AFTERNOON SESSION.

Honolulu, T. H., March 5th, 1901.

The House reconvened at 2 o'clock p. m. Mr. Speaker in the

Consideration of H. J. R. No. 3 was resumed. Mr. Emmeluth offered the following substitute amendment in lieu of one offered before recess: "That a Committee of three members of this House be appointed by the Speaker to confer with a like Committee of the Senate relative to the advisability of legislation in regard to the matters referred to above. That the Committee report their findings and recommendations within ten session days of the appointment of the Senate Committee." Mr. Ewaliko moved that the Committee should consist of five members instead of three. Mr. Emmeluth accepted the amendment. Mr. Kaniho moved that the Resolution be again tabled. Seconded by Mr. Hihio. On motion of Mr. Mossman, the ayes and noes were called on the motion to table the Resolution, with the following result:

Ayes--Messrs. Ahulii, Ewaliko, Haaheo, Hihio, Kaauwai, Kanimakaole, Kaniho, Kawaihoa, Kumalae, Mossman, Nailima, Paele and Puuki---13.

Noes---Messrs. Aylett, Dickey, Emmeluth, Gilfillan, Hoogs, Keiki, Kekaula, Keliikoa, Mahoe, Makainai, Makekau, Monsarrat, Prendergast and Robertson---14.

Present and not voting---Mr. Speaker---1.

Excused---Mr. Beckley---1.

Absent---Mr. Wilcox---1.

The Speaker thereupon announced that the motion to table the resolution was lost.

Mr. Robertson moved that the Resolution pass as amended. Carried. The Speaker then announced the following Committee in accordance with the Resolution: Messrs. Emmeluth, Aylett, Makainai, Paele and Hihio.

On motion of Mr. Monsarrat, the House thereupon adjourned.

PETITIONS, MEMORIALS AND COMMUNI

CATIONS.

The following Petitions were presented:

Petition No. 4, by Mr. Paele, from citizens and voters residing in the Second Precinct of the Fifth Representative District, asking for an appropriation of $25,000 for bridges, highway and breakwater along sea coast of the Island of Oahu. Referred to the Committee on Public Lands and Internal Improvements.

Petition No. 5, by Mr. Beckley, from twenty-six citizens and tax-payers residing in Waialua, Molokai, asking for an appropriation sufficient to build a school house in that district. Referred to the Committee on Public Health and Education.

Petition No. 6, by Mr. Haaheo, from residents of Puna, Hawaii, asking for an appropriation of $12,000 for roads in that district. Consideration postponed, to be taken up with the Appropriation Bill.

PRIVILEGED REPORTS.

Mr. Prendergast, Chairman of Committee on Enrollment, Revision and Printing, reported the following Bills printed and ready for distribution:

H. B. No. 2, by Mr. Dickey, entitled "An Act to appropriate an emergency fund to be used in repairing the damage caused by the late storm."

No. 4, by Mr. Gilfillan, entitled "An Act to provide for a commission to take evidence concerning injuries to property caused by the action of the Board of Health in connection with the suppression of Bubonic Plague in Honolulu and elsewhere in this Territory, and by the conflagration in Honolulu on January 20th, 1900, and to report thereon."

H. B. No. 7, by Mr. Hoogs, entitled "An Act to authorize and regulate the placing of electric wires in the streets of Hono

lulu."

H. B. No. 12, by Mr. Haaheo, entitled "An Act to repeal Section 861 of the Civil Laws of 1897."

The following Bills, notice of which had previously been given, were introduced, read by title, passed first reading, and were ordered printed:

H. B. No. 29, by Mr. Kaniho, entitled "An Act to amend Section 811 of the Civil Code, relating to Cart and Dray Tax.”

RESOLUTIONS.

The following Resolutions were introduced:

A resolution by Mr. Keliikoa relating to an item of $500.00 being set apart by the Legislature of 1898 for the purpose of extending wharf at Keauhou, North Kona, Hawaii. Adopted.

A resolution by Mr. Kekaula, asking for an appropriation of $250.00 for the construction of a warehouse at Hoopuloa Landing, South Kona, Hawaii. Referred to the Committee on Public Lands and Internal Improvements.

Notice was given of intention to introduce the following

BILLS ON SECOND READING.

The following Bills were taken up for consideration on their second reading:

H. B. No. 2, by Mr. Dickey, entitled "An Act to appropriate an emergency fund to be used in repairing the damage caused by the late storm." Referred to the Committee on Public Lands and Internal Improvements.

H. B. No. 3, by Mr. Robertson, entitled "An Act relating to the Jurisdiction of Circuit Judges at Chambers in matters concerning the relation of Guardian and Ward, and amending Seetion 1367 of the Civil Code, and Section 38 of Chapter 57 of the Session Laws of 1892, as amended by Act 56 of the Session Laws of 1898," was considered section by section, together with the report of the Committee on Judiciary recommending the Bill's passage. Sections 1, 2 and 3 were respectively read and passed as read. The title and enacting clause were read and adopted. Mr. Robertson moved that the Bill be typewritten and placed on the order of the day for March 8th. Carried.

H. B. No. 4, by Mr. Gilfillan, entitled "An Act to provide for a commission to take evidence concerning injuries to property caused by the action of the Board of Health in connection with the suppression of Bubonic Plague in Honolulu and elsewhere in this Territory, and by the conflagration in Honolulu on January 20th, 1900, and to report thereon," was, on motion of Mr. Robertson, referred to the Committee on Judiciary.

RESOLUTIONS.

Under a suspension of the Rules, the following Resolution was introduced by Mr. Robertson:

Resolved, that the Committee on Finance be requested to forthwith take up the consideration of the mater of the ways and means of paying claims referred to in House Bill No. 4, and that they submit a Bill or Bills to provide such ways and means. On motion of Mr. Dickey, the Resolution was adopted.

On motion of Mr. Kekaula, the House thereupon stood in recess until 2 o'clock p. m.

No. 8, by Mr. Puuki, entitled "An Act to amend Section 117 of Chapter 10 of the Civil Laws of 1897, relating to attending schools, was read by title, and, on motion of Mr. Mahoe, referred to the Committee on Enrollment, Revision and Printing. H. B. No. 5, by Mr. Robertson, entitled "An Act to authorize the removal of persons under guardianship and the personal property of such persons out of this Territory," was considered section by section, together with the report of the Committee on Judiciary thereon, recommending the Bill's passage. Sections 1,

2 and 3 were

successively passed as in the Bill, and the title and enacting clause approved. The Bill was ordered typewritten, to be read a third time on March 8th.

H. B. No. 7, by Mr. Hoogs, entitled "An Act to authorize and regulate the placing of electric wires in the streets of Honolulu," was read by title and referred to the Committee on Public Lands and Internal Improvements.

No. 6, by Mr. Robertson, entitled "An Act to repeal Sections 1378, 1386, 1387, 1388 and 1389 of the Civil Code, relating to the sale of real estate in this Territory by foreign guardians," was considered section by section. Sections 1 and 2 were respectively passed as in the Bill, and the title and enacting clause approved. The Bill was then ordered typewritten, to be read a third time on March 8th.

H. B. No. 10, by Mr. Robertson, entitled "An Act to amend Section 30 of Chapter LVII of the Session Laws of 1892," was considered, together with the report of the Committee on Judiciary thereon. On motion of Mr. Robertson, the Bill passed its second reading and was ordered typewritten, to be read a third time

on March 8th.

H. B. No. 13, by Mr. Robertson, entitled "An Act to repeal certain obsolete laws," was read by title and referred to the Committee on Judiciary.
