Honolulu, H. I., May 9, 1901.

To the Speaker and Representatives of the Legislature of the Territory of Hawaii:

Your petitioners who subscribe hereto submit the following facts and prayer, viz:

Whereas, there is not at the present time any protection to the City from the dangers of fire that may occur in shipping lying in the harbor; the Honolulu Fire Department not being equipped to fight fire on board vessels, particularly in cases where such vessels are not along side of the wharf; and,

Whereas, this fact creates a great menace and danger to the Public Works property of the Territory, to wit: to the wharves and docks of the harbor front, and also to private property near the harbor front; and,

Whereas, an appropriation should be made sufficient to furnish proper compensation for a harbor fire service, for which service the steam tug Fearless is amply equipped.

Your petitioners accordingly pray that your honorable body insert an item in the Appropriation Bill of $10,000, to be made available to the Department of Public Works, for the purpose of contracting for a harbor fire service during the biennial period. And your petitioners ever pray, etc.

Consideration of petition postponed, to be taken up in its proper place in the Appropriation Bill for current expenses, when it shall have been introduced.

BILLS ON THIRD READING.

Consideration of the following Bill, upon its third reading,

was resumed:

H. B. No. 2, by the Committee on Finance, entitled "An Act making appropriations for salaries and pay rolls during the two years which will end with the Thirtieth day of June, A. D. 1903." Mr. Emmeluth moved that the Bill be considered in Committee of the Whole. Lost.

Mr. Makekau moved to amend the following item:

COMMISSION OF PUBLIC LANDS.

9. Pay of Sub-Agent, 2nd Land District

..$1,200 00 by striking out the figures "1,200" and inserting in lieu thereof the figures "3,000".

Mr. Robertson moved that the Bill do pass on its third reading. Seconded by Mr. Ewaliko. On motion of Mr. Makainai, seconded by Mr. Dickey, the matter of salary for Land Agents, 1st and 2nd Land Districts, was referred to a Select Committee. Whereupon the Speaker appointed Messrs. Makekau, Dickey and Prendergast as such Committee.

Mr. Kaniho moved to amend the following item;

DEPARTMENT OF THE ATTORNEY GENERAL.

1. Salary of the Attorney General ..

.$9,000 00 by striking out the figures "9,000" and inserting in lieu thereof the figures "6,000".

Mr. Dickey renewed his amendment reducing the salaries of the Attorney General, Superintendent of Public Works and Treasurer from $9,000.00 to $7,200.00 for the biennial period.

The amendment proposed by Mr. Dickey was lost.

The amendment proposed by Mr. Kaniho was declared lost. Mr. Prendergast questioned the vote. Upon a rising vote being had, the amendment was adopted.

Mr. Prendergast moved an amendment to the following item:

DEPARTMENT OF THE ATTORNEY GENERAL.

2. Salary of the Deputy Attorney General .. .. ..$6,000 00 by striking out the figures "6,000" and inserting in lieu thereof the figures "4,800".

On motion of Mr. Prendergast, the House thereupon stood in recess until 2 o'clock p. m.

BILLS ON THIRD READING.

Consideration of the following Bill, upon its third reading, was resumed:

H. B. No. 2, by the Committee on Finance, entitled "An Act making appropriations for salaries and pay rolls during the two years which will end with the Thirtieth day of June, A. D. 1903."

The Speaker announced that the matter before the House was the salary of the Deputy Attorney General, being Item 2 under the head of Department of the Attorney General.

Mr. Makainai moved an amendment by reducing the amount of each item in Bill to an amount thirty-three and one-third per cent. below the respective figures submitted by the Governor in his estimates.

Mr. Paele moved the previous question, which was thereupon ordered.

The amendment to strike out in Item 2, under the head of the Department of the Attorney General, the figures “6,000” and insert in lieu thereof the figures "4,800" was adopted.

Mr. Prendergast moved that each of the Standing Committees be instructed to thoroughly investigate the needs of the several departments under their supervision, and to report their findings from day to day to the Committee on Finance, in order that the Committee on Finance might recommend to the House such reduction in salaries and pay rolls as would make the total appropriation therefor come within the estimated revenues of the Territory for the ensuing biennial period; and that for this pur pose the House do now adjourn for three days. The motion was seconded by Mr. Emmeluth, and carried. Whereupon the Speaker declared the House adjourned until May 24th.

MESSAGES FROM THE GOVERNOR.

The following message from Honorable Henry E. Cooper, Acting Governor, was read:

To the Legislature of the Territory of Hawaii:

In view of the opinion rendered by the Attorney General to the effect that Act 71 of the Session Laws of 1896, entitled "An Act to provide for Public Loans", is still in force, and that bonds may be legally issued in accordance with the terms of said Act, and it also appearing from the Statement of the Treasurer of the Territory that there still remain unissued bonds to the amount of $799,000.00, authorized by said Act, I recommend the passage of an appropriation bill making special appropriations for the use of the Territory during the succeeding biennial period, out of moneys received from the Treasury out of the loan authorized by Act 71 of the Session Laws of 1896 above referred to, and submit the following estimates, the items of which may be found in the schedule of estimates submitted by the Governor under date of May 8th, 1901.

I recommend the transfer of these items from the Appropriation Bill for current expenses to the Appropriation Bill above referred to; the remaining items of the Governor's estimates to be passed in the Appropriation Bill for current expenses, with the exception of the item of $7,000.00 for construction of roads in Puna, Hawaii, entitled "21 1-2 miles Volcano Road to connect with railroad," which I recommend to be stricken out.
