REPORTS AND COMMUNICATIONS FROM
HEADS OF DEPARTMENTS.

Mr. Kekaula moved that the communication of the Superintendent of Public Works presented the day before be taken up and considered. Carried. Mr. Kekaula then moved that the said communication be referred to the Committee on Public Lands and Internal Improvements. Carried.

PETITIONS, MEMORIALS AND COMMUNI-
CATIONS.

The following Petitions were presented:

Petition No. 8, by Mr. Ewaliko, from residents of the First District, on different subjects. Referred to the Committee on Miscellany.

Petition No. 9, by Mr. Robertson, from the Inter-Island Steam Navigation Company, asking that the sum of $136.25 be appropriated to the company's credit on account of the wrecked steamer Kilohana's coasting license. Referred to the Committee on Judiciary..

BILLS ON SECOND READING.

The following Bill was taken up for consideration upon its second reading:

H. B. No. 26, by Mr. Dickey, entitled "An Act to repeal Section 1 of Chapter LVI of the Penal Code of 1869, and Chapter XXXVI of the Session Laws of 1890, relating to the desertion of husband or wife," upon report from the Committee on Miscellany, by Mr. Mahoe, Chairman, recommending that the Bill be rejected. Mr. Emmeluth moved to postpone the consideration of the Report until to-morrow. Lost. Mr. Ewaliko moved that the Report be adopted. Seconded by Mr. Mossman. Mr. Emmeluth then asked to be excused from voting on the motion, which was granted. On motion of Mr. Dickey, the ayes and noes were called upon the motion to adopt the Committee's report with the following result:

Mr. Prendergast, Chairman of the Committee on Enrollment, Revision and Printing, reported the following Bills printed and ready for distribution:

H. B. No. 28, by Mr. Kumalae, entitled "An Act to adopt a flag for the Territory of Hawaii."

H. B. No. 29, by Mr. Kaniho, entitled "An Act to amend Section 811 of the Civil Code, relating to cart and dray tax."

H. B. No. 31, by Mr. Kumalae, entitled "An Act to provide for and to regulate the sending of youths to the Mainland or abroad to be educated."

H. B. No. 33, by Mr. Hihio, entitled "An Act for the suppression of vice and immoral and lewd practices, and to repeal Sections 856 to 863, both inclusive, of the Penal Laws of Ha

H. B. No. 44, by Mr. Kawaihoa, entitled "An Act to establish and maintain school libraries."

On motion of Mr. Hihio, the House thereupon stood in recess until 1:30 o'clock

BILLS ON SECOND READING.

The following Bills were taken up for consideration upon their second reading:

H. B. No. 34, by Mr. Prendergast, entitled "An Act to provide for the Great Seal of the Territory and to repeal Chapter V, Title II, Civil Laws of Hawaii," upon report from Mr. Mahoe, Chairman of the Committee on Miscellany, recommending that the Bill do pass. Mr. Robertson moved to amend by striking out all words after the word "Territory" in the title, as well as the whole of Section 2, and to change the number of Section "3" to Carried. Mr. Makekau moved that the report of the Committee be indefinitely postponed, and the Bill passed as amended. Carried. Mr. Prendergast moved that the Bill be typewritten and placed on the order of the day for March 14th. Carried.

H. B. No. 16, by Mr. Robertson, entitled "An Act relating to the criminal jurisdiction of District Magistrates and amending Section 1 of Act 40 of the laws of 1896 and Section 11 of Chapter LVII of the Laws of 1892." On motion of Mr. Robertson, the Bill was read section by section, and the amendments recommended by the Committee on Judiciary inserted. On motion of

amended, and the whole Bill passed its second reading, was ordered typewritten and placed on the order of the day for March

14th.

H. B. No. 17, by Mr. Robertson, entitled "An Act relating to practice in criminal cases and amending Sections 1, 2, 3 and 4 of Chapter XL of the Session Laws of 1876." On motion of Mr. Robertson, the Bill was read section by section, and was ordered typewritten and placed on the order of the day for March 15th, the motion that the Bill do pass having carried.

REPORTS OF STANDING COMMITTEES.

The following reports of Standing Committees were presented:

On H. B. No. 18, by Mr. Robertson, entitled "An Act to amend Section 2 of Chapter 1 of the Penal Code, defining felonies and misdemeanors," from Mr. Emmeluth, Chairman of the Committee on Judiciary, recommending the following amendments: Section 1, line 5 thereof, strike out the word "all"; in the same line, and in lines 6 and 7, strike out the words "offenses against the Territory of Hawaii and sentenced to imprisonment for a period not exceeding one year," and insert in place thereof the words "and sentenced for misdemeanor". In line 7, strike out the word "so", also the words "a period" and insert in place thereof the word "felony". In line 7, after the word "convicted" insert the word "of". Strike out all of line 8, so that the latter part of Section 1, beginning with the word "persons" in line 5 shall read as follows: "Persons convicted of and sentenced for misdemeanor shall be kept separate and apart from persons convicted of and sentenced for felony." With these amendments, the Committee recommended that the Bill do pass. On motion of Mr. Robertson, consideration of the report was postponed, to be taken up with the Bill.

On H. B. No. 20, by Mr. Paele, entitled "An Act to amend Sections 872 and 873 of the Penal Laws of 1897," from Mr. Beckley, Chairman of the Committee on Public Health and Education, recommending that the word "and" between the words "dead" and "respecting", in the 5th line, Section 1, be stricken out, with which amendment the Committee recommended the Bill do pass. Mr. Paele moved that consideration of the report be postponed, to be taken up with the Bill. Carried.

BILLS ON FIRST READING.

Mr. Beckley, Chairman of the Committee on Public Health and Education, presented a communication from J. S. B. Pratt, Executive Officer of the Board of Health, accompanied by an Act recommended by the Board of Health, entitled "An Act authorizing the Board of Health to prohibit persons afflicted with leprosy and pulmonary tuberculosis from entering and remaining in this Territory." On motion of Mr. Dickey, the Bill passed its first reading, as II. B. No. 52.

Mr. Monsarrat moved that the House now proceed to the order of the day. Carried.

BILLS ON THIRD READING.

The following Bill was taken up for consideration upon its third reading:

H. B. No. 13, by Mr. Robertson, entitled "An Act to repeal certain obsolete laws." Mr. Robertson moved that the Bill be referred back to be re-typewritten and made the order of the day for March 14th. Carried.

On motion of Mr. Hihio, the House thereupon adjourned.
