BILLS ON SECOND READING.

The following Bills were taken up for consideration upon their second reading:

S. B. No. 6, by Mr. C. Brown, entitled "An Act to repeal Sections 1617, 1618 and 1619 of the Penal Laws, relating to the forest roads." On motion of Mr. Dickey, the Bill was read by its title and referred to the Committee on Agriculture and Manufactures.

S. B. No. 39, by Mr. J. Brown, entitled "An Act to abolish capital punishment within the Territory of Hawaii, and to substitute in lieu thereof imprisonment for life." On motion of Mr. Dickey, the bill was read by title, and on motion of Mr. Robertson, seconded by Mr. Dickey, was referred to the Committee on Judiciary.

BILLS ON FIRST READING.

S. B. No. 26, by Mr. Kalauokalani, entitled "An Act to provide for the exemption of certain personal property from attachment, execution, distress and forced sale of every nature and description; and repealing an Act entitled 'An Act to facilitate the recovery of rents,' passed on the 10th day of January, 1865, and all other laws and parts of laws in conflict with this Act," was taken up on its first reading. On motion of Mr. Makekau, seconded by Mr. Dickey, the Bill was read by title, and on motion of Mr. Prendergast passed its first reading:

REPORTS AND COMMUNICATIONS FROM
HEADS OF DEPARTMENTS.

The consideration of the communication received yesterday from the Secretary of the Territory in re House Journal, which had been postponed until to-day, was thereupon taken up. Mr. Dickey moved that the request be granted. Secorded by Mr. Kumalae. Mr. Paele moved that the Rules be suspended in order to permit him to introduce a Resolution relating to the communication. Seconded by Mr. Makekau. Carried. Whereupon Mr. Paele introduced the following Resolution:

H. R. No. 73:

Be It Resolved by the House of Representatives, that the request of the Honorable Secretary of the Territory for a certified copy of the Journal of this House from the beginning of the present session of the Legislature to the 26th day of the current month, and that thereafter the Journal of each day's session, duly certified, be filed in his office as soon as the same can be prepared; and also, that sufficient money be placed at his disposal for making the necessary copies of the same, be and the same is hereby denied.

Mr. Prendergast moved the adoption of the Resolution. Seconded by Mr. Mossman, but on motion of Mr. Makekau, further consideration of the Resolution was postponed until March 28th. On motion of Mr. Makekau, consideration of the communication to which the Resolution referred was also postponed to the same day.

The calendar being cleared, under various suspensions of the Rules, the following business was transacted:

RESOLUTIONS.

The following Resolutions were introduced:

H. R. No. 74, by Mr. Gilfillan, requesting the Superintend ent of Public Works to furnish all information and copies of correspondence relating to the ownership of Naval Wharf No. 1, Honolulu. Adopted.

H. R. No. 75, by Mr. Emmeluth, as follows:

Whereas, the Governor of this Territory has returned to this House a portion of a certain Resolution introduced on the 12th inst. and duly passed by this House---the Governor stating that the request was too sweeping, etc.; and,

Whereas, the information sought is of a character properly within the province of this House to inquire into, consider, pass on and ratify or reject, accordingly as the law and the sense of this House may determine; therefore,

Be It Resolved, that the Resolution herein referred to and hereto attached be amended by inserting the words "if not inconsistent with the public service" after the word "requested", so the same shall read, “is hereby requested, if not inconsistent with the public service, to furnish this House with the following," etc.; and

That the Clerk of this House certify to the Governor of this Territory the Resolution as hereby amended.

The Resolution was adopted.

The Resolution referred to, and the second request of which the Governor advised this House that he would accede to as soon

as the transcript could be made up, passed the House March 12th, 1901, and read as follows:

Resolved, that the Governor of the Territory of Hawaii be and he is hereby requested to furnish this House with the following:

Originals or copies of all letters, records, books, documents, papers and vouchers, of every nature, kind and description whatsoever, relative to transactions of the Executive Department of the Government from the annexation of these Islands to the United States, to date;

That the Governor submit to this House the correspondence between the President of the late Republic of Hawaii and A. S. Hartwell, the alleged unofficial delegate to Washington during the so-called transition period.

Mr. Makekau moved that the House take a recess until 1:30 o'clock p. m. Lost.

The following Bill, notice of which had previously been given, was introduced, read by title, passed first reading, and was ordered printed:

On motion of Mr. Dickey, the following Bill was read by its title, and, on motion of Mr. Mahoe, passed its first reading, and was referred to the Committee on Enrollment, Revision and Printing:

S. B. No. 37, by Mr. Paris, entitled "An Act to regulate the fees of witnesses and jurors."

BILLS ON SECOND READING.

The following Bills came up for consideration upon their second reading:

H. B. No. 35, by Mr. Prendergast, entitled "An Act to authorize and provide for the construction, maintenance and operation of a street railway upon certain streets and roads in the District of Honolulu, and elsewhere on the Island of Oahu, Territory of Hawaii, by the Hawaiian Tramways Company, Limited." Mr. Mahoe moved, seconded by Mr. Mossman, that the Bill be taken from the table and referred to the Committee on Public Lands and Internal Improvements. Mr. Makekau moved that the Bill remain tabled. Seconded by Mr. Keiki. Carried.

H. B. No. 44, by Mr. Kawaihoa, entitled "An Act to establish and maintain school libraries," from Mr. Emmeluth, Chairman of the Committee on Finance, recommending that the Bill be laid upon the table. Report adopted. Whereupon the Vice Speaker announced that the House had, by its vote in adopting the report of the Committee, laid the Bill upon the table.

On motion of Mr. Robertson, the following Bill was taken up for consideration upon its second reading:

II. B. No. 48, by Mr. Makekau, entitled "An Act providing for and creating certain counties in the Territory of Hawaii, and providing a form of government for such counties." The Bill was read by title, and, on motion of Mr. Makekau, seconded by Mr. Mossman, referred to a Select Committee of seven members to be appointed for that purpose.

PRIVILEGED REPORTS.

Mr. Prendergast, Chairman of the Committee on Enrollment, Revision and Printing, reported the following Bills printed and ready for distribution:

H. R. No. 76, by Mr. Kaniho, requesting the Select Joint Committee on Taxation to report on H. B. No. 11, by Mr. Kaniho, entitled "An Act to abolish personal taxes and to repeal Sections 806, 807 and 809 of the Civil Code, relating thereto," and upon their failing to do so, that the Bill be submitted to the House for immediate action. Laid on the table.

REPORTS OF STANDING COMMITTEES.

The following report of Standing Committee was presented: On H. R. No. 48, by Mr. Haaheo, asking for an appropriation of $8,000 for roads, Puna, Hawaii, from Mr. Emmeluth, Chairman of the Committee on Public Expenditures, recommending that consideration of the Resolution be postponed, to be taken up with the Appropriation Bill.
