On motion of Mr. Emmeluth, consideration of the communication was postponed, to be taken up with the Appropriation Bill.

The House reconvened at 2:08 o'clock p. m. Mr. Speaker in the Chair.

BILLS ON SECOND READING.

The following Bills were taken up for consideration upon their second reading:

H. B. No. 59, by Mr. Gilfillan, entitled "An Act to authorize and regulate the placing of electric wires and poles of Oahu

Ice and Electric Company on the streets of Honolulu and elsewhere on the Island of Oahu." Mr. Dickey moved that the Bill be read by title. Mr. Kaniho moved that the Bill be read section by section and so considered. The motion to consider section by section was carried.

Section 1 was read and Mr. Gilfillan moved that the section pass. Seconded by Mr. Emmeluth. The motion was put and lost. Mr. Makekau moved to reconsider the vote upon which Section 1 was lost. Carried. Mr. Makekau moved to reconsider the vote upon which the Bill was ordered considered section by section. Seconded by Mr. Paele and carried. Mr. Makekau moved that the Bill be read through. Carried. The Bill having been read through, on motion of Mr. Mahoe, the Bill was referred to the Committee on Public Lands and Internal Improvements.

H. B. No. 60, by Mr. Mossman, entitled "An Act relating to the time within which all wires used for telegraph, telephone or for the purpose of operating street railways, or for lighting in cities and towns of every two thousand population shall be placed not less than two feet underground." On motion of Mr. Mossman, the Bill was read a second time by its title. Mr. Mossman moved that the Bill pass second reading. Mr. Monsarrat moved that the Bill be referred to the Committee on Public Lands and Internal Improvements. The motion was seconded by Mr. Hoogs and carried.

H. B. No. 61, by Mr. Kawaihoa, entitled "An Act to amend the title of Chapter LXII of the Penal Laws as compiled in A. D. 1897, and Sections 987, 989 and 990 of the said Penal Laws." On motion of Mr. Paele, the Bill was read by its title. On motion of Mr. Makekau, the Bill passed its second reading by a unanimous vote. On motion of Mr. Kawaihoa, the Bill was ordered typewritten and made the order of the day for April 4th.

11. B. No. 67, by Mr. Ewaliko, entitled "An Act to permit any person to treat leprosy without license." On motion of Mr. Ewanko, the Bill was read by title. Mr. Kaniho moved that the Bill do pass. Mr. Dickey moved that the Bill be referred to the Committee on l'ublic Health and Education. The motion to commit was carried.

PRIVILEGED REPORTS.

Mr. Prendergast, Chairman of the Committee on Enrollment, Revision and Printing, reported the following Senate Bills printed and ready for distribution:

S. B. No. 10, by Mr. C. Brown, entitled "An Act to amend Section 68 of the Penal Laws, relating to the punishment of the

offense of deforming the feet of girls under the age of eighteen years."

S. B. No. 13, by Mr. C. Brown, entitled "An Act amending Section 182 of the Penal Laws, relating to gross cheat."

S. B. No. 14, by Mr. C. Brown, entitled "An Act to amend Section 174 of the Penal Laws, relating to the offense of receiving stolen goods."

S. B. No. 33, by Mr. Kanuha, entitled "An Act to protect laborers and employees from extortion."

BILLS ON THIRD READING.

H. B. No. 56, by the Committee on Judiciary, entitled “An Act to regulate the employment of labor on the Public Works of this Territory," came up for consideration on its third reading, the same being a substitute for H. B. No. 21, by Mr. Hihio, entitled "An Act to provide that only American citizens and qualified voters of the Territory of Hawaii shall be employed on Public Works," and for H. B. No. 22, by Mr. Hihio, entitled "An Act to provide that eight hours shall constitute a legal day's work, either mechanical or industrial."

The Bill was read through, whereupon Mr. Dickey moved to amend Section 1 by adding thereto the following words: "Provided, that in case the work of the Government is seriously impeded by the employment of citizens only, it shall be in the power of the Superintendent of Public Works or the several Road Boards to employ other labor." Mr. Dickey's amendment was seconded by Mr. Wilcox.

Mr. Makekau moved to amend Section 1 by inserting at the beginning of Section 1, in the first line thereof, the following words, to wit: "No person shall hold Government office in this Territory and".

Mr. Beckley moved that the Bill pass its third reading. Mr. Makainai moved to amend Section 1 by striking out in line 1 thereof the words "as a laborer or mechanic". Mr. Beckley suggested an amendment to Mr. Makainai's amendment by inserting after the word "person" and before the word "shall" in line 1 of said section the words "except specialists and scientific experts", which amendment was accepted by Mr. Makainai and incorporated in his amendment.

The Sergeant-at-Arms announced a communication from the Executive Chamber.

Mr. Robertson seconded Mr. Beckley's motion that the Bill do pass as reported from the Committee. The amendment proposed by Mr. Dickey was put and lost. The amendment proposed by Mr. Makekau was put and carried. The question of the adop

tion of the motion of Mr. Makainai being then pending, Mr. Kumalae moved to amend the amendment by adding the words "and Court Interpreters" after the word "experts" in said proposed amendment. Mr. Makekau moved the previous question, which was thereupon ordered. The amendment to the amendment proposed by Mr. Kumalae was adopted. On motion of Mr. Makekan, the Bill was ordered typewritten and placed on the order of the day for April 4th.

NOTICES OF BILLS.

Under a suspension of the Rules, notice was given of intention to introduce the following Bills:

By Mr. Emmeluth, entitled "An Act to amend Section 10 and 12, Act 45, of the Session Laws of 1896."

By Mr. Prendergast, entitled "An Act to authorize and provide for the construction, operation and maintenance of a street railway or railways in the District of Honolulu, Island of Oahu, Territory of Hawaii, by the Hawaiian Tramways Company, Limited."

REPORTS AND COMMUNICATIONS FROM

HEADS OF DEPARTMENTS.

Under a second suspension of the Rules, the following communications were read:

From the Department of Public Works, in relation to H. R. No. 52, by Mr. Emmeluth, concerning Diamond Head Road, Honolulu. Referred to the Committee on Public Lands and Internal Improvements.

From the Department of Public Works, in relation to H. R. No. 74, introduced by Mr. Gilfillan, concerning the ownership of Naval Wharf No. 1, Honolulu, declining to furnish the information on the ground that the matter was still the subject of correspondence between the Department and the United States officials. The communicaion was referred to the Committee on Public Lands and Internal Improvements.

From the Attorney General in relation to H. R. No. 70, by Mr. Monsarrat, concerning the removal of Judge Moanauli of Honokaa, Hawaii. Consideration of the communication was postponed, to be taken up when the balance of the information in relation thereto should be furnished the House as promised by the Attorney General.
