EVENING SESSION.

House of Representatives, Honolulu, T. H., April 29th, 1901.

The House reconvened at 8:11 o'clock

p. m.

In the absence of the Speaker and the Vice Speaker, the Hon. C. H. Dickey called the House to order, and announced the first business was the election of a Speaker pro tempore. On motion of Mr. Robertson, Mr. Dickey was thereupon elected Speaker pro tempore.

Mr. Prendergast called the Speaker pro tempore's attention to the fact that there was not a quorum present. The Speaker pro tempore ruled that there was a quorum present in the Hall if not actually present in their seats.

PRIVILEGED REPORTS.

Mr. Prendergast, Chairman of the Committee on Enrollment, Revision and Printing, reported the following Bills printed and ready for distribution:

S. B. No. 24, by Mr. Achi, entitled "An Act to repeal Section 806 of the Civil Code, relating to Poll Tax."

S. B. No. 65, by Mr. C. Brown, entitled "An Act to provide for public loans."

S. B. No. 66, by Mr. C. Brown, entitled "An Act authorizing the issue of $1,500,000 of bonds of the Territoy of Hawaii, with interest coupons attached, and to define the purposes for which the money obtained shall be expended."

S. B. No. 70, by Mr. Russell, entitled "An Act to amend Sections 31 and 33 of an Act entitled 'An Act to reorganize the Judiciary Department,' approved the 25th day of November, 1892, being Chapter LVII of the Session Laws of 1892."

S. B. No. 74, by Mr. J. Brown, entitled "An Act to amend Section 710 of Chapter 55 of the Civil Laws, set forth in a compilation made by Sidney M. Ballou, under authority of the Legislature, and published and entitled Civil Laws, relating to Awa."

S. B. No. 84, by Mr. J. Brown, entitled "An Act granting a franchise to construct, maintain and operate an electric railway in the District of Hilo, Island of Hawaii, Territory of Hawaii.'

S. B. No. 85, by Mr. Achi, entitled "An Act to authorize and provide for the construction, maintenance and operation of a steam railway or railways in the Districts of Kau, North and South Kona, and South Kohala, Island of Hawaii."

S. B. No. 92, by Mr. Paris, entitled "An Act providing for the incorporation of the Kona and Kau Railway Company." S. B. No. 93, by Mr. Carter, entitled "An Act to regulate Fiduciary Companies."

S. B. No. 97, by Mr. White, entitled "An Act to amend Act 25 of the Laws of 1898, relating to and concerning vehicles, tires and wheels, by adding a new Section, to be called Section 5A.”

H. B. No. 126, by Mr. Paele, entitled "An Act to provide for the punishment of persons who shall obtain advances under promises or agreement to work, and shall refuse to commence or complete said work.”

On motion of Mr. Makekau, the House thereupon proceeded to the consideration of

BILLS ON SECOND READING.

The following Bill came up for consideration upon its second reading:

S. B. No. 66, by Mr. C. Brown, entitled "An Act authorizing the issue of $1,500,000 of bonds of the Territory of Hawaii, with interest coupons attached, and to define the purposes for which the money was obtained therefrom shall be expended.”

Mr. Robertson moved that the Rule prohibiting smoking in the House be suspended. Seconded by Mr. Wilcox. The vote resulted in a tie, whereupon the Speaker pro tempore declared the motion lost. Mr. Robertson questioned the vote, and, upon a rising vote being had, the motion was lost.

On motion of Mr. Prendergast, seconded by Mr. Paele, S. B. No. 66 was ordered considered section by section.

Section 1 was read. Mr. Robertson moved the Section pass. Seconded by Mr. Kumalae. Carried.

Section 2 was read. Mr. Robertson moved to amend by striking out the words, in lines 2, 3 and 4 thereof, "and authorized by an Act entitled 'An Act to provide for public loans,' approved the day of, 1901." Mr. Ewaliko seconded the motion, which thereupon carried.

Section 3 was read.

Mr. Makekau called the attention of the Speaker pro tempore to the absence of a quorum, whereupon the Speaker pro tempore instructed the Sergeant-at-Arms to bring in the absent members.

The Speaker pro tempore ordered the Clerk to call the roll in order to ascertain the number of members absent. The roll call resulted as follows:

Present---Messrs. Emmeluth, Ewaliko, Gilfillan, Hoogs, Keiki, Kekaula, Keliikoa, Kumalae, Makainai, Makekau, Nailima, Robertson, Wilcox and Mr. Speaker pro tempore--14.

Absent---Messrs. Ahulii, Aylett, Haaheo, Hihio, Kaauwai, Kauimakaole, Kaniho, Kawaihoa, Mahoe, Monsarrat, Mossman, Pacle, Prendergast, Puuki, Mr. Speaker and Mr. Vice Speaker

Mr. Makainai rose to a question of privilege and questioned the right of the Speaker pro tempore to hold the Chair. Whereupon the Speaker pro tempore ruled that at the time he was elected Speaker pro tempore there had been a quorum present. The Speaker pro tempore thereupon issued his warrant for the arrest of all the absent members, and ordered the Sergeant-atArms to find them and bring them before the bar of the House, or, failing to find them, to so report.

By unanimous consent the House thereupon stood in recess, subject to the call of the Chair.

The House reconvened at 9:40 o'clock p. m. Mr. Vice Speaker in the Chair.

The Roll Call was ordered by the Vice Speaker, with the following result:

Present---Messrs. Dickey, Emmeluth, Ewaliko, Gilfillan, Hoogs, Keiki, Kekaula, Keliikoa, Kumalae, Makekau, Nailima, Robertson, Wilcox and Mr. Vice Speaker---14.

Absent---Messrs. Ahulii, Aylett, Haaheo, Hilio, Kaauwai, Kanimakaole, Kaniho, Kawaihoa, Mahoe, Makainai, Monsarrat, Mossman, Paele, Prendergast, Puuki and Mr. Speaker---16.

Whereupon the Vice Speaker announced that there was not a quorum present, and, under the Rules, declared the House adjourned.

The Journal of Proceedings of the preceding day was read. Mr. Kumalae moved that the Journal be approved as read. Mr. Beckley moved to strike out all that part of the Journal after the Vice Speaker took the Chair and declared the House adjourned owing to the absence of a quorum. Seconded by Mr. Dickey. Mr. Robertson called for the ayes and noes upon the motion to strike out. Seconded by Mr. Kumalae. Carried. The ayes and noes were thereupon called, with the following result:

Ayes---Messrs. Ahulii, Beckley, Dickey, Haaheo, Hihio, Kaauwai, Kauimakaole, Kaniho, Kawaihoa, Mahoe, Mossman. Paele, Prendergast and Puuki---14.

Noes---Messrs. Ewaliko, Gilfillan, Hoogs, Keiki, Kekaula, Keliikoa, Kumalae, Makekau, Nailima, Robertson and Wilcox ---11.

Present and not voting---Mr. Speaker---1.

Excused---Messrs. Aylett, Emmeluth and Monsarrat---3.
Absent---Mr. Makainai---1.

Whereupon the Speaker announced that the House had, by its vote, stricken out that portion of the Journal of Proceedings of the preceding day following the adjournment of the House by the Vice Speaker, owing to the absence of a quorum. On motion of Mr. Beckley, the Journal was thereupon approved as corrected.

RESOLUTIONS.

The following Resolution from the Senate was taken up for

consideration:

S. J. R. No. 8, by Mr. Crabbe, declaring certain days to be holidays. Mr. Robertson moved that the Resolution be referred to the Committee on Judiciary. Seconded by Mr. Makekau. Mr. Beckley moved that the Resolution be adopted. Seconded by Mr. Mossman. Motion to commit carried.

BILLS ON FIRST READING.

The following Bills were introduced and read by title: S. B. No. 67, by Mr. White, entitled "An Act to fix the compensation of Pilots for the port of Honolulu." Mr. Dickey moved that the Bill be rejected. Mr. Mossman moved that the
