The Speaker announced the following as the members of the Select Committee ordered appointed yesterday for auditing the accounts of the Military Department, mustering out the Citizens' Guard and disposing of their arms, ammunition and accoutrements: Messrs. Emmeluth, Mossman and Makainai.

An invitation was read from the Young Men's Research Club, Honolulu, inviting the House to attend a meeting of the Club April 26th.

BILLS ON THIRD READING.

The following Bill was taken up for consideration upon its third reading:

H. B. No. 94, by Mr. Makainai, entitled "An Act to extend School Street from Liliha Street to Kamehameha IV Road, in the District of Honolulu, Island of Oahu, and to make appropri ation for said extension." Mr. Prendergast moved the Bill do pass. Mr. Robertson moved to amend by striking cut all of Section 2 thereof, and the first and third line of Section 3 thereof, and by renumbering the remaining part of Section 3, and the succeeding Section in conformity with the amendment. The amendment was declared adopted. Mr. Mossman questioned the vote, and upon a new vote being taken, the amendment was adopted. Mr. Robertson moved to amend by striking out in Section 1, and lines 2 and 3 thereof, all the words in said Section after the word "survey", and substituting in lieu thereof the words "set forth in Section 2". The amendment was adopted. Mr. Robertson moved that the Bill do pass. Seconded by Mr. Monsarrat, upon which motion the ayes and noes were called, with the following result:

Ayes---Messrs. Ahulii, Aylett, Beckley, Dickey, Emmeluth, Ewaliko, Gilfillan, Haaheo, Hoogs, Kaauwai, Kauimakaole, Kaniho, Kawaihoa, Kekaula, Keliikoa, Kumalae, Mahoe, Makainai, Makekau, Monsarrat, Mossman, Nailima, Paele, Prendergast, Puuki, Robertson and Mr. Speaker---27.

Noes---None.

Absent---Messrs. Hihio, Keiki and Wilcox---3.

Whereupon the Speaker announced that the said Bill, having received the affirmative votes of a majority of all the members elected to the House, had passed the House.

On motion of Mr. Kaniho, the House thereupon adjourned.

REPORTS AND COMMUNICATIONS FROM

HEADS OF DEPARTMENTS.

The following communication was received from the Superintendent of Public Works in answer to

H. R. No. 104, by Mr. Beckley, asking for a survey of the proposed extension of Vineyard Street to Kamehameha IV Road through the Kamehameha School premises, transmitting a blue print of the route of such proposed extension to the boundaries of Kamehameha School, but not through the premises. On motion of Mr. Beckley, seconded by Mr. Ewaliko, the Clerk was instructed to ask the Superintendent of Public Works for a survey of the road entirely through the Kamehameha School premises in accordance with the terms of the original Resolution.

REPORTS OF STANDING COMMITTEES.

The following reports of Standing Committees were presented:

On S. B. No. 23, by Mr. C. Brown, entitled "An Act to amend Section 215 of the Penal Laws, relating to the illegal marking of live stock," from Mr. Emmeluth, Chairman of the Committee on Judiciary, recommending the following amendments, and that with these amendments the Bill do pass:

By striking out in the title the words "Section 215 of the Penal Laws" and inserting in lieu thereof the words "Chapter XXV of the Penal Code," also the same amendment to Section 1, in line 1 thereof. Consideration postponed, to be taken up with the Bill.

On H. R. No. 109, by Mr. Monsarrat, instructing the Superintendent of Public Works to notify the Rapid Transit Company to cease within six hours obstructing the streets of Honolulu, and to hereafter conform to the terms of their franchise, from Messrs. Emmeluth, Paele, Haaheo and Keliikoa, a majority of the Committee on Judiciary, reporting their findings at length, and reeommending: 1---That the Rapid Transit Company be made to conform strictly to the terms of its franchise in the construction of its road bed; 2---That they be compelled to pay their propor tionate share for street improvements, as contemplated by their franchise; 3---That Section 342 of the Penal Code be repealed. and that building permits be issued only in a manner that will not obstruct the traffic of the streets and sidewalks. Also a report from Mr. Robertson, a minority of the Committee, concurring in the recommendations, but not concurring in the findings of the majority. The majority report was adopted.

On H. B. No. 111, by Mr. Nailima, entitled "An Act for the relief of Antone G. Serrao," from Mr. Beckley, Chairman of

the Committee on Public Health and Education, recommending that the Bill be laid upon the table.

The Speaker called the Honorable Mr. Beckley, Vice Speaker, to the Chair.

Mr. Haaheo moved to adopt the report. Mr. Prendergast moved to postpone consideration, to be taken up with the Bill. The motion to postpone carried.

Mr. Beckley, Chairman of the Committee on Public Health and Education, presented a communication from the Board of Health, requesting the passage of appended Bill to prevent the spread of small-pox and other diseases. The Bill was ordered referred back to the Committee on Public Health and Education.

On Petition No. 86, from the Chamber of Commerce, Honolulu, asking for an extension of the fire limits, from Mr. Makainai, Chairman of the Committee on Public Lands and Internal Improvements, recommending that consideration be postponed until the attitude of the Executive can be obtained upon the Bill now under consideration, H. B. No. 105, by Mr. Makainai, entitled "An Act to prevent the storage of lumber within the fire limits of the City of Honolulu." Mr. Mahoe moved that consideration of the report be postponed, to be taken up with the Bill. Mr. Emmeluth moved an amendment that consideration be postponed until the Executive can be heard from relative to the disposition of the Bill mentioned in the report. Seconded by Mr. Monsarrat. Mr. Mahoe accepted the amendment. The motion to postpone consideration was thereupon carried.

The following Bills came up for consideration upon their second reading:

S. B. No. 56, by Mr. J. Brown, entitled "An Act to amend Sections 54 and 55 of 'An Act to reorganize the Judiciary Department,' approved the 25th day of November, 1892, being Chapter LVII of the Session Laws of 1892," upon report from Mr. Emmeluth, Chairman of the Committee on Judiciary, recommending that the Bill do pass. Mr. Mahoe moved that the report be adopted. Seconded by Mr. Mossman. Carried. Whereupon the Speaker announced that the House had, by its adoption of the report of the Committee, passed the said Bill on its second reading. On motion of Mr. Dickey, the Bill was ordered typewritten and placed on the order of the day for April 26th.

S. B. No. 17, by Mr. C. Brown, entitled "An Act to amend Section 986 of the Penal Laws, relating to the protection of the places of sepulture," from Mr. Emmeluth, Chairman of the Con

mittee on Judiciary, recommending an amendment by striking out the words "Section 986 of the Penal Laws,, and inserting in lieu thereof the words "Chapter LXI of the Penal Code," and the same amendment in Section 1, and line 1 thereof, and that with these amendments the Bill do pass. On motion of Mr. Dickey, the report was adopted. Whereupon the Speaker announced that the House had, by its adoption of the report of the Committee, passed the said Bill on its second reading.

H. B. No. 86, by Mr. Kumalae, entitled "An Act to protect manufacturers, bottlers and dealers in ginger ale, seltzer water, soda water, mineral water and other beverages from the loss of their bottles and boxes," upon a report from Mr. Emmeluth, Chairman of the Committee on Judiciary, recommending that the Bill do pass. On motion of Mr. Kumalae, the report was adopted. Whereupon the Speaker announced that the House had, by its adoption of the report of the Committee, passed the Bill upon its second reading. On motion of Mr. Kumalae, the Bill was ordered typewritten and placed on the order of the day for April 26th.

H. B. No. 103, by Mr. Makainai, entitled "An Act regulating plumbing, house drainage, cesspools, and the registration of plumbers in the City of Honolulu, Oahu, Territory of Hawaii," upon a report from Mr. Makainai, Chairman of the Committee on Public Lands and Internal Improvements, recommending the following amendments: By the insertion of the usual ratifying Section, to be numbered Section 58, as follows:

"Section 58. This Act shall take effect from and after the date of its approval."

That the salary of the Inspector General be $1,800.00 per annum, and that of the Assistant Inspector $1,200.00. And that with said amendments the Bill do pass. Mr. Kumalae moved to adopt the report. Carried. Whereupon the Speaker announced that the House had by its adoption of the report passed the Bill upon its second reading. On motion of Mr. Kaniho, the Bill was ordered typewritten and placed upon the order of the day for April 26th.

REPORTS OF SELECT COMMITTEES.

The following reports of Select Committees were presented: By Mr. Dickey, a member of the Minority of the Select Joint Committee on Taxation, recommending certain special legislation for revenue purposes. Consideration postponed, to await the Majority Report.
