Notice was given of intention to introduce the following Bills:

By Mr. Keliikoa, entitled "An Act to provide for the regulation of the strength of coffee by degrees and also to strictly prohibit the adulteration of the same."

By Mr. Mahoe, entitled "An Act to regulate the claims of damages of those unlawfully imprisoned in 1895."

By Mr. Mahoe, entitled "An Act to regulate the granting of licenses of hack drivers."

By Mr. Mahoe, entitled "An Act to appoint an Assistant Clerk and separate Interpreters for the District Court of Honolulu."

By Mr. Mahoe, entitled "An Act to repeal the Act No. 13 of the Session of 1898, and to revise Section 1308 of Civil Law." By Mr. Mahoe, entitled "An Act to revive adverse possession rights on premises."

BILLS ON SECOND READING.

The following Bills were taken up for consideration upon their second reading:

H. B. No. 65, by Mr. Beckley, entitled "An Act creating the office of Transportation Commissioner, fixing his salary and defining his duties, and duties of common carriers, and providing penalties for violation thereof, and repealing all laws in conflict herewith." On motion of Mr. Makekau, the Bill was referred to the Committee on Public Lands and Internal Improvements.

H. B. No. 82, by Mr. Robertson, entitled "An Act to provide for the promulgation of the laws." Mr. Robertson moved that the Bill do pass. Carried. Mr. Dickey moved that the Bill be typewritten and placed upon the order of the day for April 15th. Carried.

H. B. No. 83, by Mr. Mossman, entitled "An Act to authorize the Hawaiian Fuel Gas Company to exercise certain rights in Honolulu." On motion of Mr. Dickey, the Bill was referred to the Committee on Judiciary.

H. B. No. 93, by the Committee on Judiciary, entitled "An Act to provide for the ascertainment and payment of all claims which may be made by persons whose property was destroyed by fire in the years A. D. 1899 and 1900 under orders of the Board

of Health." Mr. Robertson moved to refer the Bill to the Committee on Judiciary. Mr. Makekau moved to refer the Bill to a Select Committee of five members. The motion to commit to a Select Committee carried.

RESOLUTIONS.

The following Resolution was introduced:

H. R. No. 110, by Mr. Emmeluth, relating to quarantine wharf, Honolulu. On motion of Mr. Dickey, the Resolution was adopted.

The House thereupon adjourned.

The Journal of Proceedings of April 12th was read and approved.

The Journal of Proceedings of April 13th was read. Mr. Paele moved to strike out the Journal of April 13th, inasmuch as there had been no opening prayer and no roll call, nor reading of Journal of Proceedings of the preceding day. The Speaker had declared the House adjourned, owing to the absence of a quorum. The motion was seconded by Mr. Mahoe. Mr. Ewaliko moved to adopt the Journal of April 13th. Seconded by Mr.

Makekan. Mr. Kauimakaole moved the previous question, which was thereupon ordered. Mr. Kumalae called for the ayes and noes upon the motion to strike out the Journal of April 13th from the records of the House. Upon this motion the ayes and noes were ordered, with the following result:

A communication from the Superintendent of Public Works was read:

In re H. R. No. 101, by Mr. Ahulii, relating to lands taken for road purposes in Kula, Makawao, Maui, and stating it was impossible to furnish the information, owing to the death of one D. P. Eldridge, employed in investigating these matters, and the lack of appropriations to prosecute the work since then. Referred to the Committee on Public Lands and Internal Improve

ments.

PETITIONS, MEMORIALS AND COMMUNI

CATIONS.

The following Petitions were presented:

Petition No. 74, by Mr. Mahoe, from the Second Precinct, Fifth District, Oahu, relating to residence of members of Road Boards. Referred to Committee on Public Lands and Internal Improvements.

Petition No. 75, by Mr. Kekaula, from residents of HonoluIn, asking for an appropriation of $10,000 to extend Queen Referred to Committee on Public Lands and

street to Kalihikai.

Internal Improvements.

Petition No. 76, by Mr. Beckley, from one hundred and ten residents of Honolulu, asking for an enactment of laws regulating the Board of Health. Referred to the Committee on Public Health and Education.

Petition No. 77, by Mr. Keliikoa, asking for an appropriation for court house and jail at Kona, Hawaii. Referred to the Committee on Public Lands and Internal Improvements.

REPORTS OF STANDING COMMITTEES.

The following reports of Standing Committees were presented:

On H. B. No. 65, by Mr. Beckley, entitled "An Act creating the office of Transportation Commissioner, fixing his salary and defining his duties, and duties of common carriers, and providing penalties for violation thereof, and repealing all laws in conflict herewith," from Mr. Makainai, Chairman of the Committee on Public Lands and Internal Improvements, recommending that the Bill do pass. Mr. Gilfillan of the Committee endorsed the Report: "I do not concur." Consideration of the Report was postponed, to be taken up with the Bill.

On H. B. No. 71, by Mr. Makekau, entitled "An Act for the regulating and conducting of games of chance at which or other articles of value may be lost or won," from Mr. Makainai, Chairman of the Committee on Public Lands and Internal Improvements, recommending the question, "Does the word lottery', as stated in the Act providing a Government for the Territory of Hawaii, Section 55, include all games of chance, such as stated in the Bill?" be referred to the Attorney General: and that, if the Attorney General's reply were favorable, the Committee recommended that the Bill do pass. Mr. Gilfillan endorsed his nonconcurrence at the close of the report. On motion of Mr. Beckley, the Clerk was instructed to forward to the Attorney General the question propounded by the Committee.

REPORTS OF SELECT COMMITTEES.

The following Report of Select Committee was presented: On H. R. No. 90, by Mr. Kumalae, relative to the appointment of a Special Committee to investigate the charges against Legislators, contained in an issue of Ke Aloha Aina, reporting that the Editor of said paper had filed his written apology, acknowledging that his editorial had been written upon misinformation. The Report of the Committee was adopted.

On motion of Mr. Makekau, the House proceeded to the order of the day.

BILLS ON THIRD READING.

The following Bills were taken up for consideration upon their third reading:

H. B. No. 19, by Mr. Robertson, entitled "An Act relating to the sale of alcohol; amending Section 15 and repealing Sections 10, 13 and 14 of Act 64 of the Session Laws of 1896." Mr. Robertson moved that the Bill do pass. Seconded by Mr. Kumalae. Mr. Mossman moved that consideration of the Bill be indefinitely postponed. The motion to indefinitely postpone was lost. Upon the motion to pass the Bill on its third reading, the ayes and noes were called, with the following result:

Ayes-Messrs. Aylett, Beckley, Dickey, Emmeluth, Ewaliko, Gilfillan, Hoogs, Keiki, Kekaula, Keliikoa, Kumalae, Makainai, Monsarrat, Prendergast, Robertson, Wilcox and Mr. Speaker--17.

Noes---Messrs. Ahulii, Haaheo, Hihio, Kaauwai, Kauimakaole, Kaniho, Kawaihoa, Mahoe, Makekau, Mossman, Nailima, Paele and Puuki---13.

Whereupon the Speaker announced that the said Bill, having received the affirmative votes of a majority of all the members elected to the House, had passed the House.

H. B. No. 59, by Mr. Gilfillan, entitled "An Act to authorize and regulate the placing of electric wires and poles of Oahu Ice and Electric Company in the streets of Honolulu and elsewhere on the Island of Oahu." Mr. Dickey moved to insert a new Section, to be numbered Section 6, after present Section 5 and before Section 6, to read as follows:

"Section 6. That the said Company shall pay 24% on its gross receipts for the privileges granted it, which rate may be raised by the Legislature at any session hereafter."

Mr. Kumalae moved to amend the amendment by inserting the words "per annum" after the characters "24%". Mr. Dickey accepted the amendment to the amendment. The amendment, as amended, was thereupon put and declared lost. Mr. Dickey questioned the vote. The Speaker again declared the amendment lost. Mr. Robertson questioned the count. A second rising vote was had, resulting with: Ayes---13; Noes---14. Whereupon the Speaker declared the amendment lost. Mr. Robertson then moved that consideration of the Bill be indefinitely postponed. The motion was put and lost. The ayes and noes being called upon the motion that the Bill pass its third reading, the result was as follows:

Ayes---Messrs. Ahulii, Beckley, Ewaliko, Gilfillan, Haaheo, Hihio, Hoogs, Kauimakaole, Kaniho, Kawaihoa, Kekaula, Keliikoa, Mahoe, Makainai, Paele, Prendergast, Puuki and Mr. Speaker--18.
