RESOLUTIONS.

The following Resolution was introduced:

II. R. No. 67, by Mr. Wilcox, asking for an appropriation of $65,000 for roads and bridges, Kauai. Consideration postponed, to be taken up with the Appropriation Bill.

BILLS ON THIRD READING.

The following Bill was taken up for consideration upon its third reading:

H. B. No. 40, by Mr. Hoogs, entitled "An Act to prevent the employment of minors in places where intoxicating liquors are sold, and to prevent minors from visiting such places." Consideration postponed until a time when introducer should be present.

BILLS ON SECOND READING.

The following Bill was taken up for consideration upon its second reading:

H. B. No. 31, by Mr. Kumalae, entitled "An Act to provide for and to regulate the sending of youths to the Mainland or abroad to be educated." On motion of Mr. Kumalae, the Bill was ordered read section by section. The report of the Committee on Public Health and Education thereon was ordered taken up for consideration. The Committee had recommended that the Bill be tabled. On motion of Mr. Makekau, the report of the Committee was rejected. On motion of Mr. Makekau, the Bill was referred to a Select Committee of three members.

PRIVILEGED REPORTS.

Mr. Prendergast, Chairman of the Committee on Enrollment, Revision and Printing, reported that the following Bill had been presented to the Governor at 10 o'clock this morning:

H. B. No. 1, by Mr. Mossman, entitled "An Act to appropriate money for the purpose of defraying the expenses of the session of the Legislature of the Territory of Hawaii of the year 1901 from the public Treasury," being duly enrolled as H. E. A. No. 1.

BILLS ON THIRD READING.

Mr. Hoogs having come in, consideration of H. B. No. 40 was resumed, and the Bill was read through. Mr. Dickey moved to substitute in line 3, Section 1, for the words "same place" the words "room where the liquors are sold or dispensed." Adopted.

Section 1 thereupon passed as amended. Mr. Robertson moved to strike out in Section 3, beginning with the word "and" in line 4 thereof the balance of the Section; also to amend Section 4 by substituting the word "approval" for the word "publication" in line 2 thereof. Mr. Dickey moved to amend Section 3 by inserting in line 4 thereof, after the word "and" and before the word "the", the words "on his second offense". Mr. Dickey's amendment was adopted. Section 3 passed as amended. Mr. Robertson's proposed amendment to Section 4 was adopted. Mr. Makekau moved that the Bill be typewritten and placed on the order of the day for March 27th. Carried. The Bill was referred to the Committee on Enrollment, Revision and Printing.

BILLS ON SECOND READING.

The following Bills were taken up for consideration upon their second reading:

H. B. No. 51, by Mr. Kaniho, entitled “An Act relating to the segregation of lepers." The Bill was ordered read section by section. On motion of Mr. Monsarrat, the report of the Committee on Public Health and Education thereon was taken up for consideration with the Bill. The Committee had recommended that consideration of the Bill be indefinitely postponed. On motion of Mr. Monsarrat, the report of the Committee on the Bill was adopted, and consideration of said Bill was accordingly indefinitely postponed.

H. B. No. 38, by Mr. Emmeluth, entitled "An Act to amend Section 2 of Act 23 of the Laws of the Republic of Hawaii, Session of 1896," also the report on said Bill by the Committee on Public Lands and Internal Improvements, recommending that the Bill do pass with the following amendments: In Section 1 and line 4 thereof, and also in Section 2 and line 9 thereof, that the figures "1905" be substituted for the figures "1901". On motion of Mr. Kumalae, the report of the Committee was adopted. Whereupon the Speaker announced that the House had, by its vote in adopting the report of the Committee, passed the Bill upon its second reading. On motion of Mr. Dickey, the Bill was ordered typewritten and placed on the order of the day for March 27th.

H. B. No. 50, by Mr. Mahoe, entitled "An Act to repeal Chapter 39 of the Penal Laws of 1897, relating to prohibit gamb ling and gaming." The Bill was ordered read through. Consid eration of the report on the Bill by the Committee on Miscellany, recommending that the Bill do pass, was also taken up, and Mr. Mossman moved that the report be adopted. Seconded by Mr. Makekau. Mr. Dickey moved that consideration of the Bill be

indefinitely postponed. Seconded by Mr. Monsarrat. The motion to indefinitely postpone was lost. The question reverting upon the adoption of the report of the Committee on the Bill, Mr. Robertson moved that the ayes and noes be called. Seconded by Mr. Dickey. Carried. The ayes and noes were thereupon called, with the following result:

Ayes---Messrs. Ahulii, Ewaliko, Hihio, Kaauwai, Kauimakaole, Kaniho, Keiki, Mahoe, Makekau, Mossman, Nailima and Prendergast-12.

Noes---Messrs. Aylett, Dickey, Emmeluth, Gilfillan, Kawaihoa, Kakaula, Kumalae, Makainai, Monsarrat, Paele, Puuki, Robertson and Wilcox---13.

The Vice Speaker declared the motion to adopt the report of the Committee was lost. On motion of Mr. Makekau, further consideration of the Bill was postponed, to be taken up with the Bill on the same subject introduced by that gentleman yesterday. On motion of Mr. Monsarrat, the House thereupon stood in recess until 2 o'clock p.

The House reconvened at 2:04 o'clock p. m. The Hon. F. W. Beckley, Vice Speaker, took the Chair, the Speaker being absent.

BILLS ON SECOND READING.

The following Bills came up for consideration upon their second reading:

H. B. No. 15, by Mr. Haaheo, entitled "An Act to amend Section 814, Chapter 59, of the Civil Laws." On motion of Mr. Mahoe, the Majority and Minority Reports of the Judiciary Committee upon the Bill were also taken up for consideration; the Majority Report, signed by Messrs. Paele, Keliikoa and Haaheo, recommending that the Bill do pass, and the Minority Report, signed by Messrs. Emmeluth and Robertson, recommending that

the Bill be referred to the Select Joint Committee on Taxation. Mr. Mossman moved to adopt the Majority Report. Seconded by Mr. Mahoe. Mr. Robertson moved the adoption of the Minority Report. On being put to a vote, the Report of the Majority was adopted.

The Sergeant-at-Arms announced a communication from the Honorable Senate.

Mr. Dickey rose to a point of order and claimed that as the Majority Report did not contain the specific recommendation that the Bill do pass, that the adoption of the report had not passed the Bill on its second reading. The Vice Speaker ruled that while the report of the Committee was not technically in proper form, the intent of the recommendation was that the Bill do pass. Mr. Dickey appealed from the decision of the Vice Speaker, and the House sustained the Vice Speaker's ruling. Whereupon the Vice Speaker declared that the Bill had passed its second reading upon the adoption of the Report of the Committee by the vote of the House.

S. B. No. 28, by Mr. Crabbe, entitled "An Act to prohibit the unlawful wearing of the badge of the Grand Army of the Republic." Copies not having been supplied to the members, consideration was temporarily postponed. Later, on motion of Mr. Dickey, seconded by Mr. Mossman, the Bill passed its second reading and was ordered typewritten and made the order of the day for March 27th.

BILLS ON FIRST READING.

The following Senate Bills were read by title, passed first reading, and were ordered printed:

S. B. No. 6, by Mr. C. Brown, entitled "An Act to repeal Sections 1617, 1618 and 1619 of the Penal Laws, relating to forest roads."

S. B. No. 39, by Mr. J. Brown, entitled "An Act to abolish capital punishment within the Territory of Hawaii, and to substitute in lieu thereof imprisonment for life." On motion of Mr. Paele, the Bill was read by title and, on motion of Mr. Ewaliko, passed its first reading.

S. B. No. 36, by Mr. White, entitled "An Act relating to the appointment of bailiffs for certain Courts in the Territory of Hawaii and defining the duties and powers of such bailiffs and fixing the amount of their compensation, and providing for the payment of such compensation.' Mr. Wilcox moved that the Bill be rejected. Seconded by Mr. Dickey. Mr. Prendergast moved that the Bill pass its first reading. Seconded by Mr. Mossman. The motion that the Bill do pass carried.

Sir: Section 69 of an Act to provide a Government for the Territory of Hawaii, approved the 30th day of April, A. D. 1900, provides among other duties of the Secretary of the Territory that "he shall within thirty days after the end of each session of the Legislature transmit to the President, the President of the Senate and the Speaker of the House of Representatives of the United States one copy each of the laws and journals of such session."
