AFTERNOON SESSION.

The House reconvened at 2:02 o'clock p. m. Mr. Speaker in the Chair.

BILLS ON FIRST READING.

Under a suspension of the Rules, the following Bill, notice of which had previously been given, was introduced, read by title, passed its first reading, and was ordered printed:

H. B. No. 59, by Mr. Gilfillan, entitled "An Act to authorize and regulate the placing of electric wires and poles of Oahu Ice and Electric Company on the streets of Honolulu and elsewhere on the Island of Oahu."

NOTICES OF BILLS.

Under a further suspension of the Rules, notice was given of intention to introduce the following Bill:

By Mr. Haaheo, entitled "An Act entirely abolishing Chapter 62 of the Penal Laws of 1897, relating to leprosy."

BILLS ON SECOND READING.

H. B. No. 36, by Mr. Makainai, entitled "An Act providing for the control and management of the Government sewerage system." Consideration of Bill was resumed and read section by section.

Sections 1 and 2 passed.

Section 3 passed as previously amended.

Section 4 was, on motion, amended by striking out the word "ten" in line 1 and substituting therefor the word "fifteen"; and by inserting in line 3, after the word "newspapers," the words "published at the place where such sewer system is in operation." Whereupon the section passed as amended.

Section 5 was amended by substituting the word "thirty" for the word "fifteen" in line 1. Whereupon the section passed. On motion of Mr. Robertson, Section 6 was referred back to the Committee on Public Lands and Internal Improvements, with instructions to insert a maximum schedule of rates which the Superintendent of Public Works can charge,

Section 7 was passed.

Section 8 passed as previously amended by adoption of the report of the Committee. Mr. Haaheo moved to strike out the word "fifty" in line 4 of Section 8 and insert the word "twentyfive". Lost.

Section 9, on motion of Mr. Dickey, was stricken out. On motion of Mr. Prendergast, the motion to strike out was reconsidered and lost.

On a reconsideration of Section 1, a motion of Mr. Makekau to strike out all the section after the word "Honolulu", in line 2, was lost.

Section 10 was passed as in the draft.

Section 11 was, on motion of Mr. Dickey, amended by strik ing out the word "publication" and substituting the word "approval". Whereupon the section was passed.

On motion of Mr. Dickey, further consideration of this Bill was deferred until the report of the Committee on Public Lands and Internal Improvements on Section 6 should be re

ceived.

BILLS ON SECOND READING.

The following Bills came up for consideration upon their second reading:

H. B. No. 8, by Mr. Puuki, entitled "An Act to amend Section 117 of Chapter 10 of the Civil Laws of 1897, relating to attending schools." The Bill was taken up section by section.

H. B. No. 21, by Mr. Hihio, entitled "An Act to provide that only American citizens and qualified voters of the Territory of Hawaii shall be employed in public works." Consideration postponed until Substitute Bill, H. B. No. 56, by Committee on Judiciary, entitled "An Act to regulate the employment of labor on the public works of this Territory," previously introduced, should come up for consideration.

H. B. No. 22, by Mr. Hihio, entitled "An Act to provide that eight hours shall constitute a legal day's work, either mechanical or industrial." Consideration postponed until Substitute Bill, H. B. No. 56, by Committee on Judiciary, entitled "An Act to regulate the employment of labor on the public works of this Territory," previously introduced, should come up for considera

tion.

H. B. No. 24, by Mr. Dickey, entitled "An Act empowering District Magistrates to issue commissions to take testimony." It was discovered that by the adoption of the report of the Commiton this Bill it had been indefinitely postponed.

H. B. No. 25, by Mr. Dickey, entitled "An Act providing for judgments by default in suits upon contracts before District

Magistrates." The Bill was read section by section. On motion. of Mr. Makekau, Section 1 was stricken out. Whereupon, on motion of Mr. Makekau, the Bill was indefinitely postponed.

PRIVILEGED REPORTS.

Mr. Prendergast, Chairman of Committee on Enrollment, Revision and Printing, reported the following Bills printed and ready for distribution:

H. B. No. 40, by Mr. Hoogs, entitled "An Act to prevent the employment of minors in places where intoxicating liquors are sold, and to prevent minors from visiting such places."

H. B. No. 41, by Mr. Makainai, entitled "An Act providing for names of streets, roads and lanes in the District of Honolulu, Island of Oahu."

H. B. No. 42, by Mr. Makainai, entitled “An Act providing for the numbering of buildings and lots in the District of Honolulu, Island of Oahu."

H. B. No. 43, by Mr. Monsarrat, entitled "An Act giving the right of appeal to any person adjudged in contempt, by any Circuit Court, or by any Judge of any Circuit Court, or by any District Magistrate, or by any officer or person authorized by the laws of said Territory to take testimony, in the Territory of Hawaii, from such decision to the Supreme Court of said Territory; and prescribing the procedure governing the same, and providing for bail in such appeals."

H. B. No. 44, by Mr. Kawaihoa, entitled "An Act to establish and maintain school libraries."

H. B. No. 45, by Mr. Dickey, entitled "An Act to amend Chapter XLII of the Penal Code, entitled 'Keeping a disorderly house,' by adding two new sections thereto, relating to the landlords and owners of houses, buildings and premises wherein disorderly houses are kept."

H. B. No. 46, by Mr. Ewaliko, entitled "An Act to amend Section 812 of the Civil Laws, relating to carriage tax."

H. B. No. 47, by Mr. Makainai, entitled "An Act to amend Section 374 of the Civil Laws of 1897, relating to the maintenance of highways."

H. B. No. 49, by Mr. Keiki, entitled "An Act to appropriate pension for ex-Queen Liliuokalani."

H. B. No. 50, by Mr. Mahoe, entitled "An Act to repeal Chapter 39 of the Penal Laws of 1897, relating to prohibit gambling and gaming."

H. B. No. 51, by Mr. Kaniho, entitled "An Act relating to the segregation of lepers."

The House came to order at 9 o'clock a. m., pursuant to adjournment. A quorum not being present, adjournment was taken until 9:30 o'clock, when the House reconvened.

BILLS ON THIRD READING.

Under a suspension of the Rules, the following Bills came up for consideration upon their third reading:

H. B. No. 1, by Mr. Mossman, entitled "An Act to appropriate money for the purpose of defraying the expenses of the session of the Legislature of the Territory of Hawaii of the year 1901 from the public Treasury." Mr. Mossman moved to reconsider the vote upon which the House concurred in the Senate amendment to said Bill. Carried. Mr. Mossman thereupon moved to strike out the word "publication" in Section 2 and in

sert in lieu thereof the word "approval". Amendment carried. On motion of Mr. Emmeluth, the Senate amendment to strike out the letter "u" in the word "fourty" in the draft submitted to the Senate was concurred in. Thereupon, on motion of Mr. Makekau, the Bill passed as amended.

H. B. No. 17, by Mr. Robertson, entitled "An Act relating to practice in criminal cases and amending Sections 1, 2, 3 and 4 of Chapter XL of the Session Laws of 1876." An error being detected in the typewritten draft, on motion of Mr. Robertson, further consideration of the Bill was deferred until March 20th.

The Sergeant-at-Arms announced a communication from the Honorable Senate.
