Mr. Olin having proposed to submit the following resolution, viz : Resolved, That the resolution of this House adopted on Monday, 8th instant, restricting the business of the present extraordinary session to questions of immediate national necessity, be so construed as to admit of the consideration only of practical measures of legisla. tion on the subjects embraced in the message of the President and the reports of the several heads of departments, and to exclude all resolutions of a merely declaratory nature; and that the Speaker be directed to rule as out of order all matters thus excluded, without waiting for the point of order to be raised thereon.

Mr. Holman made the point of order that inasmuch as the said resolution changes a standing order of the House it is out of order. The Speaker sustained the said point of order.

From this decision of the Chair Mr. Olin appealed.
Pending which,

Ordered, That the appeal be laid on the table.

THURSDAY, JULY 18, 1861.-Pages 105, 106.

Mr. Hickman, from the Committee on the Judiciary, to whom it was referred to inquire whether the Hon. Henry May, a representative from the State of Maryland, has not been found holding criminal intercourse and correspondence with persons in armed rebellion against the government of the United States, made a report in writing thereon; which was laid on the table, and ordered to be printed.

Leave having been granted to Mr. May to make a personal explanation

Pending the remarks of Mr. May,

Mr. Stevens called him to order, on the ground that he was abusing the privilege granted him by the House.

The Speaker decided that under the usage, the House having granted unanimous consent for a personal explanation, he had no power to control the line of remarks to be pursued by Mr. May. From this decision of the Chair Mr. Stevens appealed.

Pending which,

Mr. Vallandigham moved that the appeal be laid on the table.
And the question being put,

It was decided in the negative,

So the House refused to lay the appeal on the table.

The question then recurred; and being put, Shall the decision of

the Chair stand as the judgment of the House?

It was decided in the negative.

So the decision of the Chair was not sustained.

On motion of Mr. Dawes,

Ordered, That leave be granted to Mr. May to proceed in order.

Mr. Sedgwick, from the Committee on Naval Affairs, reported a joint resolution (H. Res. 2) appointing a commission to select a site for the Naval Academy, and other purposes; which was read a first and second time.

Pending the question on engrossment,

Mr. Sedgwick moved the previous question; and fifty-two members having voted in favor of, and forty-one members having voted against, seconding the same, the Speaker declared that the previous question was seconded.

Mr. Vallandigham made the point of order that no quorum had voted.

The Speaker decided that, inasmuch as ninety-two members constituted a majority of the members chosen, a quorum had voted. In this decision of the Chair the House acquiesced.
