Wadsworth, situated in the town of Avon in the county of Livingston, and in the town of Ogden, county of Monroe, which have been contracted to be sold by John Gott or William Cushing, as the agent or attorney of the said William W. Wadsworth, since the first day of April, one thousand eight hundred and forty-six; but before any such conveyance shall be executed by said committee, the contract of sale executed by said Gott or by said Cushing, as the agent or attorney of said Wadsworth, shall be acknowledged or proved in the same manner as deeds of real estate, and be recorded in the county in which the lands described in the contract are situated.

§ 3. The said committee shall not execute any deed under join in deed. the power hereby conferred on him, unless the wife of the said William W. Wadsworth shall join with him in the execution of such conveyance.

§ 4. Before exercising the power conferred by this act, the said Daniel H. Fitzhugh shall execute and file in the office of the clerk of the county of Livingston a good and sufficient bond, in a penalty to be fixed, and with one or more sureties to be approved by a justice of the supreme court, conditioned for the faithful performance of his duty as committee, under the power herein granted to hin, and conditioned, also, that he shall invest the proceeds of such sales, and render true and exact accounts thereof, as shall be required by the supreme court.

Chap. 57.

AN ACT to amend an act entitled "An act to incorporate a gas light company in the village of Brooklyn," passed April 18, 1825, and to confirm the election of directors.

Passed March 12, 1850, "three-fifths being present.” The People of the State of New York, represented in Senate and Assembly, do enact as follows:

1. The first section of the act entitled "An act to incorporate a gas light company in the village of Brooklyn," passed April 18, 1825, is hereby amended by inserting after the word Provided, the following words: "That the value of

such real estate shall not exceed the sum of one hundred and fifty thousand dollars: and."

2. The election of directors of the Brooklyn Gas Light directors Company, on the first day of February, one thousand eight hundred and forty-seven, instead of the second Monday in January of that year, as directed by said act, and all subsequent elections and proceedings of the company since the said election in eighteen hundred and forty-seven, are hereby ratified and confirmed.

§3. The Brooklyn Gas Light Company shall, within Report of thirty days after the first day of May and November in every whom, and year, during the continuance of their charter, make returns under oath of the officers of said company to the common council of the city of Brooklyn, the quantity of gas consumed in said city, for the use of the city, for every six months previous to the first days of May and November in each year; and said company shall furnish to the said common council from time to time any information under oath as aforesaid, as the said common council may desire, and call for by resolution of their board.

§ 4. This act shall take effect immediately.

Chap. 58.

AN ACT to extend the time for the collection of taxes in the town of Poughkeepsie.

§ 1. If the collector of the town of Poughkeepsie in the Time excounty of Dutchess, shall, on or before the 16th day of 25th March. March instant, renew his security to the satisfaction of the supervisor of said town, and deliver to the treasurer of said county a certificate from said supervisor, of his approval of such security, and pay over to said treasurer the taxes collected by said collector prior to the date of the renewal of such security, then the time for his collecting and making final returns of taxes in said town is hereby extended to the 25th day of March inclusive instant.

§ 2. This act shall take effect immediately.

AN ACT to authorize the appointment of commissioners to open Division avenue, and establish the boundary line between the city of Brooklyn, village of Williamsburgh and towns of Bushwick and Flatbush.

Passed March 15, 1850, "three-fifths being present." The People of the State of New York, represented in Senate and Assembly, do enact as follows:

The said commissioners, before they enter upon their duties, shall take and subscribe an oath before a justice of the peace, that they will faithfully and impartially perform the duties which shall devolve upon them by virtue of their appointment; and immediately thereafter, shall fix upon a time when they will meet to And give ten view the premises, and hear the parties interested, and shall days notice give notice of the time and place of such meeting, by publication for ten days in the same papers in which notice of application for their appointment was published: they may adjourn from time to time, as may be necessary.

2. It shall be the duty of the said commissioners so apareuue, how pointed, and they are hereby authorized and empowered, to lay out, open and continue "Division avenue" from its present termination at its intersection with South Sixth street in the village of Williamsburgh, as near as they may deem proper and advisable on its present line (as far as the avenue is now laid out and used), and in as straight a line as may be consistent with the interest of property to be affected thereby, southerly to a point where it would intersect "Fulton avenue" if the same was extended and continued, or to the Jamaica turnpike, at the discretion of said commissioners. The said avenue, so to be laid out, shall be eighty feet in width. The said commissioners shall have

power to enter upon all such lands as they shall deem it necessary to enter upon for the purpose of executing the powers and duties conferred upon them by this act.

§7. otherwise made a good and level road, and shall apportion the expense thereof in the same manner as provided for the expenses of the opening; and the same shall be assessed, levied and collected in the next annual tax, after the same shall be certified to the said supervisors.

§ 9. All the commissioners mentioned in or appointed under this act shall each receive two dollars per day for each day necessarily spent in attending to the matters and business connected with said avenue; and a majority of said commissioners shall have power to act, and form a quorum for the transaction of business.

§ 10. The said county court shall have power, and the how filled. county judge is hereby authorized to appoint commissioners to fill any vacancy that may occur by death, resignation, or otherwise.

§ 11. The mayor of the city of Brooklyn, the president of the village of Williamsburgh, and the supervisor of the town of Bushwick, shall constitue a permanent board of commissioners, whose duty it shall be to cause said Division avenue, after it shall have been opened, graded, turnpiked, or otherwise made a good and level road as provided for in the eighth section of this act, to be kept in good repair; and they are hereby required to meet together on the first Wednesday in each of the months of March, May, July, September and November in each year, and examine the whole of said avenue, and direct and cause all repairs to be made and work to be done on the said avenue, which they or a majority of them shall deem necessary and proper for the preservation or protection of the same, and the making and keeping it in good order and repair. They shall apportion the expense thereof, including the pay of the commissioners, upon the city of Brooklyn, the village of Williamsburgh and the town of Bushwick, in proportion to the amount of lands belonging thereto, and fronting on said avenue; and the amount so apportioned shall be collected in the next annual tax, after the same shall be certified to the said supervisors by the said commissioners, or a majority of them.

§ 12. This act shall take effect immediately.
