Mr. Fouke moved that the vote last taken be reconsidered, and also moved that the motion to reconsider be laid on the table; which latter motion was agreed to.

Mr. McClernand submitted the following resolution, viz:

Resolved, That the question of the prima facie, as well as the final right of George K. Sheil and A. J. Thayer, contestants respectively claiming a seat in this House from the State of Oregon, be referred to the Committee on Elections, hereafter to be appointed, and that until said committee shall have reported in the premises, and the House decided said question, neither of said contestants shall be admitted to a seat.

Emerson Etheridge having received a majority of all the votes given, was declared by the Speaker duly elected Clerk of the House of Representatives for the thirty-seventh Congress.

Mr. Washburne submitted the following resolutions; which were read, considered, and, under the operation of the previous question, agreed to, viz:

Resolved, That the rules of the House of Representatives of the thirty-sixth Congress shall be the rules of the House of Representatives until otherwise ordered.

Resolved, That a committee of five, consisting of the Speaker and four members to be named by him, be appointed, to whom shall be referred the rules of the House, and who shall have leave to report at any time such amendment and revision of the same as they shall think proper, and such report, when made, shall be considered by the House as a special order; provided, that when the committee report their functions shall cease.

The Speaker appointed Mr. Washburne, Mr. Colfax, Mr. Richardson, and Mr. Mallory, who, together with the Speaker, will constitute the said committee.

Mr. Stevens presented the petition of John M. Butler, contesting the seat of William E. Lehman as a representative from the State of Pennsylvania; which was referred to the Committee of Elections, hereafter to be appointed.

Notices were given, under the rule of motions, for leave to introduce bills, as follows, viz:

By Mr. Van Wyck: A bill to provide for sending letters of officers and soldiers in the military and naval service of the United States free of postage.

By Mr. Vallandigham: A bill to repeal the tariff act of 1861 and revive the tariff act of 1857.

A message from the Senate, by Mr. Hickey, their chief clerk:

Mr. Speaker: I am directed to inform the House of Representatives that a quorum of the Senate has assembled, and that the Senate. is ready to proceed to business.

On motion of Mr. Ely,

Resolved, That a committee be appointed on the part of the House to join such committee as may be appointed on the part of the Senate to wait upon the President of the United States, and inform him that a quorum of the two houses has assembled, and that Congress is ready to receive any communication he may be pleased to make.

The Speaker appointed Mr. Ely, Mr. Carlile, and Mr. Richardson the said committee on the part of the House.

Ordered, That the Clerk acquaint the Senate therewith.

On motion of Mr. Train,

Resolved, That a message be sent to the Senate to inform that body that a quorum of the House of Representatives has assembled; that Galusha A. Grow, one of the representatives from the State of Pennsylvania, has been chosen Speaker, and that the House is now ready to proceed to business, and that the Clerk do go with said message. Mr. McKnight submitted the following resolution, viz:

Resolved, That, after to-morrow, the sessions of this House shall begin at 11 o'clock a. m.

Pending which,

Mr. Curtis moved to amend the same by striking out "11 o'clock a. m." and inserting in lieu thereof "12 o'clock m.;' which motion was agreed to.

The said resolution, as amended, was then agreed to.

And then,

On motion of Mr. Ellihu B. Washburne, at 4 o'clock and 50 minutes p. m., the House adjourned.

John J. Crittenden, a member from the State of Kentucky, appeared, was sworn to support the Constitution of the United States, and took his seat in the House.

By Mr. Windom: A bill to secure homesteads to actual settlers on the public domain.

By Mr. Bingham: A bill to provide for the suppression of rebellion against and resistance to the laws of the United States, and to amend the act entitled "An act to provide for calling forth the militia to execute the laws of the Union." &c., passed February 28, 1795.

By Mr. Stevens: A bill to repeal all laws creating ports of entry in rebellious States;

Also, a bill erecting a judicial district out of Virginia and North Carolina, the courts to be held at Wheeling, and for other purposes.

By Mr. Upton: A bill to repeal an act entitled "An act to retrocede the county of Alexandria, in the District of Columbia, to the State of Virginia," approved July 9, 1846.
