AN ORDINANCE

(Approved August 20, 1914).

To permit the Town of North Richmond, whose property is situated beyond the City limits in Henrico County, bounded on the east by Chamberlayne avenue, on the north by Ladies Mile Road, on the west by Henrico Turnipike, and on the south by Rogers street, to use City water at their property and prescribing the conditions on which the same may be used.

Be it ordained by the Council of the City of Richmond

1. That the Town of North Richmond, whose property is situated beyond the City limits in Henrico County be, and they are, hereby permitted to use City water on their property, to be subject to the conditions and penalties hereinafter provided:

(1) That the supply of water to be delivered shall be through a six-inch main and connections through a meter or meters, to be located at a point to be designated by the Superintendent of the City Water Works, the six-inch main to be connected with the main in Howard street, near Hermitage Road, through a regulating valve, and extending eastwardly from said connection of Howard street from the termination of the six-inch pipe to Brook Road, thence along the dedicated right-of-way to Seminary avenue, thence across Lombardy street and along Stuart Road to Chamberlayne avenue, a distance of approximately three thousand five hundred (3,500) feet, where connections are to be made from said main with the said property into the Town of North Richmond. All mains laid in the Town of North Richmond from the terminus of the six-inch main in Chamberlayne avenue shall be of such size as approved by the Superintendent of the City Water Works.

(2) That the main and the meter or meters (if more than one meter is deemed necessary by the Superintendent of the City Water Works) and all material and fixtures shall be of such style, make and kind as the Superintendent of the City Water Works and the Administrative Board shall approve, and that the extension in all of its parts shall be constructed under the supervision of the said Superintendent, from the said connection with the main in Howard street near the Hermitage Road above mentioned, to connection with the property of the Town of North Richmond.

(3) That the cost of the whole work, including the main and connections, meter or meters, fixtures, construction and appurtenances shall be paid for by the said Town of North Richmond.

(4) That the City of Richmond shall have the right at any and all times to make connections with the said main at any point or points outside the City limits for the purpose of furnishing water to other persons or property. And, until all of said main or mains shall become the property of the City of Richmond, as hereinafter provided in Clause 10, any person owning or occupying property located beyond the City limits to whom the City of Richmond may grant the privilege of using City Water on such property, shall have the right to make connections with said main or mains at any point or points

without the City limits, upon making such compensation to said Town of North Richmond as may be agreed upon between such personos and said Town of North Richmond, and, if said parties cannot agree upon said compensation, then it shall be fixed by the Superintendent of the City Water Works.

(5) That before said work shall be commenced, the said Town of North Richmond shall obtain and deliver to said Superintendent, written authority from the Board of Supervisors of Henrico County, approved by the Circuit Court of the said County, permitting the City of Richmond to occupy the necessary streets, roads, etc, for the purpose of laying said mains, and to uncover said mains at any and all times for the purpose of repairing and controlling the same. And that the said Town of North Richmond shall submit a plan showing the exact location of said main extended to their property, as above described

(6) That said Superintendent and the employees of the Water Department under his direction shall at all times have full and unrestricted access to said mains, pipes meter or meters and fixtures.

(7) That the said Town of North Richmond shall have the benefit of, and be governed by, all the rules, conditions, penalties and rates prescribed by the City ordinances pertaining to water takers of the City of Richmond, except that the rate for all water used or wasted shall be payable at non-resident rates

(8) That the City of Richmond reserves the right to discontinue furnishing water to the said Town of North Richmond and all other persons beyond the City limits at any time, when in the opinion of the Superintendent of the City Water Works and the Administrative Board, said water so furnished shall be needed for the purpose of supplying the water takers of the City of Richmond, or for other demands within the said City, or when the said Town of North Richmond, or any other person beyond the City limits using water from said main or mains, neglects to observe or violates the contract, or ordinances governing the supply of water.

(9) That before the work hereinbefore authorized shall be commenced the said Town of North Richmond shall execute a contract approved by the City Attorney and the Superintendent of the City Water Works, accepting the provisions of this ordinance, and shall therein covenant to save harmless the City by reason of the careless or improper use or misuse by them of the privileges hereby granted, and to pay all damages to any person or to the property of any person occasioned by the construction or repair of the work hereby authorized, and to pay all damages to any person or to the property of any person occasioned by the leakage or breaking of the said water mains and its connections, or by reason of the negligent management of the same, so long as the same or any part thereof, is outside of the corporate limits of the City of Richmond.

(10) That should all, or any portion of the territory now without the City limits, in which the said main, or any part of them, hereinbefore authorized to be constructed shall be located, be hereafter taken into the City then the said mains or so much thereof as shall located in the streets or alleys as laid down in the plan of annexation, or as actually used as streets or alleys shall become the absolute property of the City of Richmond without compensation to the said Town of North Richmond.

(11) That the said Town of North Richmond shall commence the use of water as soon as the construction of said work is completed, and that during the whole time of the use of said water under this ordinance the amount to be paid for water shall be at non-resident meter rates.

2. For any violation of any of the provisions of this ordinnance the Town of North Richmond, or any assignee or successors of said Town of North Richmond, shall be liable to a fine of not less than twenty-five dollars nor more than one hundred dollars to be recoverable in the Police Court of the City of Richmond from the party or parties violating such provisions, each day's violation to constitute a separate offense.

3. That the City of Richmond reserves the right at any time to amend or repeal this ordinance.

4. This ordinance shall be in force from its passage.

AN ORDINANCE

(Approved August 20, 1914).

To grant permission to Wilmer, Vincent and Wells to construct and maintain a metal sign lighted by electricity on the roof of the Colonial Theatre, situated on the northwest corner of Eighth and Broad streets.

Be it ordained by the Council of the City of Richmond

1. That permission be, and the same is hereby, granted to Wilmer, Vincent and Wells to construct a metal sign of open frame work, to be lighted by electricity, on the roof of the Colonial Theatre, situated on the northwest corner of Eighth and Broad streets; provided, however, that the said sign shall be safely secured by angle iron and braces and set not more than twelve (12) feet above the roof line and the width or length of said sign shall not exceed fifty (50) feet, and the height of said sign shall not exceed twentytwo (22) feet, nor shall the said sign extend beyond the property line of the said building to any extent whatsoever.

2. The said sign shall be securely fastened to the said building and shall be constructed out of material and in such a manner and according to such a design as shall be first approved in writing by the Building Inspector of the City of Richmond.

3. The said Wilmer, Vincent and Wells shall at all times keep the said sign in proper repair, and shall make such repairs as the Administrative Board may at any time deem reasonable for public safety.

4. The permission given in this ordinance is subject to the condition that the said Wilmer, Vincent and Wells, and the owner of the building on which the said sign is placed, will indemnify, reimburse and save harmless the City of Richmond for any charges, damages or costs that the City may be required to pay by reason of any person being injured or damaged in any way in property or person by the construction, existence and maintenance of said sign.

5. The Council of the City of Richmond hereby reserves the right at any time to amend or revoke the privilege hereby granted.

6. Any person violating the provisions of this ordinance shall be liable to a fine of not less than ten nor more than fifty dollars for each offense, recoverable before the Police Justice of the City of Richmond, each day's continuance of such violation to be a separate offense.

7. This ordinance shall be in force from its passage.
