§3. § 4. No superintendent of the poor shall hereafter be elected in the said county. At the annual meeting of the board of supervisors of the said county in the fall of eighteen hundred and fifty-two, and at each annual meeting of the said board thereafter, one superintendent of the poor shall be appointed by the said board, who shall hold his office for one year next after the thirty-first day of December following such appointment, and until a successor shall be appointed; and every superintendent of the poor appointed in pursuance of this act, shall exercise all the powers and discharge all the duties now by law exercised and discharged by the superintendents of the poor, except such powers and duties as are inconsistent with this act; and shall also be subject to the same liabilities and penalties that superintendents of the poor are now by law subject to.

§ 6. Whenever a vacancy shall occur in the office of superintendent of the poor of said county, the county judge, how filled. county clerk, and county treasurer shall appoint some person to fill such vacancy, who shall hold his office during the remainder of the term, and shall, before entering upon his duties, give a bond, such as is now required by law of superintendents of the poor, except that it shall be approved by the county judge, county clerk, and county treasurer. Said bond, with the approval aforesaid endorsed thereon, shall be filed in the office of the county clerk.

Contracts for § 12. The board of supervisors of said county shall have and medical exclusive power to make contracts with physicians and surgeons to furnish medicines and medical and surgical services for the poor at the poor-house, and in such towns as they may deem it advisable; and when a contract is so made in any town with any physician or surgeon, the supervisor of said town shall employ no other physician or surgeon to attend the poor in said town, except in case of the absence, inability or refusal to perform, of the physician or surgeon having the contract. If the said board fail to make the contracts aforesaid or any of them at any regular meeting, then the said contracts or any of them may be made at any other time, in such manner and on such terms as said board may direct.

§ 13. All statutes in any way conflicting with the provisions of this act are and shall be inoperative and ineffectual within the said county.

§ 14. This act shall take effect from and after the fourth day of March, eighteen hundred and fifty.

Chap. 30.

AN ACT relative to the trustees of Alfred Academy.

Passed March 2, 1850.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

§ 1. The several elections of trustees of the Alfred clared valid. Academy, in the county of Allegany, heretofore made by the stockholders in said academy, under the by-laws thereof, are hereby confirmed and made valid in like manner as if the said several elections had, at the time of holding the same, been authorised by law; and the present board of trustees, acting as such under elections so held, is declared to be the legal board of trustees of the said academy; and all the acts of the said several boards of trustees, so elected

in manner aforesaid, are hereby confirmed and made as valid as though they had been legally elected; and all conveyances grants and conveyances heretofore made to the trustees, or to any of them, or to any person or persons, for the use or benefit of said academy, shall be deemed and taken to have vested the property so granted or conveyed in the said academy, in its corporate capacity, at the time of the making of any such grant or conveyance.

The stockholders of said academy, shall hereafter be Board of authorised to elect a board of twenty-one trustees, a majority Trustees. of whom shall reside in the county in which said academy is situated, one third of whom shall be elected annually, under such general rules and regulations as may from time to time be established by the board of trustees; and seven of said trustees shall form a quorum for the transaction of business.

Chap. 31.

AN ACT to extend the time for the collection of taxes in the city of Syracuse, and the towns of Wolcott, Bethlehem, Poughkeepsie and Watervliet.

Passed March 2, 1850.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

§ 1. If the collector of the city of Syracuse in the county of Onondaga, and the collector of the town of Wolcott in the county of Wayne, and the collectors of the towns of Bethlehem and Watervliet in the county of Albany, and the collector of the town of Poughkeepsie in the county of Dutchess, shall, within the time now appointed by law, pay over all moneys by them collected, and shall renew their securities, the first to the satisfaction of the common council of the city of Syracuse, and the latter to the satisfaction of the supervisor of said towns of Wolcott, Bethlehem, Ploughkeepsie and Watervliet respectively the time for the collecting and making the final returns of the taxes in said city and said towns shall extend to the first day of April next. §2. This act shall take effect immediately.

Chap. 32.

AN ACT in relation to the free schools in the city of
Rochester.

Passed March 2, 1850.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

§ 1. The board of education for the city of Rochester shall apply the moneys levied and raised for the support of common schools in said city, in such a manner as shall secure equal educational advantages to all the children of said city, over five and under sixteen years of age, by continuing the schools in each district an equal period as near as may be. § 2. All acts and parts of acts inconsistent with the provisions of this act are hereby repealed.

§ 3. This act shall take effect immediately.

Chap. 33.

AN ACT to amend the charter of the Schenectady and
Catskill Railroad Company.

Passed March 2, 1850.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

§ 1. The first section of the act amending the act to incorporate the Schenectady and Catskill Railroad Company, passed March 3, 1848, is hereby amended, so as to extend the time therein limited for the commencement of the construction of the said road, one year from the of this passage act, and the time for the completion and putting in operation of the same, of this act. from the passage three years §2. The fourth section of the act to incorporate the Schenectady and Catskill Railroad Company, passed May 13, 1846, is hereby amended as follows: James Powers, Samuel S. Day, John Van Vleck, Erastus Beach, of the village of Catskill, and Cornelius Van Santvoord of the city of New York, shall be commissioners to receive subscriptions to the capital stock of the said corporation, and distribute the said stock; and it shall be their duty, within six months from the passage of this act, at some suitable
