Page 1 to trator of the Puerto Rico Reconstruction Administration, * * serve without additional compensation, and to exercise and discharge the functions, duties, and authority conferred upon the Puerto Rico Reconstruction Administration * * *. The Administrator is hereby authorized to appoint an Assistant Administrator and delegate to him such of the powers hereby conferred upon the Administrator as may be necessary for the efficient operation of the Administration in Puerto Rico. The Assistant Administrator shall also serve as Acting Administrator when so directed by the Administrator.* (49 Stat. 115, 49 Stat. 1135; 15 U.S.C., Sup., 728 note) [E.O. 7689, Aug. 12, 1937, 2 F.R. 1403] 200.3 Functions and duties. I hereby prescribe the following functions and duties of the said Puerto Rico Reconstruction Administration to be exercised and performed by the Administrator thereof: To initiate, formulate, administer and supervise a program of approved projects for providing relief and work relief and for increasing employment within Puerto Rico.*t 200.4 Allocations. Allocations will be made hereafter for the administrative expenses of the Puerto Rico Reconstruction Administration and for authorized projects.*t 200.5 Expenditures. In the performance of such duties and functions (see § 200.3), expenditures are hereby authorized for necessary supplies and equipment; law books and books of reference, directories, periodicals, newspapers and press clippings; travel expenses, including the expense of attendance at meetings when specifically authorized by the Administrator; rental at the seat of the Government and elsewhere; purchase, operation, and maintenance of passenger-carrying vehicles; printing and binding; and incidental expenses.** 200.6 Services and personnel. I hereby authorize the Administrator to accept and utilize such voluntary and uncompensated services and, with the consent of the local government of Puerto Rico, such local officers and employees, and appoint, without regard to the provisions of the civil service laws, such officers and employees, as may be necessary, prescribe their duties and responsibilities and, without regard to the Classification Act of 1923, as amended, fix their compensation: Provided, That in so far as practicable, the persons employed under the authority of this Executive Order (E.O. 7057) shall be selected from those receiving relief.*† 200.7 Acquisition of property. To the extent necessary to carry out the provisions of this Executive Order (E.O. 7057) the Administrator is authorized to acquire, by purchase or by the power of eminent domain, any real property or any interest therein and improve, develop, grant, sell, lease (with or without the privilege of purchasing), or otherwise dispose of any such property or interest therein.*+ Sec. Section 202.1 Agricultural loans; purposes. Loans may be made by the Puerto Rico Reconstruction Administration (a) for the purpose of financing, in whole or in part, the purchase of farm lands and necessary equipment by farmers, farm tenants, croppers, farm laborers, or stockmen, and (b) for such other purposes as may be necessary for rural rehabilitation or relief in stricken agricultural areas.* [E.O. 7554, Feb. 17, 1937, 2 F.R. 338] *§§ 202.1 to 202.6, inclusive, issued under the authority contained in 49 Stat. 115. 202.2 Agricultural loans; conditions. Loans for the purposes mentioned in section 1 hereof (§ 202.1) may be made by the Puerto Rico Reconstruction Administration either to individuals or to such bona fide associations, cooperative associations, partnerships, or other like agencies composed of farmers, farm tenants, croppers, or farm laborers as the Administrator shall approve: Provided, however, That such loans shall be made to such bona fide associations, cooperative associations, partnerships, or like agencies only upon condition (a) that they impose no inequitable restriction upon membership or participation therein, (b) that they be so conducted under the supervision of the Puerto Rico Reconstruction Administration as to protect adequately the interests of the members or participants therein, and (c) that where such a loan is for the purpose of financing the purchase of community equipment, the operation of such equipment shall be subject to the supervision and control of the Puerto Rico Reconstruction Administration so long as the loan remains unpaid.** In §§ 202.2 to 202.6, inclusive, the numbers to the right of the decimal point correspond with the respective section numbers in Executive Order 7180, Sept. 6, 1935. 202.3 Interest rates. Interest shall be charged on all loans made by the Puerto Rico Reconstruction Administration at rates to be fixed by the Administrator, which rates shall not be greater than 5 percent nor less than 3 percent per annum, and need not be uniform. (a) throughout Puerto Rico or (b) on loans of different classes. Where circumstances so require, the Administrator may reduce the rate at which unaccrued interest shall be payable on outstanding loans, but in no case to a rate less than 3 percent per annum.** 202.4 Loan period. All loans shall be for such a period, not to exceed 40 years, as the Administrator shall prescribe. The period for any loan or class of loans shall be fixed by the Administrator upon the basis of (a) the use to which the proceeds thereof are to be put, (b) the financial resources and earning capacity of the borrower, and (c), in the case of loans to finance the purchase of specific property, the estimated life thereof, the probable rate of depreciation, and the amount of the loan as compared with the total purchase price.*† 202.5 Repayment of loans. Unless otherwise authorized by the President, all loans for a period of 2 years or more shall provide for repayment in equal annual installments, which may include interest in the discretion of the Administrator, except that when the loan is for a period of 5 years or more, and in the opinion of the Adminis *For statutory citation, see note to § 202.1. Page 3 trator the financial condition of the borrower so justifies, there need be no requirement that any payment be made on the principal during the first 3 years after the loan is made.*t CROSS REFERENCE: For interest rates, see § 202.3. 202.6 Default. Upon default in the repayment of any loan or the payment of interest, the Puerto Rico Reconstruction Administration may (a) enforce payment by realizing upon the security and by legal proceedings, (b) extend the time of payment where the circumstances so justify, or (c) refinance such loan upon terms and conditions not inconsistent with the provisions of the regulations in §§ 202.2–202.6.*† CROSS REFERENCE: For repayment of loans, see § 202.5. (a) Executive Order No. 7732 of October 27, 1937, transferring certain Federal housing or slum-clearance projects from the Federal Emergency Administration of Public Works to the United States Housing Authority, is hereby revoked in so far as it pertains to or affects the following-described housing or slum-clearance projects in Puerto Rico: (1) Housing Division Project No. H-3600-SJ-A, Official Project No. 52-8384, constructed and being carried out in San Juan, Puerto Rico, pursuant to Presidential Letter No. 880 of October 28, 1935. (2) Housing Division Project No. H-3600-C-A, Official Project No. 52-5353, constructed and being carried out in Caguas, Puerto Rico, pursuant to Presidential Letter No. 1579 of May 2, 1936. (b) All right, title, and interest held on October 31, 1937, by the Federal Emergency Administration of Public Works in the two above-described projects are hereby transferred to the Puerto Rico Reconstruction Administration, together with the following: (1) All assets, contracts, records, and other property held by the Federal Emergency Administration of Public Works on October 31, 1937, in connection with the above-described projects: Provided, however, That nothing herein shall be construed as impairing or affecting the obligation of the United States under any contracts hereby transferred. (2) All funds allocated to the Federal Emergency Administration of Public Works which were available on October 31, 1937, for the construction and completion of the above-mentioned projects and are not yet expended. (3) All employees who are actually serving in Puerto Rico on the effective date of this order and who shall be certified within one month from this date by the Federal Emergency Administrator of Public Works as having been employed in the Federal Emergency Administration of Public Works in Puerto Rico on October 31, 1937, in connection with the construction or administration of the above Page 4 *For statutory citation, see note to § 202.1. described projects.
