Sir: I have the honor to inform you that the Governor has this day signed Act 10, entitled "An Act relating to the appointment of Bailiffs for certain Courts in the Territory of Hawaii and defining the duties and powers of such Bailiffs and fixing the amount of their compensation; and providing for the payment of such compensation."

BILLS ON THIRD READING.

The following Bill was taken up for consideration upon its third reading:

H. B. No. 86, by Mr. Kumalae, entitled "An Act to protect manufacturers, bottlers and dealers in ginger ale, seltzer water, soda water, mineral water and other beverages from the loss of their bottles and boxes." Mr. Dickey moved that the Bill do

pass.

Mr. Makekau moved that the House do now adjourn. Mr. Prendergast moved that the House do now stand in recess until 7 o'clock p.m. Carried.

BILLS ON SECOND READING.

Mr. Beckley moved that the Rules be suspended in order that the House might deviate from the order of the day. Seconded by Mr. Mossman. Carried. Mr. Emmeluth moved that the House proceed to the consideration of the following Bill upon its second reading. Seconded by Mr. Nailima. Carried.

II. B. No. 75, by Mr. Nailima, entitled "An Act providing a system of taxation for the Territory of Hawaii, and repealing all laws heretofore passed and in force relating to taxation." Mr. Dickey moved that the Bill be laid upon the table. Seconded by Mr. Wilcox. Lost. Mr. Beckley moved that the Bill be read section by section. Seconded by Mr. Paele. Carried.

Section 1 was read and, on motion of Mr. Emmeluth, passed. Section 2 was read and, on motion of Mr. Beckley, seconded by Mr. Dickey, was amended by striking out, in line 9 thereof. after the word "added", the words "on the first day of each month. thereafter an additional penalty of one per centum shall be added to the original tax until date of sale or payment." Whereupon the Section passed.

Section 3 was read and, there being no objection, it was declared passed.

Section 4 was read and, there being no objection, it passed. Mr. Makekau moved that the first eighteen Sections pass. Lost.

Sections 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22 and 23 were read and, there being no objection, passed.

Section 24 was read and, on motion of Mr. Emmeluth, was amended by striking out the words "nor shall any mechanical procedure", in line 2 thereof, all of line 3 thereof, and all the words in line 4 thereof, except the last word, and by inserting in line 5 thereof, after the word "machinery" and before the word "shall", the words "such as a fodder cutter". Whereupon the Section passed as amended.

Sections 25, 26 and 27 were read and, there being no objection, passed.

Section 28 was read and, on motion of Mr. Emmeluth, amended by inserting, in line 4 thereof, after the words “company shall" and before the words "be permitted", the word "not". Speaker called the Vice Speaker to the Chair. Section 29 was read and, on motion of Mr. Makekau, seconded by Mr. Kaniho, was stricken out.

Sections 30 and 31 were read and, there being no objection,

passed.

Section 32 was read. Mr. Robertson moved that the Section be stricken out. Seconded by Mr. Dickey. Lost. Lost. Mr. Dickey moved to strike out all the words in the Section after the word "tax", in line 8 thereof. Mr. Mahoe moved to strike out the entire Section. Seconded by Mr. Mossman. Carried.

Section 33 was read and, on motion of Mr. Emmeluth, was amended by striking out, in line 10 thereof, the word "Circuit" and inserting in lieu thereof the word "Supreme". Whereupon the Section passed as amended.

Mr. Makekau moved that the House do now adjourn. The motion was put and declared carried. Mr. Monsarrat called for a division, and, upon a rising vote being had, the motion carried. The House thereupon adjourned.

The following communications from the Honorable Senate were read:

I have the honor to transmit herewith House Bill No. 93, which duly passed its third reading in the Senate this day with the following amendments:

In Section 1, line 1, strike out "three" and inert "five".

In Section 10, add at the end thereof the following: "And said appropriation of $1,500,000.00 to be distributed over a period of three years, at a rate not to exceed $500,000.00 per year". "In payment of the awards or judgments, the Treasurer is hereby ordered to pay all awards and judgments pro rata at all

times."

In Section 16, "Thirteen thousand, eight hundred" was changed to "Seventeen thousand, four hundred", and the figures “4,500.00❞ were changed to "$9,000.00" to conform to the amendment in Section 1, line 1.
