to Mayo Bridge on the south side of James River:

(1) Lot "A."

"All that portion or parcel of land lying in South Richmond on the west side of Hull street between Canal street and Mayo Bridge, beginning at the southeast corner of brick building now owned and occupied by Standard Paper & Mfg. Co. (on land of Va. Ry. & Power Co., with a perpetual lease) and running N. 36° 00′ E for a distance of 68 feet to its intersection with stone retaining wall, thence along inner edge of said stone wall S. 30° 00′ W. for a distance of 67.65 feet to an angle in said wall, said point being 21.5 feet west of centre line of Hull street projected and 12.25 north of north line of Canal street projected; thence along inner edge of said wall 6 feet 10 inches to the point of beginning; said parcel of land being a triangular lot containing 231.54 sq. feet, more or less, being a portion of land now owned by Virginia Railway & Power Company and used as basement area between the building of Standard Paper Mfg. Co., and stone retaining wall, as will appear by of beginning; said parcel of land containing 2,598 sq. feet, more or less, reference to plan on file in office of the City Engineer, designated "Map of Southern Approach Mayo Free Bridge," dated September 22, 1913, under file 34-E-2,"

(2) Lot "B."

"All that portion or parcel of land lying in South Richmond on the east side of Hull street between an open roadway 50 feet wide along or near the north bank of the Canal and Mayo Bridge, beginning at a point 10 feet south of the face of south abutment of newly constructed Mayo Bridge and 11.5 feet east of the centre line of said bridge and running S. 69° 00′ E. or 10 feet from and parallel with said abutment face, for a distance of 20.5 feet, thence southeastwardly on a line 32 feet from and parallel to center line of Mayo Bridge projected, for a distance of 109.5 feet, to its intersection with north line of 50 foot open roadway, thence fronting and running along the north line of said roadway a distance of 24,5 feet, thence lv. 21° 30′ E, along the east side of old stone retaining wall for a distance of 101.75 feet, to its intersection with back line of old bridge abutment, thence southeastwardly along back line of old abutment for a distance of 3 feet; thence northeastwardly along edge of old abutment for a distance of seven (7) feet to point of beginning; said parcel of land containing 2,598 sq. feet, more or less, being a portion of land now owned by Va. Ry. & Power Co., as will appear by reference to a plan on file in office of City Engineer designated “Map of Southern Approach, Mayo Bridge," dated September 22, 1913, under file 34-E-2," the consideration for said conveyance to be two thousand four

hundred and fifty dollars ($2,450.00) which conveyance shall provide that in the construction of the proposed retaining wall on lot "A" above described area ways shall be provided as shown on a plan by the Resident Engineer of Mayo Bridge, filed in the office of the City Engineer as file 61-C-2, dated July 1913; and that the City of Richmond shall construct and maintain on and along the eastern side of lot "B" a retaining wall of sufficient height and strength to retain the filling necessary in order to complete the approach to Mayo Bridge; and provided further that the said Virginia Railway and Power Company shall waive for itself and its successors in ownership all claim to damages caused by the grading of the street from the said approach to Canal street in order to perfect the approach to the said bridge.

2. That the sum of two thousand four hundred and fifty dollars ($2,450.00) be, and the sanre is hereby appropriated to be placed to the credit of an account to be known as "Southern Approach to Mayo Bridge," and upon the execution and delivery to the Auditor of the City of Richmond of the deed hereinbefore provided for he is hereby authorized and directed to draw his warrant in favor of the said Virginia Railway and Power Company for the said sum of twenty-four hundred and fifty dollars ($2,450.00) and forthwith record the said deed in the Clerk's office of the Hustings Court of the City of Richmond, Part II.

Preston Street-Land to Open-Resolution repealing Resolution to
acquire land to open.

Be it resolved by the Council of the City of Richmond, the Board of Aldermen concurring:

1. That the City Attorney be, and he is hereby authorized to dismiss condemnation proceedings for the opening of Preston street, from Fifth to Sixth streets, and to pay the cost in such proceedings not exceeding $36.50, and charge same to account opening and widening streets.

2. That the resolution approved May 17, 1913, directing the City Attorney to acquire land to open Preston street, be and is hereby repealed.

Alley-Land to Open,

Approved November 14, 1913.

Be ite resolved by the Council of the City of Richmond, the Board of Aldermen concurring, That the City Attorney be, and he is hereby directed to acquire by purchace, 30 foot lot standing in the name of N. D. Wilkinson, on the west side of Harvie street between Grove and Park avenues at the price of three thousand dollars ($3,000.00) as recommended by the Commissioners appointed by the Hustings Court of the City of Richmond, under a resolution approved May 6, 1913, for the purpose of opening alley between

Grove and Park avenues, Harvie and Plum streets as shown on a blue print copy of plan accompanying this resolution and he is further directed to pay the cost and dismiss the proceedings instituted under the resolution approved May 6, 1913, and charge all costs to account, "Opening and Widening Streets;" provided Mrs, Alice H. Wallen will purchase from the City of Richmond the extra 10 feet not required for opening of said alley at a price of $650.00, which sum when paid shall be credited by the Auditor to account, "Opening and Widening streets," to apply on above costs.

Cleveland Street—Land to Open—Resolution to Acquire land to
Open Cleveland Street.

Be it resolved by the Council of the City of Richmond, the Board of Aldermen concurring, That the City Attorney be, and he is hereby authorized to dismiss proceedings for the opening of Cleveland street, from Grove avenue to Kensington street, and that the resolution approved June 18, 1913, directing the City Attorney to acquire land to open Cleveland street, be and is hereby repealed.

Alley-Land to Open.

Approved December 16, 1913.

Be it resolved by the Council of the City of Richmond, the Board of Aldermen concurring, That the City Attorney be, and he is hereby authorized and directed to acquire by gift, purchase, condemnation or otherwise sufficient land to open an alley 18 feet in width extending from 14th to 15th street between Hull and Decatur streets in South Richmond in accordance with a plan on file in the City Engineer's office marked 103-G-6, a blue print copy of which is attached to the draft of this resolution; but no concluded action is to be taken in the premises until the price at which said land can be acquired shall have been ascertained and reported to the Committee on Finance and by them reported to the Council, and final action shall be taken by the Council directing that the said property be acquired for the purpose aforesaid.

Grove Avenue-Grade.

Be it resolved by the Council of the City of Richmond, the Board of Aldermen concurring, That the profile of the grade of Grove avenue from

Crenshaw avenue to the Western City Limits, as recommended by the City Engineer and Committee on Streets, according to plan on file in the office of the City Engineer, a blue print copy of which is attached to the draft of this resolution, be, and the same is hereby, adopted as the true grade of said

Be it resolved by the Council of the City of Richmond, the Board of Aldermen concurring, That the profile of the grade of Ross street from Governor street to Fourteenth street, as recommended by the City Engineer and Committee on Streets, in accordance with the plan on file in the office of the City Engineer, dated December 1, 1913, a blue print copy of which is attached to the draft of this resolution, be, and the same is hereby adopted as the true grade of said street.

Alley-Grade.

Be it resolved by the Council of the City of Richmond, the Board of Aldermen concurring, That the profile of the grade of the alley from Oak street to Harrison street between Leigh and Moore streets, as recommended by the City Engineer and Committee on Streets, in accordance with the plan on file in the office of the City Engineer, dated December 1, 1913, a blue print copy of which is attached to the draft of this resolution, be, and the same is hereby adopted as the true grade of said alley.

Taxes-Maurice Estate.
