H. B. No. 78, by Mr. Emmeluth, entitled "An Act requiring directors or other officers having the management of every joint stock company to keep true accounts of the business of the company, and providing for the audit of such accounts."

RESOLUTIONS.

The following Resolutions were introduced:

H. R. No. 85, by Mr. Hihio, relating to the appropriation of $26,500.00 for constructing water pipes, Lahaina, Maui. Consideration postponed, to be taken up with Appropriation Bill.

H. R. No. 86, by Mr. Beckley, relating to the appointment of a Committee to escort the Honorable Senate to the Hall of the House of Representatives at the hour appointed for a Joint Session in S. C. R. No. 2, by Mr. White, entitled "A Concurrent Resolution providing for a joint session of the Senate and House of Representatives for the purpose of electing and apportioning eight Senators from among the members of the Senate for the term and period of four years." On motion of Mr. Robertson, seconded by Mr. Dickey, the Resolution was tabled. Mr. Mahoe demanded a division, which was had, and the Resolution was again declared tabled.

THE ORDER OF THE DAY.

H. B. No. 56, by the Committee on Judiciary, entitled "An Act to regulate the employment of labor on the public works of this Territory," being a substitute for H. B. No. 21, by Mr. Hihio, entitled "An Act to provide that only American citizens and qualified voters of the Territory of Hawaii shall be employed in public works," and H. B. No. 22, by Mr. Hihio, entitled "An Act to provide that eight hours shall constitute a legal day's work, either mechanical or industrial," came up for passage on its third reading.

Mr. Dickey moved an amendment to Section 1 by adding at the end thereof the words: "Provided, however, that it shall be lawful to employ other persons in cases where it is impracticable to obtain citizens of the United States to perform such work." Seconded by Mr. Robertson. On motion of Mr. Beckley, consideration of the Bill was postponed until April 1st.

The hour having nearly arrived at which the House and Senate were to convene in Joint Session, on motion of Mr. Beckley the House stood in recess.

JOINT SESSION.

Hall of the House of Representatives,

Honolulu, T. H., March 30th, 1901.

At 11:02 o'clock a. m. the Senate and House of Representatives of the Territory of Hawaii convened in joint session in the Hall of the House for the purpose of electing and apportioning eight Senators from among the members of the Senate for the term and period of four years, pursuant to the provisions of the following Concurrent Resolution, adopted by the Senate March 25th and concurred in by the House the same day, A. D. 1901:

S. C. R. No. 2, by Mr. White, entitled "Concurrent Resolution providing for a joint session of the Senate and House of Representatives for the purpose of electing and apportioning eight Senators from and among the members of the Senate for the term and period of four years."

Be It Resolved by the Senate of the Legislature of the Territory of Hawaii, the House of Representatives Concurring: That on the 30th day of March, A. D. 1901, the members of the Senate and the members of the House of Representatives do convene in Joint Session in the Chamber of the House of Representatives at the hour of eleven of the clock in the forenoon of said day, with the President of the Senate presiding over such Joint Session, and the Clerk of the House of Representatives and the Secretary of the Senate acting as Clerks of said Joint Session; and

That the Senate and the House of Representatives in Joint Session aforesaid shall, directly upon being called to order by the presiding officer aforesaid of said Joint Session, proceed to nominate and elect two members of the Senate from the First Senatorial District, who shall hold their respective offices as Senators for the period and term of four years; two members of the Senate from the Second Senatorial District, who shall hold their respective offices as Senators for the term and period of four years; three members of the Senate from the Third Senatorial District, who shall hold their respective offices as Senators for the period and term of four years; and one member of the Senate from the Fourth Senatorial District, who shall hold his office as Senator for the term and period of four years.

That the nomination of all such Senators shall be rira voce and the vote thereon shall be riva roce by aye and nay on the roll call of the Senate by the Secretary thereof and of the House of Representatives by the Clerk thereof, respectively. The said Joint Session may adjourn from time to time and for such length

of time as may be necessary until the election of the several Senators aforesaid is completed. The Senators who receive a majority of all the votes of the Joint Session, a majority of all the members elected to both Houses being present, shall be duly elected; provided, that the vote shall be taken so as to elect only one Senator at a time; and

Be It Further Resolved by the Senate Aforesaid, the House of Representatives Concurring: That the Senators so elected, as provided in the preceding Resolution, be respectively declared, assigned and apportioned to the Senatorial term of four years in conformity with Section Thirty of An Act of the Fifty-sixth Congress of the United States, approved on the 30th day of April, 1900, and entitled "An Act to provide a Government for the Territory of Hawaii." And that the eight Senators elected as above provided shall severally be furnished with a certificate of apportionment signed by the presiding officer and the clerks of said Joint Session aforesaid, which certificate shall entitle said Senators to hold their respective offices for the term of four years;

and

Be It Further Resolved by the Senate Aforesaid, the House of Representatives Concurring: That a copy of these Resolutions and the proceedings of the Senate aforesaid and the House of Representatives aforesaid in Joint Session as provided in the foregoing Resolutions be entered at large upon the Journal of the Senate and the Journal of the House of Representatives respectively.

Kumalae, of the House. The ayes and noes were thereupon ordered, with the following result:

Mr. C. Brown, of the Senate, moved that the Concurrent Resolution by the provisions of which this Joint Session is now convened be read. Mr. Carter, of the Senate, seconded the motion. Mr. White, of the Senate, moved that the reading of the Resolution be postponed until Monday. Upon the motion being seconded and the point of order being raised, the President declared the motion out of order. Mr. Prendergast, of the House, moved that the ayes and noes be taken on the motion to read the Concurrent Resolution. Seconded by Mr. Mossman, of the House. The ayes and noes were thereupon ordered.

The Senators and Representatives not being supplied with the ayes and noes blanks for both Houses, the Sergeants-at-Arms were instructed to supply the deficiency. While this was being done, Mr. C. Brown, of the Senate, moved that this Joint Session do now adjourn sine die. Seconded by Mr. Kumalae, of the House. Mr. White, of the Senate, moved that the ayes and noes be called on the motion to adjourn sine die. The ayes and noes were thereupon ordered, with the following result:
