BILLS ON THIRD READING.

The amendments as proposed by the Honorable Senate to the following Bill were taken up for consideration:

H. B. No. 93, by the Committee on Judiciary, entitled "An Act to provide for the ascertainment and payment of all claims which may be made by persons whose property was destroyed by fire in the years A. D. 1899 and 1900 under orders of the Board of Health." Mr. Dickey moved that the House do now concur in the amendments to the said Bill as proposed by the Honorable Senate. Seconded by Mr. Paele. Upon this motion the ayes and noes were called, with the following result:

Whereupon the Speaker announced that the House had, by its vote, concurred in the amendments to said Bill as proposed by the Honorable Senate.

On motion of Mr. Makekau, seconded by Mr. Monsarrat, the House thereupon proceeded to take up the following Bills for consideration upon their third reading:

H. B. No. 84, by Mr. Beckley, entitled "An Act to authorize and provide for the construction, maintenance and operation of a telephone system upon the streets, alleys, lanes and highways in the City of Honolulu, and elsewhere on the Island of Oahu, Territory of Hawaii, by the Standard Telephone Company, Limited." Mr. Dickey moved that further consideration of the Bill be deferred until it reached its proper place upon the calendar, seconded by Mr. Monsarrat. Mr. Makekau moved that the Bill Mr. Paele moved the previous question, which was thereupon ordered. The motion to postpone was lost. Upon the motion that the Bill do pass, the ayes and noes were called, with the following result:

No. 86, by Mr. Kumalae, entitled “An Act to protect manufacturers, bottlers and dealers in ginger ale, seltzer water, soda water, mineral water and other beverages from the loss of their bottles and boxes." Mr. Kumalae moved that the Bill do pass, upon which motion the ayes and noes, were called, with the following result:

MESSAGES FROM THE GOVERNOR.

The following communication from the Governor, written upon society note paper, was read:

To the Honorable Joseph A. Akina,

Speaker of the House of Representatives:

Sir: The Resolution of the House requesting an extension of the present legislative session for an additional period of thirty days, on the ground of unfinished legislation, has been received from your Special Committee.

The conduct of the present session of the Legislature offers no assurance, so far, that such extension would tend to promote the interests of the Territory, but raises in my mind strong doubts to the contrary.

I have recently refused a request from the Senate for an extension of the session---such request being based upon similar grounds to those expressed from the House Resolution. I find no reason now for coming to a different conclusion. Very respectfully yours,

RESOLUTIONS.

Under a suspension of the Rules, the following Resolutions were introduced:

H. R. No. 136, by Mr. Kauimakaole, authorizing the members of the House to appropriate to their own use upon adjournment all law books and statonery now in their possession. Mr. Kumalae moved the Resolution be adopted. While the Resolution was pending, the following Resolution was introduced:

H. R. No. 137, by Mr. Monsarrat, offering the services of the members of the House of Representatives to the Territory free of compensation during the special session. Mr. Monsarrat moved that the Resolution be adopted. Seconded by Mr. Robertson. Mr. Mahoe moved to table the Resolution. Seconded by Mr. Kumalae, and carried.

A motion of Mr. Robertson, which had been temporarily withdrawn to hear the communication from the Governor, that the House stand in recess until half-past 1 o'clock, was thereupon

carried.

AFTERNOON SESSION.

House of Representatives, Honolulu, T. H., April 27th, 1901. Mr. Speaker

The House reconvened at 1:42 o'clock p. m.

in the Chair.

Mr. Monsarrat called the Speaker's attention to the fact that there was not a quorum present, and moved that the House do now adjourn. The motion was put and declared carried. Mr. Robertson questioned the vote. Upon a rising vote being had, the motion prevailed.

The House thereupon adjourned.

which passed its third reading in the Senate on the 25th day of

I have the honor to herewith transmit House Bill No. 59, which duly passed its third reading in the Senate this day, with the following amendments:

In Section 1, after the word "year", at the end of the Section, add the words "from May 23rd, 1903".

After Section 5 add a new Section:

"Section 6. And it is further provided that said Theodore Hoffman and John Markham, doing business together as the Oahu Ice and Electric Company, hereinafter called The Company', and their respective successors and assigns shall pay into the office of the Treasurer of the Territory of Hawaii on the 1st day of January of each year two and a half per cent. of the gross receipts derived from the sale of light and power, and upon failure to make said payments, this franchise shall be void."
