It is the opinion of your committee that authority be granted the Secretary of War, in his discretion, to discontinue during a period of war or a national emergency the statutory requirements relating to professional examinations.

Attached hereto and made a part of this report is a letter from the War Department.

WAR DEPARTMENT, Washington, July 26, 1940.

DEAR MR. SPEAKER: There is enclosed a draft of a bill to authorize the discontinuance of professional examinations for promotion in the Regular Army of officers of the Medical, Dental, and Veterinary Corps during time of war or emergency declared by Congress, which the War Department presents for the consideration of the Congress with a view to its enactment into law.

Section 24c, National Defense Act, as amended, repealed all laws providing for the examination for promotion, other than physical examination, of all officers of the Regular Army except officers of the Medical, Dental, and Veterinary Corps. Under the provision of section 24c, National Defense Act, as amended, and the act of July 31, 1935 (49 Stat. 505, 506), officers of these three branches are required to pass a professional examination for promotion. No other officers are required to be examined professionally for promotion.

Any emergency involving a considerable mobilization of the Army of the United States will impose a very great burden upon the Medical Department. The assembly of examining boards and the conduct of professional examinations would interfere with the prosecution of the work of the Medical Department. It is, therefore, urgently recommended that authority be granted the Secretary of War in his discretion to discontinue during a period of war or a national emergency declared by the Congress the statutory requirement as to professional examination. No additional costs are involved in the proposed legislation.

The Bureau of the Budget advises that there is no objection to the submission of this proposed legislation.

CONFERENCE REPORT

[To accompany S. 1160]

The committee of conference on the disagreeing votes of the two Houses on the amendments of the House to the bill (S. 1160) entitled "An act for the relief of Roland Hanson, a minor, and Dr. E. A. Julien", having met, after full and free conference, have agreed to recommend and do recommend to their respective Houses as follows: That the Senate recede from its disagreement to the amendment of the House numbered 1, and agree to the same with an amendment, as follows:

In lieu of the figures "$2,000" insert $1,250; and the House agree to the same.

That the Senate recede from its disagreement to the amendments of the House numbered 2, 3, and 4, and agree to the same.

STATEMENT OF THE MANAGERS ON THE PART OF THE HOUSE

The managers on the part of the House at the conference on the disagreeing votes of the two Houses on the amendments of the House to the bill (S. 1160), for the relief of Roland Hanson, a minor, and Dr. E. A. Julien, submit the following statement in explanation of the effect of the action agreed upon and recommended in the accompanying conference report.

In consideration of this Senate bill, your committee believed that the amounts recommended in the bill were insufficient, and therefore increased the amount to be paid to the legal guardian of Roland Hanson from $500 to $2,000. Roland Hanson is a minor who suffered certain injuries as a result of being struck by a United States Army truck. The committee also increased the amount to be paid to Dr. E. A. Julien from $200 to $500. Dr. Julien rendered certain professional services to the said Roland Hanson.

At the conference an agreement was reached on a compromise in the amount of $1,250 for Roland Hanson, and the House conferees receded from their amendment on the amount to be paid to Dr. Julien.

Kennedy", having met, after full and free conference, have agreed to recommend and do recommend to their respective Houses as follows:

That the House recede from its disagreement to the amendment of the Senate numbered 1, and agree to the same with an amendment, as follows:

In lieu of the figures "$1,204.50" insert "$1,704.50"; and the House agree to the same.

STATEMENT OF THE MANAGERS ON THE PART OF THE HOUSE

The managers on the part of the House at the conference on the disagreeing votes of the two Houses on the amendment of the Senate to the bill (H. R. 3481), for the relief of C. Z. Bush and W. D. Kennedy, submit the following statement in explanation of the effect of the action agreed upon and recommended in the accompanying conference report. The bill as it passed the House provided for the payment of the sum of $2,500 to C. Z. Bush for personal injuries and $72.80 to W. D. Kennedy for property damage growing out of a collision involving the car in which they were riding and a truck of the Civilian Conservation Corps. The Senate reduced the amount to be paid to Mr. Bush from $2,500 to $1,204.50.

At the conference a compromise of $1,704.50 was agreed upon.
