The House came to order at 9:11 o'clock a. m., pursuant to adjournment.

The following Resolution was introduced:

H. R. No. 82, by Mr. Hihio, requesting the Superintendent of Public Works to furnish a copy of the report for the installment of a Government water plant, etc., at Lahaina. Adopted.

BILLS ON FIRST READING.

The following Bill, notice of which had previously been given, was introduced, read by title, passed first reading, and was ordered printed:

H. B. No. 75, by Mr. Nailima, entitled "An Act providing a system of taxation for the Territory of Hawaii, and repealing all laws heretofore passed and in force relating to taxation."

Notice was given of intention to introduce the following

By Mr. Monsarrat, entitled "An Act to amend Section 120 of the Civil Code, as amended by Chapter 22 of the Session Laws of 1892."

Also, "An Act to amend Section 14 of Chapter 35 of the Session Laws of 1888, relating to Tresspass of Animals."

By Mr. Prendergast, entitled "An Act providing for a specific tax of ten dollars on each ton of sugar annually produced in the Territory of Hawaii."

By Mr. Emmeluth, entitled "An Act requiring directors or other officers having the management of joint stock companies. to keep true accounts of the business of the company, and providing for the audit of such accounts."

BILLS ON SECOND READING.

Consideration of the following Bill on second reading was resumed as unfinished business:

S. B. No. 26, by Mr. Kalauokalani, entitled "An Act to provide for the exemption of certain personal property from attachment, execution, distress and forced sale of every nature and description; and repealing an Act entitled "An Act to facilitate the recovery of rents," passed on the tenth day of January, 1865, and all other laws and parts of laws in conflict with this Act." The Vice Speaker held that the motion made yesterday by Mr. Robertson to refer the Bill to a Special Committee of five members had been seconded and was first in order. Mr. Robertson moved that the ayes and noes be called on the motion to commit to special committee. Seconded by Mr. Kumalae. Upon the motion to commit, the ayes and noes were called, with the following result:

Ayes---Messrs. Ahulii, Dickey, Hoogs, Keiki, Kekaula, Keliikoa, Monsarrat, Robertson, Kumalae and Wilcox---10.

Noes--Messrs. Emmeluth, Ewaliko, Haaheo, Hihio, Kaauwai, Kauimakaole, Kaniho, Kawaihoa, Mahoe, Makainai, Makekau, Mossman, Nailima, Paele, Prendergast and Puuki---16. . Present and not voting---Mr. Vice Speaker---1.

Absent---Messrs. Aylett, Gilfillan and Mr. Speaker---3.
Whereupon the Vice Speaker declared the motion lost.

The amendment offered by Mr. Gilfillan to strike out the words "a physician, etc.," to the end of the paragraph, beginning in line 4 thereof, and to add the words "any one" after the word "by" in line 4 thereof was lost.

The amendment offered yesterday by Mr. Robertson, which the Vice Speaker held had been seconded, to add the words "or automobile" after the word "horses" and before the word "by" in line 2 thereof was then put and lost.

Mr. Mahoe moved to reconsider the vote by which Sections 2, 3 and 4 were passed as amended. Seconded by Mr. Mossman. Upon a show of hands, the Vice Speaker declared the motion carried. Mr. Robertson questioned the vote and called for a division. Division being taken, the Vice Speaker declared the motion to reconsider carried. Mr. Robertson again questioned the vote and moved that the ayes and noes be called upon the motion to reconsider. Seconded by Mr. Kumalae and carried. The ayes and noes were thereupon ordered, with the following result:

Aves---Messrs. Ahulii, Emmeluth, Ewaliko, Haaheo, Hihio, Kaauwai, Kauimakaole, Kaniho, Kawaihoa, Keliikoa, Mahoe, Makainai, Makekau, Mossman, Nailima, Paele, Prendergast and Puuki-18.

Noes---Messrs. Dickey, Hoogs, Keiki, Kekaula, Kumalae, Monsarrat, Robertson and Wilcox---8.

Present and not voting---Mr. Vice Speaker---1.

Absent---Messrs. Aylett, Gilfillan and Mr. Speaker---3. Whereupon the Vice Speaker declared the motion to reconsider carried.

Mr. Makainai moved to amend Section 2 by inserting in line 4 thereof the words "in value not exceeding $500.00" after the word "linen" and before the word "and". Seconded by Mr. Robertson. Mr. Emmeluth moved that Sections 2, 3, 4 and 5 pass as in the Bill as originally presented to this House. Seconded by Mr. Mossman. Mr. Dickey moved to amend Section 2 by adding at the end thereof the words "but the exemption in this Section shall not exceed $500.00 in value". Mr. Emmeluth moved that the Bill be referred to the Judiciary Committee. Seconded by Mr. Makekau. The motion to commit was lost. Mr. Robertson questioned the vote and called for a division, which was had, and the motion to commit was declared lost. Mr. Makainai accepted Mr. Dickey's amendment to Section 2 as a substitute for his own amendment to that Section, which amendment was thereupon put to vote and declared lost. Mr. Makainai called for a division, which was had, and thereupon the Vice Speaker again announced the amendment was lost. Mr. Mahoe moved that Sections 2, 3, 4 and 5 pass as they stood in original Bill. Seconded by Mr. Mossman. Mr. Makekau moved that the Bill pass as a whole in the original form in which it was received from the Senate, which motion was seconded. Mr. Emmeluth moved to strike out the last word in the Bill, being the word "passage", in Section 16 thereof, and to add in lieu of such word the word "approval". The motion to pass the Bill as a whole on its second reading as made by Mr. Makekau was thereupon put and carried. Mr. Mahoe moved that the Bill be typewritten and placed on the order of the day for April 1st. Seconded by Mr. Mossman. Carried.

BILLS ON THIRD READING.

The following Bills came up for consideration upon their third reading:

H. B. No. 38, by Mr. Emmeluth, entitled "An Act to amend Section 2 of Act 23 of the Laws of the Republic of Hawaii, Session of 1896." Mr. Makekau moved that the Bill do pass. Seconded by Mr. Ewaliko, upon which motion the ayes and noes were ordered, with the following result:

Ayes---Messrs. Ahulii, Aylett, Dickey, Emmeluth, Ewaliko, Haaheo, Hoogs, Kaauwai, Kanimakaole, Kanilo, Kawaihoa, Keiki, Kekaula, Keliikoa, Kumalae, Mahoe, Makainai, Makekau, Monsarrat, Nailima, Prendergast, Puuki and Robertson---23. Noes---Messrs. Hihio, Mossman and Paele---3. Present and not voting---Mr. Vice Speaker---1.

Absent---Messrs. Gilfillan, Wilcox and Mr. Speaker---3. Whereupon the Vice Speaker announced that the Bill, having received the affirmative votes of a majority of all the members elected to the House, had passed the House.

H. B. No. 44, by Mr. Kawaihoa, entitled "An Act to establish and maintain school libraries." Mr. Emmeluth moved that the Bill do pass. Seconded by Mr. Makekau. Upon the motion that the Bill do pass, the ayes and noes were ordered, with the following result:

Ayes---Messrs. Dickey, Emmeluth, Ewaliko, Haaheo, Hoogs, Kaauwai, Kauimakaole, Kawaihoa, Keiki, Kekaula, Makainai, Makekau, Mossinan, Nailima, Prendergast, Puuki, Robertson and Wilcox---18.

BILLS ON SECOND READING.

The following Bills were taken up for consideration upon their second reading:

S. B. No. 37, by Mr. Paris, entitled "An Act to regulate the fees of witnesses and jurors." Mr. Kaniho moved that the Bill be read by title. Carried. Mr. Robertson moved that the Bill be referred to the Committee on Judiciary. Seconded by Mr. Pacle. Carried.

H. B. No. 41, by Mr. Makainai, entitled "An Act providing for names of streets, roads and lanes in the District of Honolulu, Island of Oahu," together with the report on the Bill by the Committee on Public Lands and Internal Improvements, recommending that the Bill do pass. Mr. Dickey moved the adoption

of the report. Carried. Whereupon the Vice Speaker an

nounced that the House had, by its vote in adopting the report of the Committee, passed the Bill upon its second reading. Mr. Dickey moved that the Bill be typewritten and made the order of the day for April 1st. Carried.

H. B. No. 42, by Mr. Makainai, entitled "An Act providing for the numbering of buildings and lots in the District of Honolulu, Island of Oahu," together with the report of the Committee on Public Lands and Internal Improvements thereon, recommending that the Bill do pass with the amendments as set forth in their report of yesterday. Mr. Dickey moved that the Bill
