On motion of Mr. Mossman, seconded by Mr. Prendergast, the translation of the Governor's message into Hawaiian was dispensed with.

The House then, on motion of Mr. Mossman, stood in recess until 1:30 o'clock p. m.

Notice was given of intention to introduce the following

By Mr. Gilfillan, entitled "An Act to provide for a Commission to take evidence concerning injuries to property caused by the action of the Board of Health in connection with the suppression of bubonic plague in Honolulu and elsewhere in this Territory, and by the conflagration in Honolulu on January 20th, 1900, and report thereon."

RESOLUTIONS.

The following Resolution was introduced:

H. R. No. 5, by Mr. Robertson, asking that the Sergeant-atArms be instructed to supply the Members with copies of the Civil Laws of 1897, Penal Laws of 1897, and the Session Laws of 1898. Seconded by Mr. Makekau and adopted.

Mr. Robertson called to the attention of the Speaker that the Rules provided for five members each of the Standing Commit

tees.

The Speaker acknowledged his error and stated that he would later comply with the Rules.

Mr. Emmeluth then moved to return to the consideration of the Rules. Carried. On motion of Mr. Dickey, seconded by Mr. Emmeluth, Rule 88 was suspended by unanimous consent as provided for in Rule 89. A motion by Mr. Mahoe to consider the Rules section by section was ruled out of order.

Mr. Emmeluth then moved that a Committee on Miscellany be added to the list of Standing Committees. Seconded by Mr. Dickey and carried.

Mr. Emmeluth moved to insert the words "counsel may be employed" in line 6 of Rule 37. Seconded by Mr. Dickey. Mr. Emmeluth's amendment was voted upon and carried.

Mr. Emmeluth moved to strike out the last sentence in the fourth paragraph of Rule 40. Mr. Robertson moved to amend the same sentence by striking out the words "on motion" and insert the word "not" in lieu thereof. Mr. Emmeluth accepted the amendment and moved a further amendment by substituting "shall" for "may", so that the sentence should read as amended: "The House shall not vote upon any other question by ballot." The section was then passed as amended.

Mr. Emmeluth moved to strike out the word "three-fifths" in line 4 of Rule 50. Mr. Robertson moved that the aves and noes be called on the adoption of the amendment. Carried. The ayes and noes were thereupon ordered, with the following result:
