Ordered, That the Clerk deliver said bill to the Senate, and request their concurrence therein.

The bill entitled "An act to amend an act entitled 'An act in relation to the powers and duties of the department of public parks of the city of New York,' passed June 28, 1873, and in relation to the powers of the common council in said city," being announced for a third reading.

Mr. Alvord moved to re-commit said bill to the committee on affairs of cities, with instructions to amend as follows:

Section 1, lines 16 and 17, printed bill, strike out the words "nothing in this act shall be construed to authorize."

Line 17, after the word "commissioners" insert the words "of public parks are hereby authorized."

Line 19, strike out all after the word "mentioned" to the end of the section, and report the same forthwith, retaining its place on the calendar of third reading of bills.

Mr. Daly moved to amend by substituting for Mr. Alvord's amendment, the following:

Add at the end of section 1, the words, "in so far as to determine the department under the direction of which said work shall be done."

Mr. Speaker put the question whether the House would agree to said motion of Mr. Daly, and it was determined in the affirmative.

Mr. Speaker then put the question whether the House would agree to said motion of Mr. Alvord, as amended, and it was determined in the affirmative.

Mr. Eastman, from the committee on affairs of cities, reported said bill as directed by the House.

Said bill, as amended, was then read a third time.

Mr. Speaker put the question whether the House would agree to the final passage of said bill, and it was determined in the affirmative, a majority of all the members elected to the Assembly voting in favor thereof, and three-fifths of said members being present.

Senate bill entitled "An act to authorize the city of Utica to borrow and disburse money to pay for fire apparatus, and to levy and collect a tax to pay the same," was read a third time.

Mr. Speaker put the question whether the House would agree to the final passage of said bill, and it was determined in the affirmative, a majority of all the members elected to the Assembly voting in favor thereof, and three-fifths of said members being present.

Ordered, That the Clerk return said bill to the Senate, with a message informing that the Assembly have passed the same.

The bill entitled "An act to amend an act entitled 'An act to amend and consolidate the several acts in relation to the charter of the city of Rochester,' passed April 8, 1861," was read a third time.

Mr. Speaker put the question whether the House would agree to the final passage of said bill, and it was determined in the affirmative, a majority of all the members elected to the Assembly voting in favor thereof, and three-fifths of said members being present.
