Section 2.0 Compliance with international conventions. In addition to the regulations contained in this chapter licensees must observe the provisions of the following in so far as they apply:

The International Radiotelegraph Convention and General regulations annexed thereto (49 Stat. 2391).*+ [Rule 183]

The source of §§ 2.0 to 2.83, inclusive, (except for amendments and additional rules noted in the text,) is Rules and regulations of the Federal Radio Commission, effective Oct. 3, 1933, as adopted by the Federal Communications Commission, July 11, 1934.

DEFINITIONS

2.1 Services other than broadcast. Whenever in the regulations in this part the words "services other than broadcast" are used with

out specific restriction or further qualification, the words shall be taken to refer to all radio services, frequencies, etc., except broadcast service in the band of frequencies between 550 and 1,500 kilocycles, inclusive.*t [Rule 182]

2.2 Applicability. The definitions in §§ 2.3-2.23 shall apply generally to all services (see International Conventions).*t [Rule 187]

2.3 Radio station. The term "station" means all of the radiotransmitting apparatus used at a particular location for one class of service and operated under a single instrument of authorization. In the case of every station other than broadcast, the location of the station shall be considered as that of the radiating antenna.*t [Rule 188] 2.4 General communication service. The term "general communication service" is used in the regulations in this part only with respect to the service allocation of certain frequencies, and means that such frequencies have not yet been assigned to any specific service.*† [Rule 197]

2.5 Frequency band of emission. The term "frequency band of emission" means that the frequency band of an emission is the frequency band actually occupied by the emission for the type of emission and for the signaling speed used.** [Rule 224 (b)]

2.6 Frequency tolerance. The term "frequency tolerance" means the maximum permissible separation between the frequency assigned to a station and the acutal frequency of emission.*+ [Rule 224 (c)]

2.7 Mobile station. The term "mobile station" means a station that is capable of being moved and ordinarily does move.*t [Rule 189]

2.8 Fixed station. The term "fixed station" means a station, other than an amateur station, not capable of being moved, and communicating by radio with one or more stations, similarly established.*† [Rule 190]

2.9 Land station. The term "land station" means a station not capable of being moved, carrying on a mobile service.*+ [Rule 191] 2.10 Portable station. The term "portable station" means a station so constructed that it may conveniently be moved about from place to place for communication and that is in fact so moved about from time to time, but not used while in motion.*+ [Rule 192]

2.11 Portable mobile station. The term "portable mobile station" means a station so constructed that it may conveniently be moved from one mobile unit to another for communication, and that is, in fact, so moved about from time to time and ordinarily used while in motion.*t [Rule 192a]

2.12 Mobile service. The term "mobile service" means a radiocommunication service carried on between mobile and land stations and by mobile stations, communicating among themselves, special services being excluded.*+ [Rule 193]

2.13 Fixed service. The term "fixed service" means a service carrying on radiocommunication of any kind between fixed points, excluding broadcasting service and special services.*+ [Rule 194]

2.14 Special service. The term "special service" means a radiocommunication service carried on especially for the needs of a specific service of general interest and not open to public correspondence, such as a service of radio beacons, radio direction finding, time signals, regular meteorological bulletins, notices to navigators, press messages addressed to all, medical notices (medical consultation by radio), standard frequencies, emissions for scientific purposes, etc.*† [Rule 195]

2.15 International service. The term "international service" means a radio communication service between offices or stations under the jurisdiction of different countries, or between stations of the mobile service except when the latter are of the same nationality and are within the limits of the country to which they belong. An internal or national radio-communication service which is likely to cause interference with other services beyond the limits of the country in which it operates, shall be considered as an international service from the standpoint of interference.*t [Rule 196]

2.16 Public service. The term "public service" means a service for the use of the public in general.* [Rule 198]

2.17 Public correspondence. The term "public correspondence" means any radio communication where the offices and stations, by reason of their being at the disposal of the public, must accept for transmission.*t [Rule 199]

2.18 Private service. The term "private service" means a radiocommunication service which is not open to public correspondence and which may be used only by specified persons for either general or specific purposes.*+ [Rule 200]

2.19 Private enterprise. The term "private enterprise" means any person, company, or corporation which operates one or more stations for radio communication.*+ [Rule 201]

2.20 Limited service. The term "limited service" means a service which can be used only by specified persons or for special purposes.*+ [Rule 202]

2.21 Radio operating signals. The term "radio operating signals" means a letter, figure, or combination of letters and figures, or both, designed to facilitate the conduct of communications; for example, the list of abbreviations to be used in Radio Transmission, appendix 1 to the General regulations annexed to the International Radiotelegraph Convention (45 Stat. 2887).8*+ [Rule 203]

2.22 Day or daylight. In all cases where the word "day" or "daylight" occurs in connection with a specific frequency, such use of the word shall be construed to mean that period of time included between 2 hours after local sunrise and 2 hours before local sunset.*† [Rule 222]

2.23 Unlimited. The term "unlimited" when used in instruments of authorization, with respect to frequencies or hours of operation, means that the frequencies may be used and the station operated on any schedule of hours during the 24-hour day.** [Rule 223 (b)]

ADMINISTRATIVE REGULATIONS

2.41 Nature of construction permit. Each construction permit, subject to such conditions as the Commission may impose, will specify the following:

(a) Time within which construction of the station shall begin and the time within which construction shall be completed and the station ready for operation.

(b) Location and description of the proposed transmitting appa

ratus.

(c) Location of the proposed main studio (if a broadcast station). (d) Frequency or frequencies.

(e) Maximum power and operating power of the transmitting apparatus.

(f) Periods of time during which the station may be operated. (g) The station or stations, if any, with which the station may communicate.

(h) Such other conditions as may be prescribed. (i) Call signals.*t [Rule 9]

2.42 Period of construction. Unless otherwise determined by the Commission in any particular case, each construction permit will specify a maximum of 60 days from the date of granting thereof as the time within which construction of the station shall begin and a maximum of 6 months thereafter as the time within which construction shall be completed and the station ready for operation.*† [Rule 10]

2.43 Test during construction. During the period of construction and prior to filing application for license the permittee is authorized to test the equipment constructed in compliance with the terms of the construction permit for a period not to exceed 10 days, at such times as will not cause interference with existing services, provided the Commission and the inspector in charge are notified 2 days in advance of the beginning of the test, and provided further that the Commission may notify the permittee to conduct no tests until specifically authorized by it.*+ [Rule 217]

2.44 Test after construction. When construction is completed and regular application for license is filed in exact accord with the terms of the construction permit, the permittee is authorized to begin service tests in exact accord with the equipment, power, frequency, and hours specified in the construction permit, and such tests may continue for a period not to exceed 30 days, provided the Commission and the inspector in charge are notified two days in advance of the beginning of such service tests, and provided further that the Commission may cancel or change the period and/or date of the beginning of such tests in such manner as may appear to be in the public interest, convenience, and/or necessity.*t [Rule 218]

2.45 License to operate essential. The authorizations for tests shall not be construed as constituting a license to operate, and under no circumstances is the permittee to operate the station under the construction permit except for testing purposes as specified above, until license has been granted by the Commission. The granting of a license

will cancel all authority to operate other than in accordance with the terms of the license.* [Rule 219]

2.46 Permittee to apply for license. Upon completion of construction in exact accord with the terms of a construction permit, the permittee shall file application for license or modification of license in accordance with § 1.72.*+ [Rule 216]

2.47 License expiration time and period. All station licenses will be issued so as to expire at the hour of 3 a. m., E. S. T. The normal license periods and expiration dates are indicated below. Unless otherwise ordered, when an application for a new station license is granted within three months of the expiration date for licenses of the particular class of stations involved, the license shall be issued for the unexpired period of the current license term and for the full succeeding term.

(a) Broadcast station licenses will be issued for a normal license period of 6 months, expiring as follows:

(1) For stations operating on the frequencies 640, 650, 660, 670, 680, 700, 710, 720, 740, 750, 760, 770, 790, 800, 810, 820, 830, 850, 860, 870, 970, 990, 1,000, 1,020, 1,040, 1,050, 1,060, 1,070, 1,080, 1,090, 1,100, 1,110 1,130, 1,140, 1,150, 1,160, 1,170, 1,180, 1,190 kilocycles August 1 and February 1.

(2) For stations operating on the frequencies 550, 560, 570, 580, 590, 600, 610, 620, 630, 780, 880, 890, 900, 920 kilocycles September 1 and March 1.

(3) For stations operating on the frequencies 930, 940, 950, 1,010, 1,120, 1,220, 1,230, 1,240, 1,250, 1,260, 1,270, 1,280, 1,290 kilocycles October 1 and April 1.

(4) For stations operating on the frequencies 1,300, 1,320, 1,330, 1,340, 1,350, 1,360, 1,380, 1,390, 1,400, 1,410, 1,430, 1,440, 1,450, 1,460, 1,470, 1,480, 1,490, kilocycles November 1 and May 1.

(5) For stations operating on the frequencies 1,200, 1,210, 1,310 kilocycles December 1 and June 1.

(6) For stations operating on the frequencies 1,370, 1,420, 1,500 kilocycles January 1 and July 1.

(b) The normal license period for stations of the following classifications will be 1 year, and licenses will be issued so as to expire on the dates hereinafter designated:

(1) All classes of stations in Alaska with the exception of broad
