place in the city of New York, as they or a majority of them shall direct, to re-open books to receive subscriptions to the said capital stock, after giving thirty days previous notice of the time and place of re-opening said books, in such newspapers in the city of New York as to them shall seem proper. And the said commissioners, or a majority of them, shall proceed in the distribution of said stock in the manner prescribed for the distribution of stocks in and by the act entitled "An act to provide for the construction of a railroad from Attica to Buffalo," passed May 3, 1836, and shall possess all the powers conferred upon the commissioners appointed in and by said act.

§ 3. This act shall take effect immediately.

Chap. 34.

AN ACT to enable the Kingston and Middletown Turnpike Road Company to sell their roadway rights, and other property.

Passed March 2, 1850.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

§ 1. The directors of the Kingston and Middletown Turnpike Road Company are hereby authorized, with the consent of a majority in amount of the stockholders in such company, to sell and convey all their lands, grants, improvements, materials, surveys, roadway and franchises, to the Ulster and Delaware Plank Road Company, for a sum to be agreed upon; and such conveyance shall vest such lands, improvements, materials, survey, roadway and franchises in the Ulster and Delaware Plank Road Company, as fully as though the same had been originally granted to, or acquired by, such last mentioned company, under and by virtue of the act entitled "An act to provide for the incorporation of companies to construct plank roads, and of companies to construct turnpike roads," passed May 7, 1847, and the acts amending the same.

§ 2. This act shall take effect imediately.

Chap. 35.

AN ACT to extend the time for the collection of taxes in the town of Scriba in the county Oswego, and all the towns of the county of Westchester.

Passed March 2, 1850.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

§ 1. If the collector of the town of Scriba in the county of Oswego, and the collectors of each and every town in the county of Westchester, shall give their securities to the satisfaction of the supervisor of their towns respectively, and pay over the moneys by them previously collected at the date of the renewal of their several bonds, the time for the collection and making final returns of taxes in the town of Scriba in the county of Oswego, and each of the towns in the county of Westchester, is hereby extended to the first day of April next.

§ 2. This act shall take effect immediately.

Chap. 36.

AN ACT authorizing certain commissioners to build a bridge across the Hoosic river.

Passed March 2, 1850.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

§ 1. The board of supervisors of the county of Rensselaer are hereby authorized and required to levy by tax, upon the taxable inhabitants and property of the towns of Scaghticoke and Pittstown, in the same manner as other town charges and expenses are levied and raised, the sum of fifteen hundred dollars, in two annual instalments, as follows: Three hundred and seventy-five dollars on each of said towns, at the annual meeting of the board of supervisors in 1850; and the like sum of three hundred and seventy-five dollars on each of said towns, at the annual meeting of the board of supervisors in 1851.

§ 2. Said moneys, when collected, shall be paid over to such one of the commissioners, hereafter appointed, as a

majority of the said commissioners shall designate, who shall be their treasurer; and the said moneys so raised shall be expended by the said commissioners in erecting a new bridge, or in repairing the old one, across the Hoosic river, between the towns of Scaghticoke and Pittstown, at the place commonly called and known as "The Valley."

§ 3. Isaac Tallmadge, Ira Gifford and Isaac Miller of Scaghticoke; Daniel Fish, Chauncey B. Slocum and John Commis P. Ball of Pittstown, are hereby appointed commissioners to superintend the rebuilding or repairing of said bridge, and expending the moneys hereby provided, in such manner as they may consider most expedient, and shall account to the board of supervisors of Rensselaer county, at its annual meeting next after said bridge is completed, for the moneys received by them under this act; and a majority of said commissioners shall, at all times, constitute a quorum for the transaction of Quorum. business, and any order signed by a majority of said commissioners shall be valid as an act of all of them.

§ 4. In case the commissioners shall deem it expedient to complete the said bridge in the year 1850, they are hereby May borrow authorized to borrow the sum of fifteen hundred dollars, directed by the first section of this act to be levied at the annual meeting of the board of supervisors, in the years 1850 and 1851, and the money so levied shall be appropriated by the treasurer of the commissioners to the payment of said loan; the interest of said money, so borrowed, shall be paid by the commissioners of highways of the towns of Scaghticoke and Pittstown, in equal proportions, and shall be audited and allowed them in their accounts, in the same manner as other moneys laid out by them.

§ 5. The commissioners herein before appointed, shall have power to designate and appoint one of their number as their trea- his bond. surer, who shall give security for the faithful discharge of his duties as such treasurer, in a bond to be approved by a majority of said commissioners, and whose duty it shall be to receive and disburse, under the direction of the commissioners, all moneys which may or shall come to his hands for the purpose contemplated by this act; but neither the said treasurer, or other commissioners, shall be entitled to any commissions, or other compensation, for their services.

§ 6. Chap. 37.

AN ACT establishing a fund for the benefit of the Stock-
bridge Indians.

Passed March 2, 1850, "by a two-third vote."

The People of the State of New York, represented in
Senate and Assembly, do enact as follows:

§ 1. The comptroller shall place to the credit of the
Stockbridge Indians, on the books of his office, the sum of
thirty thousand dollars, to remain in the treasury or be in-
vested in the name of the people, by or under the direction.

by the legislature.

§2. Six per cent per annum on said sum of thirty thouto be paid an- sand dollars shall be paid by the treasurer, on the warrant of the comptroller, annually, to the chief sachem and head men of said tribe or nation, or upon their order, or the order of a majority of them, to be by them expended in promoting the christian religion, general education, agriculture and the mechanic arts among their people, and in promoting the general welfare of their tribe or nation.

§ 3. Before any money shall be paid by this act (except as provided in the fifth section thereof), it shall be the duty of the chief and head men of said tribe or nation of Indians to cause to be filed in the office of the secretary of state of this state, a certificate duly acknowledged as hereinafter provided, setting forth the name of the chief sachem and of the head men of said tribe or nation; which certificate shall be filed annually immediately after their annual election, and shall be signed by the chief sachem and head men who shall be in office at the time said election shall be held.

§ 4. Such certificate, and the order mentioned in the be acknow. second section of this act, shall be duly acknowledged by the chief sachem and head men of said tribe or nation, or a majority of them, before some person legally authorized to take the acknowledgment of deeds to be recorded in this

The sum of two hundred and fifty dollars is hereby $250 to be appropriated to the agents of said Indians now in this city, agents. for the purpose of defraying their expenses in attending upon the legislature to procure the passage of this act; and the treasurer shall pay, on the warrant of the comptroller, the said sum of two hundred and fifty dollars to Austin E. Quinney and John W. Quinney, being such agents, out of any moneys in the treasury not otherwise appropriated.

§ 1. It shall be lawful for Charles S. Moores, George W. Trustees Webster, William Reed, J. Dryden Warren, and Peleg T. may sell Stafford, trustees of the village of Plattsburgh, or their successors in office, to sell or exchange, and to grant and convey by deed, the engine lot in the village of Plattsburgh in the county of Clinton, for the use and benefit of said village, in such manner as the said grantors shall provide in their deed of conveyance of the said premises.

§ 2. This act shall take effect immediately.
