Mr. Love moved that the committee on penal institutions be discharged from the consideration of Senate bill (No. 190, Int. No. 190) entitled "An act to amend the Prison Law, in relation to the disposition of children born in prison," and that said bill be amended, reprinted and recommitted to the committee on penal institutions.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Westall moved that the committee on internal affairs of towns, counties and public highways be discharged from the consideration of Senate bill (No. 1541, Int. No. 1353) entitled "An act in relation to the government of Westchester county and providing a form of government for said county in conformity with section twenty-six of article three of the Constitution," and that said bill be amended, reprinted and recommitted to the committee on internal affairs of towns, counties and public highways.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Fearon moved that the committee on the judiciary be discharged from the consideration of Senate bill (No. 1511, Int. No. 1343) entitled "An act to amend the Election Law, in relation to extending the period for personal registration," and that said bili be amended, reprinted and recommitted to the committee on the judiciary.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Brown moved that the committee on public service be discharged from the consideration of Senate bill (No. 1037, Int. No. 934) "An act to amend the Public Service Commission Law, in relation to the powers and duties of the board of transportation, and that said bill be amended, reprinted and recommitted to the committee on public service.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Campbell moved that the committee on taxation and retrenchment be discharged from the consideration of Senate bill (No. 1262, Int. No. 1142) entitled "An act to amend the Tax Law, in relation to the franchise tax on foreign corporations," and that said bill be amended, reprinted and recommitted to the committee on taxation and retrenchment.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Truman moved that the committee on finance be discharged from the consideration of Senate bill (No. 427, Int. No. 407) entitled "An act to amend the labor law, in relation to salaries and

grades of inspectors, and making an appropriation therefor," and that said bill be amended, reprinted and recommitted to the committee on finance.

The President put the question whether the Senate would agree to said motion, and it was decided in the affirmative.

Mr. Thompson offered the following:

Resolved (if the Assembly), That a respectful message be sent to the Governor, requesting the return to the Senate of the Senate bill (No. 992, Int. No. 895) entitled "An act to amend the Tax Law, in relation to compensation of surrogates in certain counties," for the purpose of amendment.

The President put the question whether the Senate would agree to said resolution, and it was decided in the affirmative.

Ordered, That the Clerk deliver said resolution to the Assembly and request its concurrence therein.

The Assembly returned the above resolution with a message that it has concurred in the passage of the same.

Ordered, That the Clerk deliver said resolution to the Governor. Mr. Mastick offered a resolution, in the words following:

Resolved (if the Assembly concur), That four thousand (4,000) copies of the report of the Special Joint Committee on Taxation. and Retrenchment, dealing with tax exemption, be printed as a legislative document for use of the Committee at an expense not to exceed thirteen hundred and fifty dollars ($1350).

Ordered, That said resolution be referred to the committee on finance.

Mr. M. J. Kennedy gave notice that at some future time he mill move to suspend Senate Rules numbered 1, 4, 8, 9, 11, 14, 18, 19, 22, 30, and 43, for the purpose of reading, passing and trans mitting to the Assembly out of its regular order the Senate bill (No. 317, Int. No. 310) entitled "An act to amend section eleven hundred and forty-one of the Penal Law, relating to prosecutions for the sale and circulation of obscene literature."

Mr. Downing gave notice that at some future time he will move to suspend Senate Rules numbered 1, 4, 8, 9, 11, 14, 18, 19, 22, 30, and 43, for the purpose of reading, passing and transmitting to the Assembly out of its regular order the Senate bill (No. 166, Int. No. 166) entitled "Concurrent resolution of the Senate and Assembly proposing an amendment to section one of article four of the Constitution, in relation to the term of office of the Governor."

Also, Senate bill (No. 932, Int. No. 848) entitled "An act authorizing the sale of certain lands owned by the State located at Kingston, Newburgh, Poughkeepsie and Yonkers heretofore acquired by the State for Barge canal terminals and authorizing the purchase and sale thereof by such cities and the issuance of city obligations."

Also, Senate bill (No. 933, Int. No. 849) entitled "An act to amend an act, entitled 'An act making provision for issuing bonds to the amount of not to exceed nineteen million, eight hundred

thousand dollars for the purpose of furnishing proper terminals and facilities for Barge canal traffic, including the acquisition and interchange of property thereof, with a view to improving and fostering the commerce of the State, and providing for the submission of the same to the people to be voted upon at the general election to be held in the year nineteen hundred and eleven,' in relation to the sale by the State of such terminals and lands acquired therefor when found to be unnecessary for terminal purposes."

Also, Senate bill (No. 847, Int. No. 778) entitled "An act to amend the City Home Rule Law, in relation to the power of cities to adopt and amend local laws."

Also, Senate bill (No. 837, Int. No. 769) entitled "An act to amend the Public Service Commission Law, in relation to change. of rates of fare in contracts or franchises entered into or granted by a municipality."

Also, Senate bill (No. 163, Int. No. 163) entitled "An act to amend the Election Law, in relation to restoring direct nominations of party candidates for State-wide offices and the office of justice of the Supreme Court."

Also, Senate bill (No. 838, Int. No. 770) entitled "An act to amend the Public Service Commission Law, in relation to the powers and duties of the board of transportation."

Also, Senate bill (No. 164, Int. No. 164) entitled "An act to amend the Election Law, in relation to statements of campaign receipts, expenditures and contributions."

Also, Senate bill (No. 165, Int. No. 165) entitled "Concurrent resolution of the Senate and Assembly proposing an amendment to section twenty-six of article three of the Constitution, to enable the Legislature to provide forms of government for counties."

No. 267) entitled "An act to amend the Highway Law, in relation to providing for compensation for personal injuries or death resulting from the operation of motor vehicles and for securing the payment of such compensation, to require motor vehicle owners to be insured, and making an appropriation therefor."

Also, Senate bill (No. 836, Int. No. 768) entitled "An act to amend chapter four of the Laws of eighteen hundred and ninetyone, entitled 'An act to provide for rapid transit railways in cities of over one million inhabitants,' with reference to acquiring rapid transit railways. "

Also, Senate bill (No. 341, Int. No. 330) entitled "An act to amend the Workmen's Compensation Law, in relation to insurance carriers."

Also, Senate bill (No. 839, Int. No. 771) entitled "An act to amend the Public Service Commission Law, in relation to the powers and duties of the Board of Transportation, and the Transit Commission."

Also, Senate bill (No. 1423, Int. No. 1274) entitled "Concurrent resolution of the Senate and Assembly proposing an amendment to sections four and five of article three of the Constitution, in

relation to eliminating the State enumeration of inhabitants, and to enumerations and apportionment of Senators and Assemblymen."

Also, Senate bill (No. 1469, Int. No. 1301) entitled "An act to amend the Civil Service Law, in relation to civil service employees separated from the service by reason of the State Departments Law."

Also, Senate bill (No. 1504, Int. No. 1336) entitled "An act to amend the Workmen's Compensation Law, in relation to modification of award."

Also, Senate bill (No. 1505, Int. No. 1337) entitled "An act to amend the Workmen's Compensation Law, in relation to occupational diseases."

The Senate bill (No. 1527, Int. No. 1109) entitled "An act authorizing designated authorities in behalf of the State of New York to enter into an agreement or compact with designated authorities of the State of Vermont for the creation of the Lake Champlain bridge commission, the establishment of the Lake Champlain bridge commission and the defining of the powers and duties of such commission, and making an appropriation for such purposes, was read the third time.

The President put the question whether the Senate would agree to the final passage of said bill, the same having been printed and upon the desks of the members in its final form for three calendar legislative days, and it was decided in the affirmative, a majority of all the Senators elected voting in favor thereof, and three-fifths being present, as follows:

The Assembly bill (No. 1761, Rec. No. 310) entitled "An act providing for the construction of a bridge over the ravine of the Normanskill creek, from Delaware avenue, city of Albany, to county highway number seven in the town of Bethlehem, and apportioning the cost thereof between the State, the city of Albany and the county of Albany outside of the city," was read the third time.
