CHAPTER XXVI.

PLUMBERS.

2251. Plumbers certificate.—Any person now or hereafter engaged in or working at the business of plumbing in cities of seven thousand and five hundred population or more in this State, either as master plumber or employing plumber or as journeyman plumber, shall first receive a certificate thereof in accordance with the provisions of this Chapter. -2266

2252. Application for certificate; examination.-Any Ib., Sec. 2. person desiring to engage in or work at the business of plumbing, either as a master plumber or employing plumber or as a journeyman plumber, in cities having a population of seven thousand five hundred or more and a system of water supply or sewerage, shall make application to a Board of Examiners hereinafter provided for, at such times and place as said board may direct. Said examinations may be made in whole or in part in writing and shall be of a practical and elementary character, but sufficiently strict to test the qualifications of the applicant.

2253. Board of examiners; qualifications; terms of office; Ib.. Sec. 3. compensation.-There shall be in every city of seven thousand five hundred inhabitants or more, a board of examiners of plumbers, consisting of three members, one of which shall be chairman of said board of health; a second member, who shall be a master plumber, and a third member, who shall be a journeyman plumber. Said second and third members shall be appointed by the appointing power of said city or town as provided by charter or ordinance for the term of one year from the first day of January in the year of appointment, thereafter annually before the first day of January, and shall be paid from the treasury of said city the same as other officers, in such sum as the authorities may designate.

2254. Examination of applicants; fees, etc.-Said board Ib., Sec. 4. of examiners shall, as soon as may be after their appointment, meet, and shall then designate the times and places for examination of all applicants desiring to engage in or work at the business of plumbing within their respective jurisdiction. Said board shall examine said applicants as to their practical knowledge of plumbing, house drainage, and plumbing ventilation, and, if satisfied of the competency of

such applicants, shall thereupon issue a certificate to such applicant authorizing him to engage in or work at the business of plumbing, either as master plumber or employing plumber, or as a journeyman plumber. The fee for a certificate for a master plumber or employing plumber shall be five dollars; for a journeyman plumber it shall be two dollars. Said certificate shall be valid for the term of one year, but the same can be renewed if application for renewal is made to said board not less than thirty days before the expiration of said certificate. The fee for renewals shall be one dollar. All moneys shall be paid into the city or town treasury for the use of said city or town.

2255. Cities to provide rules for construction of all plumbing; plumbing inspector; qualification; reports to city board of health. All cities or towns in this State, and within the provisions of this chapter, shall provide by ordinance, rules and regulations for the construction and maintenance of all plumbing and drainage placed in or on any building or the premises thereof in such city or town, and no work of this character shall be done unless a permit be issued therefor, excepting the repairing of leaks. It shall be the further duty of said cities. or towns to provide for the appointment or election of a plumbing inspector and such assistants as are necessary, but said inspector and assistants must be practical plumbers of not less than ten years' experience, whose duty it shall be to see that all rules and regulations touching such plumbing are faithfully and diligently observed and executed. The plumbing inspector shall preside at all meetings of the examining board of plumbers and shall have the deciding voice and vote in all matters connected with the examination of applicants and granting of certificates, whenever the remaining members of said board are unable to agree. That the plumbing department of every city or town embraced in this chapter, consisting of the examining board, the plumbing inspector and his assistants, shall be under the supervision of the board of health of said city or town, and the plumbing inspector shall make a complete report of this department to said board of health at the end of each year, and oftener as may be required by said board, or provided for by ordinance.

2256. Counties containing cities of certain population to appoint plumbing inspector; duties.-In counties of this State containing cities or towns having a population of seven thousand five hundred inhabitants or more according to the

Federal Census of 1910, or any subsequent Federal Census, the county commissioners or governing board of said counties are required and hereby empowered to appoint an inspector of plumbing who shall be a plumber of not less than ten years' experience. His duties shall be to inspect all plumbing and drainage installed in the territory embraced in a radius of one mile beyond said city or town's limits, and to do such other work as the said county commissioners may require. All plumbing and drainage done in this territory shall be done in conformity with the rules and regulations governing plumbing in the city or town contiguous thereto. CHAPTER XXVII.

EMBALMERS.

2257. State board of embalming; how constituted.-A board is hereby created and established, which shall be known under the name of the State Board of Embalming.

2258. Appointment of board; by whom composed, and Ib., Sec. 2. how appointed. The board shall consist of the State Health officer and four members to be appointed by the Governor. Provided, no person shall be eligible to appointment as a member of said board of embalming who has not been engaged in the business of, and practiced embalming in this State for a period of at least five years preceding said appointment.

2259. Term of office. The term of office of each member Ib., Sec. 3. of said board shall be four years, except the members of the first board to be appointed under this chapter, who shall serve one, two, three and four years, respectively, and until his successor is appointed and qualified.

2260. Oath of office.-Each member of said board shall, Ib., Sec. 4. before entering upon his duties take before some person competent to administer oaths, an oath to faithfully perform the duties of his office, and that he is legally qualified to become a member of said board, under the provisions of this chapter.

2261. Organization.—The said board of embalming shall Ib., Sec. 5. within thirty days after having been appointed and qual

ified, meet at Jacksonville and organize, by electing from its number a president, and secretary and treasurer thereof and it shall meet from time to time thereafter at such place and as often as may be found to be necessary.

2262. Time and place of meeting. The president of said State Board of Embalming shall have the power to call a meeting of said board at any time, and at such place as he may designate.

2263. Quorum.-A majority of said board shall at all times constitute a quorum.

2264. Seal. Said board shall provide itself with a suitable seal.

2265. Preservation of records.—The records of said board shall be kept at the office of the secretary and treasurer, who shall give such bond as the board shall deem necessary.

2266. Board to make and publish rules. It shall be the duty of said board of embalming to formulate and adopt rules, regulations and by-laws, not inconsistent with the law of this State or the United States whereby the duties of said board can be performed and the practice of embalming dead human bodies regulated.

2267. Licenses and so forth.-Every person desiring to engage in the practice of embalming dead human bodies, (within the State of Florida shall make a written application to the secretary of the State Board of Embalming for a license, accompanying same with a license fee of an amount not exceeding twenty-five dollars, whereupon the applicant as aforesaid shall present himself or herself before said board at a time and place to be fixed by said board, and if the said board shall find upon due examination that the applicant is of good moral character, and not addicted to the excessive use of alcoholic or narcotic drugs, possessed of the skill and knowledge of said science of embalming and the care and disposition of the dead, and has a reasonable knowledge of sanitation and the disinfection of bodies of deceased persons and the apartments, clothing and bedding, in case of death from infectious, contagious or other communicable disease, shall issue to said applicant a license to practice embalming and shall register such applicant as a

duly licensed embalmer. Such license shall be signed by the majority of the board and attested by its seal, and all persons receiving a license under the provisions of this chapter shall register the fact at the office of the clerk of the court in each and every county in which he may thereafter locate, and with the local district registrar in whose district he may practice his profession: Provided, further, That no embalmer shall be considered eligible for licensure who had not had at least two years' experience under a licensed embalmer.

2268. Certificates of former practitioners.-All practi- Ib., Sec. 12. tioners who have been engaged in the practice of embalming in this State prior to the 21st day of May, 1917, under a license issued by the State board of health, shall be granted by the State Board of Embalming a certificate of licensure without further examination and expense.

2269. Renewal of Registration.-Every registered em- Ib., Sec. 13. balmer who desires to continue the practice of his profession, shall annually thereafter during the time he shall continue in such practice, on such dates as said board may determine, pay to the secretary of said board a fee of two dollars for the renewal of registration.

2270. Compensation of members of board and other ex- Ib., Sec. 14. penses. All expenses, salary and per diem of members of said board shall be defrayed from fees received under the provision of this chapter, and shall in no manner be an expense to the State.

2271. Limitations of Act.-Nothing in this chapter shall b., Sec. 15. apply to or in any manner interfere with the duties of any officers of local or State institution, or shall this chapter apply to any person engaged simply in the furnishing of burial receptacles for the dead and burying of the dead and not embalming.

2272. Revocation of license.-Any embalmer who shall Ib., Sec. 17. violate the provisions of this chapter may have his license revoked at the discretion of this board.
